I tend to agree. My friend is a court clerk for in person proceedings and she said she deals more with unruly jurors while the defendants tend to stand mute and behave...unless there's mental illness or something. Even then, the sheriff's or bailiffs don't stand for any shenanigans. I also live in Baltimore and they will lock you up for acting crazy.

In some jurisdictions, since it is stated outright that they can challenge the presiding judge, they simply jump on that. However, it is not necessarily a wise tactic.

@@shotforshot5983 That is exactly what happened here. The problem is that part of it was "if you believe the judge is biased". The judge wasn't even done with the basic procedural stuff. He didn't yet even have the opportunity to do anything that could raise bias claims. I guess it's an optimistic side of me that expects adults to have a baseline level of intelligence that would prevent this stuff.

By reality of them being repeat offenders, the cases didn't go their way, so they try door number 3,4,5,6. Even if they've never been before a given judge, their reputation may precede them. Bailiffs, recorders, clerks all know who is a problem or danger in court.

The world needs less of 2 things, violent career criminals and those who advocate for them. When it comes to repeat violent felons, and I mean serious things, like stabbing someone, shooting them, beating them with a bat, etc., that violent felon should be put down on their 3rd serious conviction. 2 years for appeal, then zap-zap-zap. Innocence project? That really has NOTHING to do with innocence, it's only about breaking the system, they couldn't care less about if the people they get out are innocent or guilty and almost all of them are guilty. What they do is look for an issue in the criminal's trial, take that to a liberal judge, in a jurisdiction with a liberal DA. The judge grants a new trial and the DA declines to retry the case, so the defendant is released. Even in jurisdictions where the DA would like to retry, it's nearly impossible to do so. Witnesses are scattered or deceased, investigators and the original prosecutor are retired or deceased, evidence has been moved around, possibly lost, or destroyed and the cost to retry such a case would be astronomical. That doesn't mean that the convicted criminal is innocent, it just means that retrying them is nearly impossible, would be prohibitively expensive and the odds of convicting when the original witnesses, investigators and prosecutor are long gone / deceased. The Innocence Project gets a convicted murderer out of prison, not because they were exonerated, but because a retrial would be impossible to conduct 20 years later or because the current DA is a Soros type and wants to get criminals out of prison. If you're on the side of violent criminals, you're on the wrong side of history. The era of virtue signaling and treating violent criminals like victims is drawing to a close.

The judge needs to be careful because they can't just delay sentencing or whatever because you said fuck because even though they pretend otherwise, we DO have freedom of speech and that constitutionally guaranteed right does not become suspended when you are in court, you can use whatever language you like that's the first amendment right of freedom of speech which the supreme court has ruled does protect things people may deem offensive or obscene such as saying "swear" words like fuck and shit, giving the middle finger to people, and even saying racial slurs. The government is criminal they're enforcing laws that directly violate the constitution, it will only end when we the people stop tolerating it and hold our government officials accountable. So long as people can come home after work and watch football, it's never going to change because people are too comfortable with how their life is.

There's already lots of comingling that happens behind the scenes between defense and state attorneys. More often than not though it's the state prosecutors who want to get more lucrative jobs working as defense attorneys. It's a pretty routine career arc at this point for most lawyers; start off as public defender, spends some time as a prosecutor then go into private practice. Yes, the same people who while in the prosecutor's office would make impassioned speeches that led to the conviction of countless criminals pulls a full 180° and starts defending criminals.

He clearly suffers from mental illness. He is the perfect example as to how no access to psychiatric help forces the police and then the courts to deal with them. They never do anything bad enough to be held for long, yet stay on the docket almost constantly. I can't imagine how frustrating it is for the authorities to deal with people like this. Ahhh .. Mr Tooson did SO good throughout, he had almost reached the end, but he just couldn't help himself, he just proved exactly what the Judge was concerned about. OSG, I agree with you on many of the things you pointed out - Mr Overwater did an excellent job for his client, he mastered it superbly and eloquently. You know, when I first heard the defendants attorney speaking on his behalf, I have to say that I was really pulling for Mr Tooson's chance to get a lower bond .. he secured an apartment, had family support, and had a young son he wished to be reunited with. But then - Ms Kirby also did an excellent job at laying out the facts, and this is a very concerning case indeed. If Mr Tooson does indeed have a mental health illness, then that needs to be addressed and treated. Those were some deeply concerning alleged threats he made to the officers and to others around him. I think the Judge made a great decision .. and I have seen Judge Burke before and agree with your thoughts on him .. he has a dry sense of humor and can be quite funny, and he is a fair Judge.

Great work, old man. The first video shows what judges have to deal with when handling defendants that just have nothing to lose. If there's no money and a lengthy prison sentence already looming, what good is contempt? For the second case, officers often feel shafted by the court system releasing people with minimal assurances of them obeying the law. This judge was great, realizing that even officers need cover from the courts to keep dangerous criminals behind bars. I have sympathy for people undergoing a mental health crisis, but that does not mean you should release them upon an unsuspecting populace. I believe that means the exact opposite. But for this all to work, mental health assistance must be available within the jails and prisons. But, no one can be helped until they understand that they must admit their own issues and help themselves.

