Dems absolutely need to be doing more. I’ve been very disappointed in Biden’s weak condemnations with no action or plan. So far the only thing he’s mentioned is the probability of appointing two new justices next term, but it sure seems contingent upon conservative justices retiring. What if they don’t retire? Why would they, if they know their life’s work will be undone? SCOTUS gives me existential dread and so far all I’ve heard from the administration is essentially “vote harder.” We need a plan to expand the court. Senate Dems have not even yet held hearings, even though the Thomas corruption story broke last year. It’s just been very disappointing to see so few willing to go beyond strongly-worded letters.

It’s incredibly frustrating to watch people sitting around, twiddle their thumbs and not even attempting to take action because they’ve already decided they have no power. It’s like watching people show a bunch of fake outrage as a way to get more face time on cable TV, but when it comes to actually sticking their necks out and taking a risk, they shirk into the corner and say, “somebody ought to really do something about this!”

Unfortunately, a president can't remove justices from the Court. The only way to do that is through impeachment and removal, which requires a majority of the House and 2/3 of the Senate. The numbers just aren't there.

It's a nice sentiment, but I strongly believe that it has never been anything but politics. The courts invent post-hoc legal rationalizations for whatever outcome they prefer. I don't think law is a principled intellectual discipline.

Missus here: Take the decided cases as being reverse engineered. IMO, the Court knows what conclusions they want to come to, then spend their decision time rooting around to try to come with some reasons, in law or in the Constitution or in their imaginations and with varying degrees of success, to justify their decisions. I think one of the problems we face is that for many of us there is little difference between being critical of the law and being cynical about it. When Melissa Murray says things like, "Why are you even surprised by this?" that rhetorical question is not limited to the specific decisions made by SCOTUS, but can seem to extend to the entire idea that institutions matter at all. Of course they do - or they should - but the way commentators critique them does not seem to reinforce that core idea. Without a sober restatement that institutions matter, these critiques fail to rise above mere complaints and can even seem to some like the rantings of cranks.

There is no mechanism for that, unfortunately. The only two paths forward to overruling the court's decision are 1) pass a constitutional amendment, which would have to pass congress by two-thirds of both houses and then ratified by thirty-eight state legislatures, or 2) wait for the Supreme Court, with a few different justices presumably, to reverse the decision in a future case.

I should add that congress and the president could fast track path 2 by impeaching and removing some justices, for example by charging them with violating their oath to the constitution or failure to recuse under situations of egregious conflict of interest. Yet another reason why this election is crucial!

Scotus itself is being unconstitutional, let alone the government or executive... Previously the doctrine was "set in stone" yet now any nonsensical "law" is being considered entirely valid and even preferable... to quote Paine: "... that so far as we approve of monarchy, that in America the law is king. For as in absolute governments the King is law, so in free countries the law ought to be King; and there ought to be no other..."

In the Ledbetter opinion the Supreme Court said the deadline for filing a sex discrimination suit could run out before the victims are aware of the pay gap. In the post case the statute of limitations can be reset for companies every time they create a new company (in Amarillo for example).

Nothing is going to beat the immunity decision this term, but the EMTALA and bump stock decisions really make me mad. The EMTALA one for all the reasons Kate is mad about. The bump stock one, though, is a perfect encapsulation of textualism: on its face it's probably the "right" decision. The statute bans machine guns, and a semi-automatic weapon with a bump stock installed isn't _exactly_ a machine gun, it just has similar effects. So in the narrowest, most technical sense this is a defensible decision. But that's the problem: it's only "right" if you completely disregard the intent of the law and all the real-world consequences. The legislators who wrote the law banning machine guns _clearly did so because they wanted to stop people from firing a huge number of bullets very fast._ That is literally the entire point of such a law. They tried to write it in such a way that such guns were not available for civilian use. The fact that someone found a way around the law, a loophole if you will, doesn't mean the Supreme Court has to allow it, but of course they chose to because deadly weapons should clearly be regulated as loosely as possible. The other thing about the bump stock ruling is that there is absolutely no legitimate civilian use case for firing 800 rounds per minute. _The only civilian use for bump stocks is mass murder._ If someone knows of another civilian use, please let me know, because I see no other reason to have one. So SCOTUS decides to side with _literal mass murderers_ because...reasons? _(We all know the reasons: the conservative movement is 100% in lock step with gun manufacturers and the NRA and will brook no talk of "real-world consequences" and other such nonsense. Who cares about actual human lives when there is profit to be made, loopholes to exploit, and grieving families to piss off?)_ The immunity ruling is the Supreme Court spitting on George Washington's grave. Of all the things Washington did, two of the greatest were insisting on being addressed as "Mr. President", and leaving office voluntarily, peacefully transferring power to the next president _whoever that may be._ Both of these actions say that the president is not better than other citizens and that the system is more important than any one person and we're a country of laws rather than men. And SCOTUS decided that was stupid and fuck that guy.

This will appear to be an obscure analogy, but hear me out. There is a famous election in Canada in 1926 which centered on a constitutional crisis called the King-Byng Affair. Essentially, the Liberal leader, W.L. Mackenzie-King challenged the unelected Governor General, Lord Byng, for refusing to call an election, but transferred power to the Conservatives led by Arthur Meighen. The Conservatives subsequently lost a Confidence vote, and an election was called. Mackenzie-King won the election, centering his attack on Lord Byng's political interference, and it set a precedent for limiting the powers of Governor Generals throughout the British Commonwealth. I have been thinking of this in the context of an unelected body interfering with elections and influencing which party wins, and what effect this could have on the subsequent election. I think the King-Byng Affair illustrates that when voters are asked who they want having the power, unelected or elected officials, they will chose the elected officials. Therefore, if framed the right way, fighting the US Supreme Court can be a winning issue for Democrats in 2024.

50:15 "...now that you have a textualist majority." No we don't. There aren't actual textualists on the Court because nobody is _really_ a textualist in the first place. Every piece of text has to be considered in context _because it was written in a certain context._ Words have the meanings we give them and different times and places and circumstances understand them differently. Aside from that, the "textualists" on the Court simply ignore the entire concept when it suits them. Neil Gorsuch gets facts wrong when it's convenient for dismantling the administrative state. Alito simply ignores inconvenient facts and/or text. _The entire conservative majority_ seems to think the founders made a little oopsie when they didn't put presidential immunity in the Constitution, that what they _really_ meant was that the president should never face criminal consequences for any actions _despite the reams of text saying the opposite._ There is no reasonable way any of the 6 of them can be considered "textualists" regardless of what they say or want to believe about themselves. They were always liars, the lies are just more obvious now.
