He’s reselling your flowers. Take him to small claims and never accept a check again. That was a poor business move. We also keep a blacklist at my company for all staff.

A bit more than 50 years ago my dad wound up with an NSF cheque from someone he'd done work for. The guy just kept insisting the money was in there and to talk to the bank so he did just that. Now remember this was a long time ago when you knew the tellers in your local bank and rules were a bit more fluid. That let my dad find out, unofficially of course, that the account was only short something like $20 so he deposited that amount and resubmitted the cheque. He walked away out only a little instead of a lot and the jerk couldn't do anything about it since it was perfectly legal to put money into an account you don't own.

As a florist, I do not make up any order without payment first. Cash or card no checks - for exactly this reason. No flowers without payment,and this goes for ALL customers, including regular customers and family, it just leads to difficult situations or legal ones, like this instance.

Small claims? No, this is a criminal offense. You can afford criminal court AND add any kind of hot check charges you wish, meaning you can charge him a $200 hot check charge and get it all court ordered when he loses in court.

Filing for a small claims case is not overly expensive. But what you do is also sue for the court costs and the time away from work (being forced to close shop for the day) to make up for the lost income. You can also try to put a lien on his house or car so he can't sell without paying you off first. Do NOT confront this guy as it will only turn around to bite you in the ass. If you have CCTV put his picture on a notice in your shop saying he's banned for non-payment and maybe send a copy to other florists/garden centers in your city with a letter saying what he's done. But you're likely to have to sue to put a lien on his property, so small claims is likely your best option. I'm glad he was essentially forced to pay up. Well done on not giving in to his demands to drop charges. I don't know that I would put his name and write's bad checks on an outside sign, but having his picture, name, write's bad checks-refuse service on a bulletin board by the register is fine. Putting it outside could cause you more problems with this guy. I could see him vandalizing your shop. And if you don't currently have cameras outside your home and business you may want to consider getting some.

It isn't the cost, it's the time in small claims court. You can spend days dealing with court delays. He has all those different SUV's because he doesn't pay for them. Some states have laws against shame lists, especially if you include the picture.

In this day and age checks are no longer a viable payment option. If the client can not pay at that moment they can use a credit card. If that is not an option they either need to wait till they can budget it, or go for something more in their price range. I would not be surprised if this guy is reselling her flowers at a profit. OP should also charge a down-payment upfront that covers at least the material costs. Can not help but feel that if OP did post a big sign outside exposing him he will try to sue her.

Credit cards can have stop payments placed on them, payment charges challenged and so on. Lots of different ways to get out of paying a credit card payment to a business. Many people still use checks even if it's not as common as it once was.

I don't believe small claims cost you anything. Want your money back, tell him you will be posting his cheque in your store for all to see. Literally stick it to the store window. Or on the counter with a big sign that says BOUNCED CHEQUES. I had to do this at the store I worked at and you will be surprised how fast they come in to clear up the cheques as they don't want everyone to see that they bounched a cheque. Almost worked everytime we did it. Seriously call him and tell him, betting he comes in.

I find USA bank system weird Country is advanced in tech(love the country just not the banking) but backwards in banking. In most countries you can transfer money or pay by eftpos without paypal or venmo even credit card. Love HAPPY ENDING to this story❤❤

50% on ordering and the balance on collection. Also I didn't realise cheques were still a thing 🤷 Really don't see them often in the UK. Don't accept a cheque (they're not accepted in most retail businesses in the UK now), unless they are paying in advance so it will be cleared before collection.
