A lot of auditors go and record buildings and no one bothers them so the videos are too boring and long to upload. So in reality we only see 1% of auditor videos. If cops stopped detaining auditors the entire hobby would end overnight.

Just listen to this judge and you'll see what the biggest problem we are having with law enforcement these days. The cops lawyers are constantly attempting to dance around the U.S. Constitution. This judge constantly has to remind these lawyers that they do not have probable cause to even demand identification from Mr. Turner. I mean, they don't get it, it's crystal clear to anyone with half a brain that the cops in this case were completely acting outside of the law. There is no probable cause of a crime, video-taping from a public street cannot be considered suspicious or a crime. Cops hate when someone knows their rights, refusing to cooperate with an investigation that is being done on one's self is also not a crime. Their entire argument is completely absurd and unreasonable.

What's funny is the cop union lawyer is claiming it wasn't an arrest when they put him in handcuffs and stuck him in the squad car, even though that's clearly an arrest. But even if it wasn't an arrest and was only a detainment then they only had legal authority to FRISK Phillip for weapons for the bogus "officer safety" excuse, NOT SEARCH him or seize any of his property. It's clear as crystal on the bodycam footage that they searched his pockets and seized his phone and keys. So if it wasn't an arrest... then it was an illegal search. And if it was an arrest then it was an illegal arrest because they did not have probable cause that the commission of a crime was in progress or imminent. I don't know why this cop union lawyer even came to these arguments, they played themselves on video... there's no space to weasel out. Either illegal search or illegal arrest.

D.A.'$ are criminals. Most should be in jail. That goes for most lawyer's. I had a lawyer win a case for me ($10,000 later, and 3 different judges and 6 different D.A.'$. Got it dismissed ) my lawyer actually said " wouldn't it be great to have a Purge night?!...like the movie, some people just deserve to die". Referring to the D.A. and corrupt judge's and court system....

I must admit, I skipped toward the end. But she was asking irrelevant questions like whether or not Philip was filming to make a statement, the police are busy and shouldn't be bothered, etc. She's right, the police should leave the guy with the camera alone, but that's not what she meant. Ivory towers can remove people from reality. Was the male judge any better?

Dave, yes, the male judge was clearly far more informed. I like how you picked up on the female judge's accidental statement that I think everyone can agree on. After all, the police really ought to have better things to do, like go fight real crime, than mess with a law-abiding videographer.

Battiousai, who was the lawyer for the police? He lied. He said 'my understanding is the police called for the supervisor". The tape clearly shows that YOU asked for a supervisor when they were hooking you up. He should be disbarred

There was a motion to dismiss the lawsuit on the 3 cops in their individual capacity. Originally that motion was granted, but later, on appeal, it was partially overturned. Eventually the first 2 cops would not have qualified immunity on the basis of that any reasonable person in Turner’s position would believe they were under arrest. The female judge dissented on taking away their qualified immunity on the basis that Turner has requested a supervisor and the first two cops were only waiting for Driver to show up to grant Turner’s request. However, the fatal flaw in her reasoning was they kept Turner cuffed in the back of a hot police car. If they had let uncuffed Turner and let him out of the car her reasoning would be more valid, but they didn’t do that.

She talked about how busy the police are - Well, if they're THAT busy, how about going out and fighting real crimes, rather than harassing, detaining and torturing, a citizen for performing a "non-crime"? If they are so busy then how is it that 10+ 🚔 cars/officers show up for a guy filming with just a 📸 camera(Almost Immediately)? Or in response to a guy on a bike 🚲 with a dim tail light 🏮(less than 10 minutes)❓ Seriously?? You need that many cops to stand around and intimidate your good citizens on every call? Yet after my neighbors house gets vandalized, nobody showed up for 5 hours and when my friends car was broken into, again it took over 3 hours before an officer showed up to take a report.

The man waited two minutes and called back saying that there was no need to hurry because he shot the prowler. When about 10 police officers arrived in three minutes, they found the prowler sneaking around the area. Then the officer said to the man who called, "I thought you said you shot him." to which the man replied, " I thought you said you were too busy to send anyone here right away."

The city's lawyer screwed up majorly by saying that the cops called the supervisor because they were "trying to figure out what was going on." The judged jumped on that and said that the cops only have a right to continue the detention if they are investigating a crime - not just trying to figure out what is going on.