A lot of it came with the wave of suing anyone & everyone in the 70’s/80’s, advances in technology in law enforcement enabling more people to get caught & was contributed to by advances in medicine, science explaining more of the world & helicopter parenting in the late 90’s/2000’s to now. And of course the spread of social media means that the sheer volume of bad & scary news has amped up dramatically. And the internet means that they’re used to having everything instantly, or as near to instantly as possible. As a society people learned that there is always someone to blame, always a tablet to take or medical procedure to cure things & if there isn’t yet, it’s just a matter of time. We learned that the world is less safe than we thought, with paedophiles, rapists & murderers everywhere, so we started hovering over our kids, preventing them from getting injured (& learning how to deal with injuries) and preventing them from learning how to deal with the normal trials of life & not teaching them to take responsibility for themselves so they don’t learn any coping skills. We’ve acknowledged that there’s far more mental illness in the world than was acknowledged previously, and we’ve acknowledged the atrocities that have been done to entire groups of people through racism, bigotry & misogyny So with all of that & more, most people have learnt to blame someone else & not to take responsibility for their own actions 🤷♀️ Just like we’ve done a 180 from embracing the new in the 60’s-2000, to embracing vintage & antique while incorporating that into the new, we need to take the good things we’ve learned & combine them with teaching kids & adults personal responsibility, coping skills & resilience. The current younger generations with their massive levels of anxiety disorders, and reliance on technology would be sunk if we had an apocalyptic event now. Especially one that wiped out most adults. I’m a Paramedic & I despair of a lot of people these days. They call an ambulance because they’re drunk & vomiting, have a hangover, have had V&D for a few hours, have a toothache & it hurts (even though they’ve had it for days), run out of their medication & want the ambulance to just drop some off to them, want a lift home (I kid you not!!!). I had one kid in his early 20’s who rang because he was locked out of his house 🙄 He couldn’t wake his Mum up - not because of any medical condition, but just because she was deeply asleep. So he rang the police & ambulance asking for emergency help 🤦♀️ It wasn’t freezing cold, he’d been out drinking for the night & it was 3.30am, so not even that long to daylight. I was absolutely astounded that he literally couldn’t cope with sitting outside for a few hours or walking back to his mate’s place. Well, he learned that he could survive minor discomfort that night because he definitely didn’t get an ambulance or police to help 🙄

1st clip..The judge kept trying to be nice and respectful unlike him...imagine being an officer dealing with him, maybe after a stressful call. The patience they have to have not to snap is amazing! 2nd clip..dude blames everyone but himself in previous vids, he should not be in public but at least his PD stopped another outburst. The second clip is why you need an attorney. He made quite good arguments, and while I don't think he can be released, his attorney knew things were bad and tried to make the best of it. Also at the end he successfully got him to be quiet because it obviously would not help him. With the first clip that guy should have had an extra 30 days for contempt.

Dude was advised if he throws out one more F bomb he's out of the court hearing until the next day. He throws it out and the judge lets it go, and he gets real quiet, thinking the judge missed it. He knew he crossed the line. lol 🙂🙂🙂🙂😁😁😁😁

They didn't have the right to arrest me because I was just breaking the law and this judge doesn't like me so I'd like to spin the wheel for a new judge who will let me get away with it. The first guy basically prosecuted himself while the judge and attorneys tried to pick the next court date. 😂

More craziness - thanks OSG Loony Bond guy. Sounds like the "thumb" was a ploy or he's on his meds and more lucid. Judge Burke handed the situation well and PD Overwater did an excellent job controlling Tooson when he tried to spouut off.

Here in Massachusetts if you are on SSI and you go to jail for at least 30 days....they stop your monies and there is no retroactive when/if u get out

Another pillar of the community. Did I miss the part where bond was supposed to be set based on one's ability to pay it? I kinda thought it was supposed to be predicated on the severity of the charges, the threat the goblin poses, and that it be enough of a burden to insure attendance at court.

Here's something I bet you can't do- Explain to me what a narcissist is in your understanding with plainly worded English and without the aid of Google. I bet you can't. This word is used WAY too frequently when and where it doesn't apply because people don't understand what it even really means, how to use it and who and what to use it on. ABsolutely need contempt charge, with a minimum of 10 days no bail, then escalate for eavery charge. Many judges let this behavior continue, which I do not understand and is difficult to watch.

It seems as though second defendant may have a long history of such episodes. He is receiving SSI. But if the person willingly fails to stay on their behavioral meds... it is a predictable cycle. During incarceration, they behave and calm. They are released with condition of staying on meds. Eventually, they stop taking them and wind up going back to jail, maybe hurting someone. Why do we subsidize their existence and have to suffer abhorrent behavior and acts?

When I worked in law enforcement I worked w a guy for a few years. He left that department and went to work for another about 40 miles away for more money. It was a smaller dept and there were only 2 officers on duty at a time. He arrested a guy who made similar threats to him about his family and like always he just shrugged it off as him just mouthing off as we all did. He got a call one night while he was on duty and he was told his wife was hospitalized & he needed to come immediately. She was home alone & their kids were at a sleepover. The guy broke in and sexually assaulted his wife, sodomized her, beat her up pretty good, stole a ton of their belongings and wrecked their house. She was barely recognizable he beat her so bad. He tore her bad while SAing her. Even used different objects after he was done w his penis. Including a glass bottle that he put inside her and punched her stomach so hard the glass shattered inside her. It was absolutely brutal. I guess the lucky part of it (if there was one) was his daughter’s weren’t at home that night. Any other night it would have just been his wife & daughters home alone. No telling how many people have threatened me like that as well as other officers and that was the first time I’d ever saw someone actually follow up on their threats. We may have signed up for the job but our family did not. He quit law enforcement that night. It took her years & multiple surgeries to be able to function properly. She was terrified to stay home and terrified to leave. I talked to him many years later and He never forgave himself. Their marriage was very rocky for a while but then after a while in therapy they were able to stay together. She was such a sweet woman and definitely did not deserve that at all. These people are cowards in my opinion. Take it out on the person that locked you up not their innocent family

He pushed the glass into her vagina & beat her in her stomach area and busted the glass as it was inside her vagina. Do I need to go into complete detail as to where & how each of her injuries occurred ? Damn I thought most adults would understand w o going into details.
