She's lucky She's not renting from a leasing company, fining the sht out of you for every little thing. Making you pay 500$ opportunity fee on top first and last month's rent plus deposit, just for making one late payment with your previous landlord. I've heard some horror stories, she is lucky.

Too many people have that 'poor man's' mentality that people who own property are rich and that they don't need to pay rent, pay it late or just walk away from a lease. Those properties are generally being financed, and when you don't pay your rent, he can't pay the bank. If it wasn't for landlords, you'd be living in a shanty or a tent in a city park.

I aloud my tenants to make 2 rent payments.....on the 1st, and on the 15th. They STILL complained that they wouldn't have their money on those particular days. I told them to go find a place that would work with them the way I was trying to do!! We did charge a $50 late fee per pmt, so it did start to add up. Judge Milan was spot on telling her that just because she told him she was going to be late, and he said ok, doesn't mean he would forgive the late fee. I have been a property manager, and a renter. When Harvey asks who's worse, landlords or tenants.....I can give examples for BOTH sides. I will say a lot of my tenants were under the impression that THEIR problems should be accommodated me.

The first apartment I had, 30 years ago, they didn't prorate the first and last month. If you moved in on the 13th, your rent was due every month on the 13th. These days everyone charges you for 18 days for the first month and 12 for the last because computers can't handle computing other than the first to the last of the month.

It has nothing to do with computers. If you're a landlord with multiple units, it can become a nightmare to collect rent from different people on different days. It's much simpler for rent to all be due on the same day.

@Atheistari , oh no no. When I renewed my last lease I forgot to also extend my automatic rent payments. I came home on the 5th of the first new month to an EVICTION notice. When I went to the office, they said we're not evicting you. We just do that to light a fire under people. It messes up the computer system if people don't pay their rent on time. It's alllll computers now. How is it difficult to take someone's payment if they ARE paying with a check on, say, the 20th, and puuuuut the info in the compuuuuuter??

"I paid late in January because I explained to him it was Christmas time" -- okay?? This is why you start buying things in August-November. You buy a couple things per paycheck and save the rest for bills. There is ZERO excuse to pay late just because YOU overspent for Christmas. Let's say he has a mortgage and it is due on the 1st, do you think he can call his bank and be like, "Oh, I'm SO sorry but I spent all my money for Christmas so I'm gonna be a week late" and have them say, "Oh, that's OK, pay us any ANYTIME, sweetheart" of course not, they're going to be like, "Well, sucks to suck. You owe us or else it's going to end up being a late fee applied PLUS a late payment attached to your credit." ALSO with the whole storage thing. I would have given her a 5 day warning saying, "This is a follow up to the verbal warning given to V on W (date). This is your FINAL NOTICE: You have to remove X stuff from the basement of Y address as of Z date. If the property is not moved by Z date than it will be disposed of WITHOUT notice." It doesn't matter if you don't have enough space, that's a YOU problem, not a landlord problem. The ENTITLEMENT this woman has when the landlord tells her, "You can't store stuff down here" and to respond with, "OH! But there is a little area, if stuff is just moved, it can fit there." Like, lady, NO. It is NOT your property to disperse to put YOUR excess toys. $25 is INCREDIBLY reasonable considering most storage units START at $50 (at least, where I'm from). But also, if it was "trash" as she puts it, why was she so anal about storing it there when there are probably dumpsters around the facility?? Also, her perspective of, "You're losing money by not renting out the basement for storage" or, how about he's saving potential looters, crime. If he gives a key to anyone that's "paying for storage" and there is no security (ie: rooms that have the ability to lock) than he's actually setting himself up for my liability, ESPECIALLY if the boilers and electrical box are down there. But also, how about instead of focusing on what HE is missing out on financially, YOU focus on paying your rent on time. You're focusing so much on other things that you're about to get evicted and are easily setting yourself up for it, especially coming on national TV and admitting to paying late over and over again. Also, as a landlord, he has EVERY right to charge you for a parking space, ESPECIALLY if you have more than one vehicle. Do I agree that he should charge for the first vehicle? No, but where else are you going to find MONTHLY parking for $75 in NY? Especially if it's gated or somehow secured. The $75 charge is so that you DON'T end up having five cars parked, taking up necessary spots for other tenants. I think you have it pretty swell lady. Also, $150 late fee is NOT bad considering her rent is what, $1675? That's less than 10%. My late fee for my last place was 10% of the whole rent which eventually became $1750. UGH, I can't STAND tenants like her!! She's PART of the problem, she's PART of the reason why landlords are sticklers to the rules and don't bend them for anyone (which is their right). It's people like HER that are given an inch and take miles.