Officers putting a cuffed person in a car in the heat to " make you sweat " shows clear intent to cause them discomfort and impost negative reinforced behavior modification technique to impose their will on him , Essentially a form of torture . If given the opportunity where is their limit ? Driving the car on a person's cuffed hands to " make you talk " . This behavior by police has no place in a free society . Stay strong and keep up the good work Mr. Turner .

Cops can walk up and ask anyone anything . And anyone can refuse to answer. Right now , that's not a crime. But the cops want it to be. Just imagine living in a fucking world where we are forced to engage in conversation with known liars. I certainly hope you win this one Batt. This one is of major importance. At first, when your lawyer was speaking, I thought for certain this judge was a full blown cop sucker. After listening to him address the cop's lawyer, I have some hope. Thank you Phillip . Attorney wants the law to work like this: In Texas, despite Texas penal code 38.02, failure to identify is cause for further detainment until a finger print scanner can be brought to the scene to force your identity from you, even if the criteria for detainment or arrest is not met, hence no lawful reason to ID you. Well, the judge's response on this one was on the mark, "That's Absurd".

Semantics and loopholes. Thats how the system does it. If they can't get something from you they will force it out of you in any sneaky way that they can. The absurdity is on the courts idea of how ID protection can be overtaken by suspicion and what ifs.

Thanks for posting this. This is the aspect that is missing from so many channels that do this type of advocacy work. The dealing with an attorney, the filings, the court proceedings and such are just as crucial to understand as is the right to film and how to deal with officers on-site.

In 1941-ish, Japanese spies took pictures of Pearl Harbor before the attack, to pinpoint ship locations. The 2001, it is known that the terrorist had taken several pictures of their known targets. I suppose this could be considered “dangerous.”.

The female judge thinks this case is a joke, but the male judge seems thoroughly involved in the case, and I think the ruling is going to go in Phillip's favor. The attorney was a little shaky at first, but he sounded good at the end.

The JUDGE would not let him get away with it. He kept asking what's the CRIME? What crime were they investigating & that lawyer had no answer. LEO is HORRIBLE at when they can get ID. I don't even live in TX & I know it.

What "could be" is not justification to detain anyone. The moment the courts rule it is lawful to detain someone based on SPECULATION about what they "could be" up to, absence of actual evidence, then that allows government to speculate away everyone's rights at anytime under any imagined circumstance. Whether the detention is for 1 second or for years, the principle is the same. Detentions are an arrest. Arrests halt the choice of the individual to leave and thereby treat that individual as property and not as an individual who owns himself. When that arrest/detention is predicated on speculation, absent of actual evidence, that arrest has become unconstitutional.

they shouldnt be allowed to detain anyone unless they commit a crime,even to investigate and detain to do so is against being innocent untill proven guilty ,once u are in their custody its an arrest make no mistake and they can give those hand cuffed moments any lable they want but ur stil not free to leave and thats an arrest or kidnapping one ,.if u or i held a person to investigate them in cuffs or a cage it would be kidnapping ,be no different if i caught my mothers murderer and held him to get all the details locked up in a car with cuffs on ,id go to jail for it,these judges all kno wat happened is against our civil rights but are seeking a loop hole to get cops out of the camras view an the lady judge is definatelly not liking police being watched in their dutys,every thing our government does should be completely legal to video unless its a actual dealing of national security ,courts and police and our leaders should have at least the minimum privacy,wen it comes to dealing with citizens

Your lawyer did a good job. He represented your positions and fought for you, maybe he wasn't the best speaker but he got his points in. I give you huge credit for pursuing legal action against cops it's the only real way we can change system using their methods. Also the police lawyer must be getting paid very well to be able to pull so many 'favorable' court decisions however his error was that all were arrest related whereas yours was a detaining. I think it could go either way, hoping for the best though!

On thing you have to consider is that there was a time limit and typically 15 minutes is not enough time to answer questions and get the point across. It's to give the judges some one on one time with the lawyers to get an idea what's going on besides reading the case. If it were a trial things would be quite different.

