ALMOST..... The best DUI Video. Should've covered the people that have a little more knowledge of the law. I have a lot of experience in this area (but not a lawyer) and I know that even "Lawyers" fail to follow their own advice under the extreme pressure of a DUI arrest. Please make another video in which case a more knowledgeable and (perhaps) braver person does NOT submit to FST or BT.

I would like to see advice on not just what to do after I've been charged with DUI, but how to best conduct myself during the traffic stop and police interaction before the arrest to increase the possibility of a favorable outcome, and how not to make decisions that will damage my case further than what was unavoidable. Of course the best policy is never drink & drive. To that end I'm 63 and never had a DUI. I haven't even had a moving violation in 20 years. I don't drink much. I'm literally a 2 beer twice a year drinker. Those are reasons why I never fell into the DUI trap. I'm only thinking about the contingency for "what if". I am not experienced. If it happens to me it will be my first time. You are a little ambiguous on submitting to the breathalyzers. Should I refuse the roadside one but take the other one downtown at the police station, or refuse them all, or take them all? I already know not to submit to the FST. I also know not to make any statements or admissions, or answer any questions pertaining to my activities or travel, or any questions not directly pertaining to the traffic stop, and to remain silent if arrested. If this happens to me I would like to give my lawyer the best possible case to work with by not making any mistakes. Thanks.

@@driverdefenseteam I'm truly flattered, thank you! BTW I'm in northern IL and frequently travel in Du Page, Kane, Kendall etc. If I may expand, I've also gleaned that in today's zero tolerance climate when the cop asks have you been drinking, the correct answer is a polite firm "no". There can't be any nuanced explanation because anything less than a flat no will be considered an admission. I've also seen that cops can charge DUI even when you're sober in some cases. It seems like once the cop decides to pursue a DUI investigation then you will have choices to make, and maybe different circumstances could change some of the choices one should make, or maybe not, I don't know. If I may, I have 3 possible roadside scenarios: #1 You have had literally nothing to drink and the cop is just plain wrong. #2 You had 2 drinks a few hours ago and you don't feel over the limit, but you wouldn't bet on it. #3 You are over the limit and you know it. @@wadewen1008 when someone gets arrested and charged with a criminal offense, that becomes public information. So lawyers and other people can acquire the information of people arrested and then market to them by sending those mailers. Hope that helps clear it up!

Hi, good video! I have a question, let's say that you refused both FST and breathalyzer. The SOS suspends your DL for 12 months, can you fight this suspension and if yes, what are the odds of winning it? Thanks,

Yes you can fight the suspension. Your attorney will file a Petition to Rescind the Statutory Summary Suspension. Then you can have a hearing where he/she will argue that the suspension should be rescinded (removed). There are a few legal arguments that can be the basis for the rescission of the suspension. Your attorney can figure out if those arguments exist and what the strength of them may be.
