Hey guys. Been following only a short while. Appreciate that y’all interact with serious movies in an intelligent way. In that spirit I’d like to suggest a few films that are under known today. In the heat of the night (1967). Groundbreaking for the time. Powerful performance by the two leads. The Deer Hunter. (1978) Powerful casting. This movie made Christopher Walken a star and his first Oscar. It was nominated for an insane amount of awards. After Hours. (1985). It’s a cult classic from Martin Scorcesse. All star cast. Didn’t perform well when first released but has obtained cult status since. N Adam resurrected. (2008). Jeff Goldblum in a role I would not have expected from him. I would call it a performance of a lifetime from him. I love movies and could sit and talk all day about them. And could make you a much bigger bigger list. Cheers. Oh and before I forget. The Reader (2008). Brilliant all the way around

This is a great film. Loads and loads of great actors .. all of them seem to have liked the script .. they even got the famous rock-god Nigel Tufnel to star in it, no doubt hand picked by Rob Reiner. Cheers 🍺

1. “We live in a world of walls, And those walls have to be guarded by men with guns.” If Colonel Jessup had transferred Santiago, the replacement likely would have been up to Marine Corps standards. 2. “We follow orders, or people die. It’s as simple as that.” Jessup received orders from his commanding officer’s from U.S. Navy Region Southeast. Those orders were to cease and desist in the use of code reds as a disciplinary practice. He disobeyed that order. Santiago died as a result. It always struck me how Colonel Jessup was both correct and wrong at the same time.

@@Samstone7 I would argue that Jessup was a Tyrant who truly believed he was right and the absolute authority for the situation, as you see him try to leave without being arrested since he felt right in his actions and did not consider himself a criminal. He never thought he was wrong.

@@multifan1644 I don't think Jessup thought he was a tyrant. It was a freak accident when Santiago died. It went too far and Jessup tried to cover it up. However, there are some others in different situations who think they are doing work for the better of humanity turning out to be a tyrant for their own unknowing personal goals.

I always thought that on some level, if Jessup hadn’t done the illegal things he did, there is some truth to his little speech. About how people discussing war and the military don’t always know what they really have to go through. And we may prefer to not think about that while we live safely sometimes because of what they do. But Jessup goes beyond just feeling under appreciated and onto deciding he’s above the law because he can do whatever HE thinks is right to do his job.

As a Marine veteran, this is probably my favorite movie in the military genre. Most are products of a Hollywood director and producers who have a jaded view of the military, and while they all have military advisors, they tend to be way over the top taking advantage of the majority of the audience that has no military experience. Full Metal Jacket is the perfect example. But in this one, I've met Marines who remind me of each of the different personalities in this flick, and it does convey to some degree the reality of a lot of Marines in combat units, including Jessup and Kendrick. I also spent a year deployed on two different Navy ships, and the difference between Marine and Naval Officers in this film is equally as stark as during the time I served. I got out the year this flick was released. Beyond that, the story was really good and the actors were top notch. Just a fun flick that brings back some good memories. Never saw a Marine killed by another Marine, and we didn't have the term "Code Red", but inter-unit justice was definitely a thing. I know of a Marine who was tossed off the second story balcony of the barracks at Pulgas (Pendleton) for stealing a camera, and ass-kickings were pretty regular. As an NCO in a combat MOS I wouldn't physically attack a Marine in my charge, but I had lots of holes dug in the desert, and, um, some other ways to discipline them in ways that would not result in permanent marks - on their record. Was fun watching you react to this one.

Based on your post, I think that you might like "The Rack" (1956) if you haven't already seen it. It is also a court drama staring Paul Newman, and a young Lee Marvin. It was written by Rod Serling. Great movie!

Former Army here (11b1p), but I definitely remember a few soldiers who shouldn't have been in the army, or at least not an airborne infantry unit, that had a lot of attempts to "fix" them before finally being chaptered out, most of which were not particularly nice.

The script was written by Aaron Sorkin, also responsible for _The West Wing, The American President, Charlie Wilson's War, The Social Network, Moneyball,_ etc. Best known for his smart, snappy dialogue, if you haven't seen any of the above and would like to see more great scenes like the climax of this movie, check 'em out.

One of my favorite movies of all time. Up until this movie I was totally in action movies. With this movie for the first time I understood power of words (The other one worth mentioning is Twelve angry men(1957)). Together with Star Wars, Ben-Hur (1959) and Amadeus (1984) this is the only movie that I probably saw more then 10 times.