Are you claiming de facto arrest? What is the difference between detainment and arrest. Is it lawful to handcuff someone who is simply detained? the 1st cop lawyer got destroyed. The case against Driver is weaker. Why did the judges not see your video? The correct statue is 38.02 not 38.01 which provide definitions. Sec. 38.02. FAILURE TO IDENTIFY. (a) A person commits an offense if he intentionally refuses to give his name, residence address, or date of birth to a peace officer who has lawfully arrested the person and requested the information. (b) A person commits an offense if he intentionally gives a false or fictitious name, residence address, or date of birth to a peace officer who has: (1) lawfully arrested the person; (2) lawfully detained the person; or (3) requested the information from a person that the peace officer has good cause to believe is a witness to a criminal

The Battousai I thought your lawyer did an excellent job. I hope you get a beaucoup damage award. E Williams: YES, a cop can handcuff a detainee, but as is being debated in the Batt's case, it cannot be for PUNITIVE purposes. Batt was handcuffed and placed in a hot car NOT so that the police could investigate a crime (there was no RS a crime had been committed,) he was placed there purely for punitive purposes. Further, if it is shown that Batt's detention rose to the level of arrest, which I think it did, then he was also falsely arrested because the cops lacked PC as well. The Court should rule that Batt's refusal to identify does not create RS and thus is not grounds to detain and conduct an investigation into his identity (circular logic.) And, if is not RS, then is not PC. However, I'm wondering if his "non-cooperation" will play into the Court's decision. Batt did not assert the 5th at the beginning of the cop's investigation. Did this "non-cooperation" create RS? Eagerly waiting for the Court's decision....

A great set of oral arguments, i absolutely loved hearing this and was a first taken aback by the verbal stumbling of your counsel, yet his points and arguments show he knew what he was doing and had his facts (mostly) straight. The questions and points brought by the main Judge give me hope that at least he sees it in your favor we shall wait and see. Please keep up the great work being out there in the muck and asserting your and our rights, without folks like you this would be a very different country we live in.

News now Houston went there a week after the decision........ And guess what the police did...... They detained him, questioned him for 20 times. Nothing changed

I disagree with a comment that said your lawyer didn't do a good job and was not prepared. I thought he did an excellent job, he may have been nervous, fighting not only a team of lawyers but also the system. I may have missed a few things and certainly am not qualified to practice law and rarely even understand the law. I can only say the result speaks for it's self and how you and your Attorney helped all of us to be freer. Thank God you won.

That was so fucking beautiful! When the judge said towards the end “ as in instances like the Boston marathon bombers citizens filming helped the police” in all cases filming exposes the bad guys and exonerates the good guys. CAMERAS DONT LIE! Which is why they don’t want the people to film! They want the option to lie! Plain and simple. Amen for the decisión of this court. Amen for Turner’s hard work. Man, dude, I’m so proud of you! That was so beautiful

No one is asking how a persons identity will help or hurt an investigation. How will a persons ID help in determining if a crime was committed? A hobbyist videographer is not expressive conduct but filming the police out of protest is? What the fuck? Very interesting. Well, I'm certain the judge with the male voice will vote in favor of liberty but I'm not sure about the female judge. She sounds like she would never vote against a cop no matter how serious the allegation.

I think they mean expressive as in exercising your constitutional rights, not as in expressive art.

You do realize how insane that sounds? You can't take photos for their esthetic appeal, you can only take photos if you're making a political statement. In other words, free expression only applies if it's controversial and political in nature. Taking a photo of a sunset is suspicious because it's expressive art but taking photos while protesting and open carrying near an abortion clinic is not because you're exercising your civil rights.

No doubt it is in insane, but that's what the judge in that case ruled, although you have it backwards. He's saying you can't take photos of police unless you are making a first amendment statement, which is what he refers to as "expressive."

Yup. This issue should have been raised. The identity of someone doesn't contribute to an investigation of the crime they supposedly were suspecting him of committing. Oh well.

I think this was my 2nd time listening from start to finish. It strikes me that our perceived rights teeter on a razor's edge controlled by the peccadillos, prejudices and preconceived beliefs of judges who may or may not have the citizens best interest in the forefront of their decision making processes.

They, cops and judges, and all LEO employees, are also, possibly unknowingly or on board, with the population control devices engineered into society. Look at the numbers of people killed by the numerus entities that are responsible for DEATHS OF HUMANS. There has to be a DEATH RATE. I submit if a judge doesn't get his morning BJ from wifie somebody in custody could get the DEATH SENTENCE that afternoon..

I have never sat through an oral arguments before. Not for any court in any state. Not even on the federal level. This was fascinating. I learned more about the law that governs myself, than I ever could have on my own.

