i thought movers usually have in the contract that they are only responsible for so much per lb or 500 dollar limit if something breaks . usually the judge would tell young movers like this that they need to protect themselves in the future by having customers sign a dollar limit on broken items before they move anything .

It had dings, scratches, nicks, etc & it was the BEST table & family members tried to buy it & he said no. He made it for our parents! Point is, if it’s important, WHY GIVE IT AWAY? It’s so that they can replace it (with a new one) They’re not going to be able to pay the old price, du to inflation rate. Like Harvey said in the end. They are going to order an identical one from Italy. So they will get the same heirloom because it’s made by their family in Italy over again. I think that’s pretty fair. Also the way these customers were spoken to is not ok. This case was judged correctly in my eyes.

The defendants are still very young minded and it's quite apparent by the way they speak and how they addressed this situation. Not to mention all the giggling in the courtroom. I can not stand people who love throwing the "I know many lawyers/attorneys" to intimidate others for their own wrongdoings... On top of everything, suing for defamation when they don't even know the definition🤦♀️They made themselves look so foolish.

Just curious why she took their replacement cost at face value. How many times has Judge Milian say “you don’t get purchase/replacement cost, your damage is the value of the item at the time”. Maybe I missed something but the movers totally screwed themselves by not having a contract that explicitly refers to liability for damaged items.

I wondered about that too. The only thing I can think of is that maybe since this wasn't an ordinary table but also an artistic piece it's really hard to place a depreciated value on it. You can't go online and see what identical ones are selling for used. In fact it may actually be worth more than when they purchased it. As far as the comment about deducting the amount already spent on repairs, I kind of thought that too but then since the plantif has to give them the table, the money spent to repair it is of no value to the plantif. Hopefully the defendants can sell the table to at least recover some of their loss. The defendants remind me of something I sometimes say about myself. I wish I knew now half of what I thought I knew when I was younger.

I don't think they should of had to pay that much because any other time Judge M would say with time it decreases the value!! Also just because it's a family heirloom doesn't mean anything. At least that's what Judge M has said in other cases about cars, TVs, and any other thing.

If the plaintiffs can part with the table that easily, then it doesn’t have much sentimental value. It seems their value is in the “idea” of passing down something through generations, not maintaining and passing down an original heirloom. This is likely to happen again as the table moves around.

Well personally I would’ve taken the two pieces of the table and had shelves or something made. Repurpose it so the heirloom stays in the family and she mentioned she had two children that would probably fight over it eventually so why not just find a way to repurpose it so each kid would have their own special piece of it? I mean I get their perspective for sure, however the new table won’t have the same memories or meaning as the original. To each their own.

Confused by this verdict. Owners chose to have it repaired instead of replaced. Like a visible crack would somehow vanish once glued back together. The repair looked totally fine and they know it. They just want the money and have zero intentions of buying a new table. I feel bad for the young men.

i can go to a thrift store any day of the week and find a table like that for 40 bucks . i doubt these people spent thousands of dollars for that table and they showed no proof of its value . bad verdict .

How come plaintiffs did not get price of used item? Why they get new? All other courts i heard judge say that people entitled only to used item amount.

These two young men have a lot to learn about life and about customer service. The one in the grey shirt is sweating buckets and his tie is a kids tie ha ha ha and his business partner has an attitude problem, which is going to cost them customers in the future...