Imagine being on set with Kevin Pollak, during Jack Nicholson’s performances. It’s like being at the most fun acting school there is. He just blows everyone away. I worked with people who worked with him in the UK on Batman. A story I heard was that one day during filming he was messing around with two of the crew, and ruined his makeup on his way to the set. Everyone freaked out. He covered for them, saying he fell down the stairs or something and blamed the studio. Got back into make up for another two hours and carried on. Everyone said he was a really kind and mellow guy and not at all what you’d expect. Super intelligent too.

Gitmo is an interesting place. There is a massive minefield, razor fencing and heavily armed bunkers separating the base from the rest of the island, and a couple of hundred Cubans commute to work on the base every day. They work in the base's civilian businesses - there is a fancy and mid-tier restaurant along with some fast food places, a NEX shopping center, movie theater and the like. They were really nice. (edit: the Cubans were really nice)

The funny little bit with Jessup jokingly saying they're surrendering and Tom being like "OK" is brilliant. It shows the absolute authority that Jessup has over the men. Tom didn't hesitate because as Jessup likes to brag about, when he gives an order it is followed. I love little bits of detail like that.

Exactly. It may seem ridiculous, but I've received an order and I'm going to carry it out, as I've been trained. I never made the connection that it emphasizes a point in the movie; that Colonel Jessup's orders would be followed without question.

Footnote: Naval Air Station Guantanamo Bay wasn't always a prison that housed terrorists. It's mainly used for air/sea rescue...and was also used to give Castro the bird...🙂

I've watched recently an Interview with Kiefer Sutherland where he talked about the scene between Jack and Tom and he said everybody was gathering behind cameras (even Bruce Willis who was at the time with Demi) to see that scene and they did it in two shots. Jack recorded the dialogue and used to listen it in his car everyday until the day of shooting. Remarkable actor. Great reaction. A classic for sure!

When I watched this film in the theater, I had no idea that 4 years later I would be an United States Air Force officer and a military trial attorney. Military members taken to a court martial have their choice of having either a jury, or having the case be heard by judge alone. An officer defendant who chooses a jury has a jury composed of officers; an enlisted member who wants a jury can choose between having a jury composed entirely of officers or a jury composed of officers and enlisted members.

In an interview with Rich Eisen, Noah Wylie (of ER fame) told about sitting down for the first table read with Jack Nicholson. Wylie said most table reads are pretty straightforward and dry. He said as soon as Jack Nicholson started to say his lines, everyone around the table, including Tom Cruise and Demi Moore, instantly sat up straight and looked around at one another as if to say - "Oh we're really doing this right now!"

Jack Nicholson earned $5 million for this film for 10 days work. $500,000 a day. That courtroom scene was worth every penny. When they were filming these courtroom scenes Jack was on set when they were filming Tom and Demi and Kevin from the different angles, even though he wasn’t needed that day. But he wanted to be there off screen to feed them their lines. Every time they did a different camera angle Jack performed his lines exactly as you see them in the film, full intensity. Rob Reiner took him aside and said ‘you know Jack, you can hold back a bit if you want until we film your scenes’. Jack said ‘But Rob you don’t understand. I just love to act…’

Regarding why the jury were all military members: A Court Martial, where a member of the military is tried for violations of the Uniform Code of Military Justice (UCMJ), is a military court. The judge, jury, and lawyers are all military, and the military maintains jurisdiction. In some cases, military members can also be tried in civilian courts for violations of general laws. But where it is a military crime, the military courts typically maintain sole jurisdiction. Hope that helps. Love the channel, by the way. You guys put out really enjoyable content.

Oh, also, to get a bit deeper into the weeds, each branch maintains its own Courts Martial. But since the Marine Corps is part of the Department of the Navy, it does not have its own. That is why some of the lawyers (JAGs) were Marines and some were Navy.

One scene that is OFTEN overlooked is when Kaffey is talking to Weinburg. "You don't believe their story. You think they should go to jail for the rest of their lives," "I believe every word of their story and I think they should go to jail for the rest of their lives." That's powerful

Technically, Kendrick did not perjure himself when he said he didn't order Dawson and Downey to give Santiago the code red. Because he didn't. He only ordered DAWSON to do it, not Downey. As they clearly proved in court by showing that Downey wasn't present when Kendrick ordered Dawson to give the code red. The wording in the question is important. He couldn't admit in court that he ordered Dawson and Downey to give the code red because he would have been lying under oath (perjury). He has a right against self-incrimination (5th amendment), and just because he didn't admit to ordering both of them to do what they did doesn't mean he lied. He just didn't incriminate himself via telling that he did in fact order Dawson to do it, just not Downey. Because that's not the question he was asked. He was asked if he ordered BOTH of them to do it, and he did not.