When I was young in my first apartment. BEFORE I signed the lease I told the landlord I get paid on the 7th of each month. Can I pay on the 7th when I get paid or should I find a different apartment. And he said that was fine, he pays his house payment on the 15th of the month. I never had an issue with late fees. I was always a half if not more a month ahead at a time. He loved having me as a tenant. I was never any issue and my rent was always paid and he never had to worry about me being an issue.

its obvious that she take s advantage of her landlord with regard to paying so late (I think hes actually pretty kind in allowing a 5 day grace period; I've never heard of any sort of bill where you can regularly pay 5 days late and not have a penalty!!) I can understand why he puts up with her though - it sounds like she still pays the rent every month. He also didn't have any complaints about her in court about noise or damage etc. Finding tenants who pay regularly and don't wreck the place is something that some landlords will try to hold on to!!

Before signing the lease, she should’ve negotiated her rent to be on the 3rd day of the month. It’s how I have mine setup because sometimes my check doesn’t get deposited on the 1st of the month and I’ve been in my unit for 4 years with no problems.

I've lived in our house for 6 years and only been late one time cause my wife ended up in the hospital in an induced coma and I didn't have access to her paycheck and we had till the 5th to pay and when I told him what happened he said it'll still be past the 5th. We paid the late fee.

My rent is due the first,so when i applied i asked the owner if i could pay on 3rd cuz that's when i get my SS.she said no problem plus a 5 day grace period in case my check is late to be deposited but its $25 fee after that 5 day grace the another $25 if i pay after 15th of month.its a small complex i live in,(28 residents) and all are seniors.if a tenant is hospitalized she gives that tenant the whole month to make arrangements to get the rent money to her via friends or family,etc.very kind of her to do that

I don’t understand being late or using grace periods. Ive never used a grace period. Im payed bi weekly, I pay my mortgage with the second check no matter when it lands. Twice a year there is a third check in a month, I still pay the mortgage out of the second check, it just happens to get payed fairly early that month.

Those people being interviewed... Have they ever rented or paid a mortgage? Rentals/mortgage payments usually you're late so many days past your payment late fees are added. It's a contract.. they may not care what your reasons are. Private landlords may be a bit more flexible but even they have their limits. Their take on it is interesting.

$150 for being late 2 days past the agreed upon date is way too much. We we rented a house our landlord gave us until the 5th to pay the rent and anything beyond that was $30 for the first day and then $10 for additional days. So if I paid on the 7th then I would owe $40 in late fees unlike the $150 that this guy charges. I wouldn't sign a lease with him.

It takes less than 20 seconds to transfer money, how does her working on the 5th make ANY DIFFERENCE? She took advantage of the grace period and made the 5th her due date. He asked for 25 dollars a month for storage and she couldn't pay that either. Plus, she calls HIS possessions "junk"? It's HIS property, he could keep whatever he wanted there. She's a nightmare.

$150 late fee is insane. Idk why she signed that lease. My lease is $25 on the 5th & only $5 per day after

She has tons of excuses, and this defendant does this to every landlord. And says she was married with no ring on the finger and then stored trash in the basement. Yuck.