There is No Code that simply Says 'reasonable suspicion' it is 'Reasonable Articulable Suspicion that a Crime has been, Is being or is about to be Committed' You Can't just detain for reasonable suspicion, it has to be suspicion of a Crime, Not Reasonable Suspicion that he is Suspicious! Acting Suspicious alone is not enough to detain.

It was a pleasure to listen to this entire oral argument. Hearing the Judges ask pertinent questions was fantastic! It really highlighted whether the Police can ID and lawfully detain someone with "reasonable suspicion" only without articulating a crime. It made me chuckle to visualize the subject standing on the other side of the street across from the Police station, wearing shorts and a Tshirt holding a video camera and the Police felt justifiably threatened that a "crime was afoot", which they were basically unable to verbalize the specific crime that was afoot. And then to punish a man by unlawfully detaining him because he wouldn't "cooperate" with the investigation by providing ID and handcuffing him and placing him in the Police car to "Sweat it out".

Good for you Turner, I'm glad you moved Law. I want to know who the lady judge is, she sounded hateful, arrogant and was not going to change her mind about allowing police to do what they want to do to civilians.

In the original incident,it was actually Turner that asked for a supervisor.As opposed to what is stated in this hearing by Drivers attorney.He says (And I'll paraphrase) "it was the police who called a supervisor so that they were sure that they were doing the right thing"

Batt, hearing the judge inquire about the length of time you spent in the car brings a thought to mind: maybe you should get an Apple Watch so that the time, as well as audio, is uninterrupted during your detentions? When cuffed, I don't think they would have cause to seize your watch. Ha!

This whole case should come down to the "reasonable" part of the suspicion, just like most other First Amendment audits. Everything else is off point. Is it reasonable to detain someone because you suspect them of a crime when they are doing nothing criminal? Of course not. End of story.

When this case came out. I immediately jumped on it and wrote a research paper ,I got a A on my constiutional law class. This case will eventually be part of a criminal Justice court case in the books. LT Drive V Turner. The main reason why this case is so important is not filming police officers. Is filming Public officials in public.

Shutting someone in a car and rolling up the windows to make him sweat, if any citizen did that to a dog in a car, they would do prison time, yet here we have 3 cops deliberately doing this to another human being as a tactic to make him talk. Thank god the judges made the right decision here.

Well, I think it's astounding that, while being so busy dealing with "real crimes," that the police would waste so much of their time investigating a non-crime. Put the blame where it belongs - on the police, who made the decision to approach and harass someone doing absolutely nothing wrong. If they have enough time to harass law abiding citizens, it seems they aren't so busy dealing with "real crime" and therefore, some layoffs are in order.

Imagine standing before the judge as a citizen accused of a crime and claiming “qualified immunity”. It’s literally ignorance of the law. Granted to people who are supposed to enforce it. But people who aren’t taught law mess up once and are prosecuted.

I find it interesting when the female judge dives into the "hobby" aspect or "artist" when talking about filming. I might have plead both, because these videos are works of video art as well as tell a story and have a message..... This could go either way in my book after listening. But you know my interest is peaked now more than ever.

It's amazing to me that Police can internalize EVERY SCOTUS decision that empowers them, (they call it their "tools") yet the basic Civil Rights understood by a 5th grader seems to constantly allude them. BTW, they may have "qualified immunity" but their LEO license doesn't. The People should organize to litigate CLEAT/TCLOSE for licensing people of questionable character/ability/mental status etc. Just like a bad Dr. or Nurse who gets their credentials revoked, they can't be employed where they can inflict their special flavor of discord on the rest of civil society.

Your lawyer isn't a great orator but I think he made solid arguments. The one opportunity that I think he missed though is to point out the occasion that you provided your video to help the police catch a shooter. That would show clear evidence that your videos are not designed only to portray police in a bad light but to can also be of assistance. I hope the court does the right thing and doesn't just give another free pass to the cops.

This is so flippen interesting, I really salute your hard work, tenacity and bravery. You are making Texas and USA a better place to live. Sadly the Police use your tax money to buy the best lawyers and your lawyer seems to be struggling a bit. You have a very strong case and the Judge can see it. Sadly your case is not very well presented and the Judge is trying to nudge your lawyer in the right direction but he is not well prepared. Then the Cop Lawyer gets up and he is a monster with a weak case but the Judge pulled a knot in his tail fairly quickly. I am wishing you the best of luck with the outcome, please keep us updated.
