Thank you for posting this. I am VA rated at 90 percent. I work in a production based job for federal government and am last in my office in production. I just cannot keep up like i used to. I understand reducing production is not a reasonable accommodation. I will contact your office in the coming months. I have seven months of sick leave built up and will likely take an FMLA leave.

This is basically just to verify your information, but don't worry, there is no offset between VA Disability and Federal Disability Retirement. You will be able to receive both of these benefits fully!

Ok, am I hearing this correctly? If I'm 100% disabled through the VA (Not TDIU), I have zero restrictions on my yearly earning potential? Basically I won't be limited to the 80% of their high three? Is that correct? I can't find this info. Thanks

Being 100% VA disabled does not restrict your earning potential, but if you are also approved for Federal Disability Retirement, that will restrict your earning potential. If you are approved for Federal Disability Retirement and make over 80% of your previous position's current salary, then your annuity payments will stop. This video is just saying that a 100% VA rating does not add any additional restrictions!

Question. If a veteran resigned from a federal agency, with a combined total of around 18 "vested" yrs via military and civil service, after resignation was then service connected %100 Disabled TDIU, could they apply for federal disability, even if in their 40's? Does their total time of combined creditable federal service entitle them to anything at all? Thanks

If you bought back your military years prior to resignation those years could increase your retirement annuity. Resignations are not often supportive of Federal Disability Retirement and you must apply for this benefit within one year of separation from your federal agency. You cannot receive the special retirement supplement (SRS) if you are approved for Federal Disability Retirement. In order to receive the SRS, you must retire on an immediate, unreduced annuity.

Once I start the application process for federal disability, do I need to stop working or do I stop working only after FDR gets approved by OPM?

You do not need to stop working while applying for Federal Disability Retirement but being on a modified schedule or in a leave status may help support your case. You will work with your agency and the OPM to determine your last date of pay status. If you do stop working before you are approved, you will receive backpay from your last date of pay.

I have 8 years military and 20 additional years federal service. I recently decreased my hours to part time last year due to not being able to physically work long hours. Will my top 3 consist of my top 3 annual salary even thought I’m not working enough hours to earn the full salary?

Your high 3 will be the average of your three highest years of federal pay, regardless of your current part time position. It does not have to be your most recent three years of pay, just the overall highest 3 years.

@@DisabilityRetirement Ok, so for example, if my annual salary is $100,000 but I only earned $50,000 because I was only paid half of it, would they count the $100,000 even if I haven’t been earning my full salary. Or will they only look at the highest three salaries I actually earned?

Im a 100% P&T and have been working for the VA for 29yr and i have 5yr active duty time . I want to file for disability retirement but my hold up is my military buy back ... impossible to get them to on the phone or call back . I have my drs ok to file ..its just the buy back part ...can your firm help complete this process

Active duty is not necessarily federal employee status. You would have to be a federal career employee paying into FERS to qualify for Federal Disability Retirement.

I worked under Ford, Cartor, Regan, Bush, and Clinton. They keep forcing me back in a recall. And dose your firm file for seal METALS of vapor. So clients can recive the $1.500 a month .
