Accused Entitled To Immediate Release If Arrest Doesn’t Satisfy Section 41 CrPC: Bombay HC
In an important pronouncement, the Bombay High Court on Monday observed that an accused is entitled to be immediately released if the requirements of a lawful arrest as laid down under Section 41 of the CrPC are not fulfilled.
The order was passed while granting interim relief of bail to Ex-ICICI Bank CEO Chanda Kochhar and her husband Deepak Kochhar in the ICICI Bank-Videocon loan fraud case.
