The Quran is very clear on this matter. It states that marriage is a contract. Now, in order to enter a contract you need to be somewhat mentally, physically and intellectually developed, otherwise how do you know what your contractual duties are, how do you understand the requirements? A 6,7,9 year old girl does know her duties as a wife, so how could our beloved prophet (who was also very intelligent) marry a child who can not fulfill her contractual duties? She would have been minimum in her late teens in order to enter and understand a marital contract. Marrying a 9 year old would have sounded wrong 1400 years ago and still sounds really wrong. The answers are all in the Quran. 🤲🏽

You wonder why Aisha keeps resurfacing as a topic? Less enlightened souls like Daniel H. have promoted the topic of intercourse with prepubescents and less than a week ago announced in a 5 hour session he wants minor marriage to become a winner topic. In simple terms: though some countries have reduced Minor Marriage and legislated against it: some Muslim communities still practice it and some still promote it. .So it keeps coming back.
@generalpro6141

A winner topic? Wdym by that? Also I don’t think he promotes sex with prepubescents. Although he does promote the idea of sex with girls as soon as they hit puberty I agree with that. With prebuscent girls he probably means marriage without the girl leaving the house. To go the husband house.

Then he makes clear it was for reproduction at 46:05 kzitem.info/news/bejne/wHuil2ePkamDd4I “in the vast majority of history life expectancy was relatively low infant mortality was considerably high and so therefore was necessary to use the extent of the fertility window for reproduction” and he claims researchers like Rind think it is OK. @concerned_parent

@@generalpro6141 1. Yes, prepubescent means before biological puberty. Islam made it permissible to contract and consummate marriage prior to puberty and prior to option of puberty. In fact: it is easy to find fatwas for all madhabs that list pregnancy or menarche as a sign of puberty. This was a logical consequence of it being permissible to consummate prior to puberty. So a girl can discover she has become an adult by being pregnant, in Islam. 2. A winner topic, means that it is easy to start about it again and again because it is is relatively easy to prove and there is little defense against it. Since MALM is maliki you can easily check: malikifiqhqa site uncategorized/about-female-maturity-shaykh-abdullah-bin-hamid-ali/ Maliki “by menstruation, or by becoming pregnant (even if she was not known to have a menstrual cycle). ….And if none of these signs appear, she is considered legally responsible once she reaches 18 lunar years.”

When the mainstream sunni scholars, the dawah givers or just the ordinary Muslims exalt the status of Aisha to the level of a “ Mother of believers “ while ignoring the Prophets (pbuh)first wife that was most beloved one it’s a manifestation of the men’s sexual depravity! This is a psychological topic . Of course young and versatile girl is a much bigger attraction to the younger or older men especially. That's the nature. If the Islamic scholars wouldn't think with the lower head there would be no need to defend the Prophet's( pbuh) honor now. They will fight to the death for the Aisha’s child marriage narratives.

Excellente lecture Mufti! And it was easy to listen to and follow. Thank you for being a voice of reasoning. This is why over the years I have resolved to one thing! Sticking to the Quran Alone! As a layman I have neither the leisure, nor the natural ability to first, understand Arabic, 2nd, i do not have a scholarly knowledge of Hadiths literature, Sira or other so-called Islamic source outside of the Quran, 3rd I do not think ALLAH left out anything out the QURAN as far as our Deen is concerned. What he authorized and forbade does not need to be shuffled through the thousands of post-prophet Muhamad (PBUH) documents or writing that he has not authored let alone authorized. The topic of Aisha’s âge only troubles those who actually give great importance to the Hadiths. ALLAH revealed what we need to know to his Messenger (in Quran) and that honestly suffices me! Maybe if all Muslims did the same, you would have to grace us with your beautiful lecture! Salaams to all.

The problem if child-marriage is not that all Muslims promote or practise it. But it is true that the madhabs still allow it and that some communities still practice minor-marriage with khyiar-al-bulugh, with the unconsummated marriages rules in Q33:49, Q2:235-7 minor marriage in Q65:4. So there is a wide band of related hadiths with Muhammed deciding on option of puberty, with linking minor marriage to Q2:237. Wit Muhammed commenting on child-marriage of other companions, etc. etc. Fact remains that it is historically not unlikely or impossible that Muhammed married a child. One clear problem is that some clerics and leaders still promote child-marriage in Islam. That is what keeps attracting attention to it.

So is Abu Ishaq Sa`d ibn Ibrahim who reports it from Imam al-Qasim ibn Muhammad - one of the Seven Imams of Madina - from `A’isha. In addition to the above four Madinese Tabi`in narrators, Sufyan ibn `Uyayna - from Khurasan - and `Abd Allah ibn Muhammad ibn Yahya - from Tabarayya in Palestine - both report it. Nor was this hadith reported only by `Urwa but also by `Abd al-Malik ibn `Umayr, al-Aswad, Ibn Abi Mulayka, Abu Salama ibn `Abd al-Rahman ibn `Awf, Yahya ibn `Abd al-Rahman ibn Hatib, Abu `Ubayda (`Amir ibn `Abd Allah ibn Mas`ud) and others of the Tabi`i Imams directly from `A’isha. This makes the report mass-transmitted (mutawatir) from `A’isha by over eleven authorities among the Tabi`in, not counting the other major Companions that reported the same, such as Ibn Mas`ud nor other major Successors that reported it from other than `A’isha, such as Qatada! I also dont think she was 9 as the ages themselves in the hadith are not consistent nor do I think it fits in with our society today. HOWEVER, even if she was 9 it shouldnt affect your iman. Doing so is using intemporal abstractions on a man and culture 1400 years ago. You cant separate the Prophet PBUH from his culture and environment completely. If that were the case, slavery would have been banned during his lifetime. Its been practiced in his day all the way until now amongst the Muslims who are one of, if not THE, biggest slaveholders and traders since the Prophets day. Before anyone comments about trajectory hermaneutics (I've watched Mufti's video and dont disagree with it completely), it still shows that he never completely outlawed it as he did with adultery, shirk, etc. Its dangerous to completely have a 100% stance that he did or didn't do it because we have no reliable documents to state either. If we were to somehow have irrefutable evidence that she was 9, would you become an apostate due to that alone? The deen shouldnt hinge on whether he had relations with a 9 year old or not.

