If The Congress and the Senate are the representatives of the people, why don’t they listen to them? I’m from the UK and I watch with puzzlement here. Another question. Is there a reason why the Supreme Court is not independent of the Government? The senators could have short terms in the Senate, but as we see, their decisions influence the judicial system for a long time. Shouldn’t the judges be choosing their Supreme Court judges?

Janette Chapple - Good questions. "Why doesn't Congress listen to the people?": First off, the Congress constists of both the House of Representatives and the Senate. So when you say "the Congress" you're actually referring to both. And only the House of Representatives represents the people. The Senate represents the states. Each state has two Senators regardless of population. Originally the State Legislatures appointed their respective Senators. But that changed because of the 17th amendment. Now we elect them directly. But their primary duty is to represent their State's interests. Not necessarily the people's interests. That's the job of The House. They have 6 year terms with no term limits whereas The House has 2 year terms and they have a much higher turnover rate because if they don't listen to their constituents they get voted out quickly. Second, "shouldn't judges be choosing their own supreme court? ": We have what's called "Judicial independence". It's the basic notion that judges should be free from the political consequences of their decisions. It also ensures that judges have the ability to remain impartial. This is why they serve a life term, are not elected and cannot be fired, transferred or have their pay reduced. They are not beholden to anyone. The reason they are appointed by the President and confirmed by the Senate is because it gives the people (indirectly) a say in the matter. Because the people elect Presidents and Senators. If judges appointed their own Supreme Court, the people would have less power.

Founding Fathers did not embrace Democracy. It is a Republic . Initially they only allowed WASP men to vote, they allowed slavery , they devised the very anti Democracy Electoral College where a Group of appointed, mostly unknown people , actually elect the President and small states have a disproportionate influence. Voters in Wyoming, for example, a state of no consequence have more power, per capita , than People in California in The Electoral College. Alex Hamilton said the people are turbulent and changing they rarely judge correctly thus justifying the Electoral College . Each state gets 2 Senators . Thus Red States with smaller aggregate populations have more power per capita than larger generally much more economically successful states. Trump and W Bush both were elected with fewer votes . The USA is not a Democracy, it is the rule by the minority, it is this fact that will divide this Nation to a point that it may ultimately destroy it . The seeds of its demise were planted in 1776.

Thanks for adding that historic perspective to the discourse. Frankly I was baffled by the stubborn behavior of the GOP members of the juidical committee right after they had recommended Kavanaugh to he senate. It reminded me strongly of the East German gouvernment in the days right before the wall came down. People were protesting in the streets and they still did not see what was coming.

Doug, you are right, and as it stands at the moment, any American can vote. However, do you think that someone should place a vote based on the shape of the donkey or elephant? Most American's have a right, and the privilege to vote. Do you think that illegal immigrates have the the right to engage or influence our country with a vote? Jaywalk 2020 Article III, Section 1 of the Constitution establishes the Supreme Court of the United States. Currently, there are NINE Justices on the Court, NOT just one. In other words, "Justice" Kavanaugh must confer w/ EIGHT other Justices before a decision is made. You might wish to read the U.S. Constitution before opining about it. The mind is a terrible thing to waste.

You were and are being tested and you can rest easy because it looks like the majority of humans will pass your last and final test. Kavanaugh’s character test fails! Even if we put aside the emotionally charged sexual misconduct allegations, any rational conclusion on judge Kavanaugh’s character must acknowledge his inability to not impart political or religious belief based bias into the supreme court was brought to light during the televised nomination review process. Kavanaugh’s contemptuous display of anger, evasiveness and partisan contempt should by itself be enough to call into question the character of this candidate. Then again his character is questioned related to honesty evident as numerous former acquaintances independently came forth in the media challenging Kavanaugh’s under oath misrepresentation of his drinking, behavior and relationships. While I do not support the Democratic party’s added views and assertions, based on publicly available information judge Kavanaugh fails all reasonable character tests...

walkinthunder Kavanaugh’s calendar where he wrote down on July 1, 1982 a gathering as described by Dr. Ford. Also the testimony that corroborated the second accuser. News sources had to take the testimonies since the FBI refused (wasn’t allowed?) to do so.

MagnumDB Actually SCOTUS doesn't enforce any law; law enforcement is the sole responsibility of the executive branch. The job assigned to SCOTUS is to determine whether the laws passed by Congress and signed by the President (as well as whether a specific exercise or expansion of the executive orders/privilege powers of the President) are Constitutional or not. In other words even if Democrats take control of Congress and the Presidency, none of the laws they pass will ever see the light of day, much less be enforceable, if a conservative leaning SCOTUS rules that they are un-Constitutional (in essence shutting down progress in the areas of pro-choice, voting rights/anti-gerrymandering, campaign finance reform, environmental protection, corporate regulation, universal healthcare, etc.).

ChadDad123 There's nothing suspect about her timing. First of all, Ford didn't want nor choose to "come out"; her letter was leaked. Second, she communicated her allegations to her District Representative prior to Kavanaugh's nomination, when he first made Trump's short list of candidates to replace Justice Kennedy. And even if the timing were questionable, the content of her allegations as well as the testimony of Kavanaugh speak for themselves, as they should, given the gravity of the charges and the importance of the job of Justice of the Supreme Court.