Another Tom cruise film which also fits the war film and inspired by true stories is "Born on the Fourth of July" which is about Vietnam and casualties sent back home. And there there is a Michael J Fox film inspired by real events called "Casualties of War" Both are really good. I personally like "Heaven and Earth" which is from a vietnamese woman's perspective, directed by Oliver Stone as well.

It still makes no sense how Dawson and Downey never told their lawyers that only Dawson was in the room with Kendrick. I mean the lawyers would go over very precise details over and over again, yet it never came up what did you say when Kendrick order you to give a code red.

My understanding of how the US Navy operates, and the Marine Corp is a department of the Navy so it might run things the same way, Jessop would likely be found guilty of conduct unbecoming and discharged. IF (big if) Jessop gets the charges dropped in the scenario you suggested, he'd still lose his command and be transferred to a desk job somewhere else, and that would likely see a man like him choose to retire instead. Either way, he would not run Guantanamo Bay any more.

I found it interesting that YOU found it interesting that the jury wasn’t made up of civilians. After all it IS a military court. Who better to determine the guilt or innocence of soldiers than fellow soldiers? People who actually know what it is to serve and possibly give their lives for their country. Where it’s not an idea or concept, but a way of life.

Dawson and Downey were being tried in a military tribunal not a civilian court of law, given that their actions took place on government property against a fellow member of the Armed Forces, hence why the jury were all officers. A terrific legal drama - if you two haven't seen 12 Angry Men, that's the natural companion; also, My Cousin Vinny for a different flavour of the same style, and some other classics like Anatomy of a Murder, To Kill a Mockingbird, and A Time to Kill.

Great reaction y’all, & really enjoyed your commentary. This is a really good film; terrific screenplay, stellar casting & storyline kept you guessing at times. For two other legal films I must suggest “The Firm” again with a great cast (a John Grisham novel) & imo the greatest courtroom/legal movie ever “12 Angry Men” (an all-star cast)!

It was a Military Courts Martial conducted by the Judge Advocate General (JAG). Military service members have to adhere to the Uniform Code of Military Justice. The swear an oath to abide by it (among other things like... following the orders of the Commander in Chief and those appointed above them and to support and defend the Constitution of the United States from all enemies, foreign and domestic). Colonel Jessup wouldn't get off with a slap on the wrist. He would receive a severe reprimand and would (because of his prior service) have been given the choice of receiving a Discharge Under Other Than Honorable Conditions or retirement. He, obviously would have gone for retirement since his career would have been over anyway.

You might take a look at The Caine Mutiny. It's the OOG military court drama. Legendary performances.

Wow great movie. You should see other legal dramas like Rainmaker 1997 or Civil Action . Also a great lawyer movie with Tom Cruz is The Firm.

In any movie I see portraiting u.s. court law, I'm just amazed how a human's fate can be put down to calculus without properly discussing the charge in a court room.

Here's the problem I have with this movie. Dawson and Downey are both absolutely guilty, if not of murder, than at least of the lesser included charge of manslaughter. First of all the code red was an unlawful order and thus they had a duty not to follow it. Secondly, as to the pre-existing medical condition, that's a textbook example of what's known in legal parlance as an "eggshell skull." It doesn't suddenly become not murder just because the guy has one hit-point.

If you want to watch another strong dialogue / amazing acting movie you should watch Glengarry Glen Ross. Quite possibly the best dialogue driven movie ever.

It was only after 9/11 that Guantanamo Bay became any sort of prison. At the time this movie was made, it was simply the U.S.'s only base on the Island of Cuba.

Pretty much anything Aaron Sorkin writes is amazing. The West Wing is one of the greatest TV shows in history. Netflix has his Trial of the Chicago 7, that'd be a good reaction.

Keifer Sutherland actually scarier than Jack Nicholson. Jessop is the chief, but kendrick is the weapon. Cold and dispassionate. Unaffected by the outcome a blunt instrument as Nathan Jessop’s disposal to wield how he commands with out question. Epic performance by him.

Demi looks so good in that uniform...yes ma'am. Not a bad movie, but I cant say its one I ever felt the need to watch twice. It always kind of struck me a decent TV Movie type affair.