So what is the age of consent according to Islam?
@stadiamak692
Жыл бұрын
Questions like this are baffling... you talk about a concept that has only recently been invented and then what Islam's views on that... The best you are going to get is a scholars inteprration of what consent is and when it is applied.... You're not going to get a specific age of consent... like how you have uk law that says 16 or France that says x age

@@stadiamak692 Mufti's stance is, the prophet could not have slept with a 9 years old because it’s "immoral", so he should have specified how old a woman has to be for it to be considered no longer immoral. Emotions aside he should be able to answer the question logically. In 1880, the ages of consent in America were set at 10 or 12 in most states, with the exception of Delaware where it was 7.

@@Full2635 suggest you go to around 27:00 for more arguments he gives. Also, I recommend you watch Mufti’s age of Aisha video. The argument that this hadith passes through mostly Iraqi’s is quite a strong argument. The fact that this chain doesn’t pass through the hijaz is pretty fishy. There are also hadiths that conflict with the age this specific hadith puts Aisha’s age at. The fact that Aisha was engaged before the Prophet married her is even more evidence that this hadith is false since Aisha’s ex fiancé’s mother was scared that she would convert him to Islam. So the mom was scared a toddler was going to convert her son to an ideology and way of life? Makes no sense. Hisham (the one the hadith chain goes to) also had dementia and was known to be forgetful regarding hadith after a certain age. You won’t find a specific age of consent A far as what Islam says about it. This isn’t mentioned in the Quran and established Sunnah. This is pretty common when it comes to religion in general. Things like that usually depends on cultural influences and views of the time.

"this hadith" is not just found in Bukhari. The transmission of Aisha's age is mutawatir, and it is not just from Hisham and it is not just from Iraq, there are narrators from Madina: Shaykh Gibril Haddad (muhaddith) summarizes: Al-Zuhri also reports it from `Urwa, from `A’isha; so does `Abd Allah ibn Dhakwan - both major Madanis. G. F. Haddad: Rather, Ibn Hisham lists `A'isha among "those that accepted Islam because of Abu Bakr." This does not mean that she embraced Islam during the first year of Islam. Nor does it mean that she necessarily embraced Islam before `Umar (year 6) although she was born the previous year (year 7 before the Hijra) although it is understood she will automatically follow her father's choice even before the age of reason.

G. F. Haddad: The hadith Masters, Sira historians, and Qur’anic commentators agree that the splitting of the moon took place about five years before the Holy Prophet’s (upon him blessings and peace) Hijra to Madina. Thus it is confirmed that our Mother `Aisha was born between seven and eight years before the Hijra and the words that she was a jariya or little girl five years before the Hijra match the fact that her age at the time Surat al-Qamar was revealed was around two or three A.H.

THE AGE DIFFERENCE BETWEEN ASMAA ( رضي لله عنھا ) AND AISHAH ( رضي لله (عنھا The age difference between Asmaa ( رضي لله عنھا ) and Aishah ( رضي لله عنھا ) was narrated by historians, only from the words of Ibn Abee Az-Zinaad who did not live at the time of Asmaa ( رضي لله عنھا ) since he is from the Atbaa’ at-Tabi’een55. He was credited by some and discredited by many. Furthermore, most of scholars whom he narrated from did not see Asmaa ( رضي لله عنھا ) either. Thus, the narration cannot be accepted as its chain is munqati' (discontinuous). . By: Ayman Bin Khalid G. F. Haddad: Well, Ibn Kathir based himself on Ibn Abi al-Zinad's assertion that she was ten years older than `A'isha, however, al-Dhahabi in Siyar A`lam al-Nubala' said there was a greater difference than 10 years between the two, up to 19, and he is more reliable here.

Ayman reports several scholars statements about Hisham and summarizes: After reading the opinions of various scholars about Hisham, we can summarize the following: 1) The scholars of hadeeth endorsed Hisham Ibn U’rwah while recognizing his tadlees37 in some of the hadeeths he narrated in Iraq. However, this did not lead the scholars to reject all the hadeeths that he narrated in Iraq. 2) The criticism of some of the scholars was only limited to some of the hadeeths that he narrated in Iraq. This was due to the fact that he used different phrases to state how he heard the hadeeth (the chain, not the text). Thus, the scholars only excluded these hadeeths from consideration and accepted the rest without hesitation, as it was obvious that they had no defects As a result, we can see that the early scholars used to conduct an in-depth analysis of every hadeeth. Their analysis did not lead them to reject the hadeeths pertaining to the age of Aishah ( رضي الله عنها ) as they were all authentic. Moreover, none of the scholars rejected all of the hadeeths of Hisham ibn U’rwah. G. F. Haddad notes: As for Malik, he reports over one hundred hadiths from Hisham (as is evident in the two Sahihs and Sunan!) to the point that al-Dhahabi questions the authenticity of his alleged criticism of Hisham.