This is why your failure is absolute and final. You may define yourself as "progressist", but there is no "progress" in your mind. You're simply thinking about "stopping your political enemy" (not "adversary", since when that becomes the only point in your agenda you are already thinking about politics as WARFARE, as a battlefield without rules where everything goes, so you've taken it to the next level and basically became UNpolitical, despite dealing with politics). @@AFenderson I don't consider myself a lib. Some positions I have are more liberal, and others more conservative. At the end of the day, I want to see the government function as how the framers intended it to work: Have respected positions based on facts, work to compromise, legislate proactively not reactively, being respectful, etc in order to solve the issues I've been hearing about for the past 10 years. In his farewell address, George Washington warned of three things: Serving more than two terms as president, entangling alliances, and a two party system. We've learned from former two, and we need to come closer together on the political spectrum or a third party comprised of independent thinkers will soon emerge. Not being able to admit fault, hiding in our opinions of truth, only listening/reading to hyper political commentary does not help, and our politicians who are supposed to tackle the hard issues avidly avoid them and now only care about cramming legislation through when they control a major part(s) of the government. You called me a liberal, but I thought you'd want to better know where I'm coming from.

That helps, absolutely, great thoughts, we can all agree on your points and it is a good foundational perspective of an emergent third party. Right now there is a critical need to apply the rule of law in order to cut out the cancer, start the healing, and start the rebuilding process. Kavanaugh is a vote to be able to use military courts to try traitors who have literally sold the country off piece by piece, subverting norms and rules to enrich themselves over doing their job. The solution is proposed as socialism and eventually communism, but I think the framers intended something else. Point being, right now the patriots are in control. If the patriots know that the right move is putting Kavanaugh in place, I trust the plan. His record for pure constitutionalism is very good and has broke ranks with the republican line many many times. Prior to this charade, he was very well respected by democrats. He also gave the Clintons a pass back in the day. Partisan politics however... So that's why the filibuster + 60 thing is a bad idea. Extremely partisan times will just result in seizing up the system. Delay and resistance is only to delay and resist their arrests, you don't have to take that on as an everyday citizen, that's their problem.

@@AFenderson The reason you disagree with my idea of returning the procedure back to what it was before 2014 is exactly why it's needed. Senator Reid eliminating the filibuster and McConnell eliminating a 9 necessary votes has made the process more partisan than ever. Look at the vote, it was almost exclusively by party lines except for Manchin and Murkowski. If Washington is to work a little more cohesively on some level, you have to force it to something like the filibuster + 60 votes. John Roberts got 79 voted I believe. Good justices will get votes. I agree that when Kavanaugh was announced, many thought his record would be tough to vote against, but there were other good candidates to be chosen. Outside of the accusations, his behavior in his last hearing was a disgrace and unqualifying. I never had an issue with Gorsuch, but Kavanaugh's behavior/antics was not up to standards for a Supreme Court Judge. Also, regardless of your belief of the Mueller Probe, you can't deny he was chosen in part for what he wrote about sitting presidents and that they should not be indicted while in office. Many could say that memo he wrote looks quite partisan today.

It is astonishing that so many people in the US seems to focus on the short term issues. The shift that Republicans are doing in the SC will have huge long-term influences. The decision for unlimited funding is one of these decision that short-term creates paid justice and paid politics. Long term it will destablize the whole US with more riots, more social insecurity. It never works out long-term for the rich to be too greedy and to influencial in politics. It seems pretty obvious that prosperity and importance of the US will decline. It is btw bizarre how many people make their political decision making based on the Dow-Jones index. A Dow-Jones Index tells you nothing about the distribution of wealth, power, social security, unbiased justice. It seems as if blindness, ignorance and stupidity are on-vogue in the US today.

Well Andreas, there is no "wealth distribution" in a republic. "the shift that the republicans are doing", you say. What shift? What do you consider short and long term? The prior administration made deals that our laws state only congress can make, used funds that only the House can approve, so in the "long term", do you think one man should make illegal decisions and abuse his power? Obama did. Another long term move, Obama put nearly $6 million of our dollars into deals with alternative energy sources, that then went belly up. Obama engaged in war with Libya, without the approval of our congress, do you think one man should bypass the government and do that? How about Benghazi, do you think he should have ignored the calls for help and allowed our ambassador to be murdered? Perhaps you are ignorant, Lord knows there are plenty of those around the world, but if you claim to know so much, tell me why you think the democrats have done well for 8 years and yet financially we are far worse, unemployment went up, our credit rating went down, and common core education is an (obvious) failure? What you are commenting on is our justice system which requires that there be evidence, not accusation, to call a person a criminal. Do you think that the democrats were thinking long term when they decided an accusation should be sufficient to destroy your life, your family, your career? When in history has that worked for anyone? This wasn't about a man being put on a panel of justices, this was about the democrats being so desperate, they took information of an alleged criminal act from decades ago, did nothing about it (a crime in this country) then brought it out in a political move. Bad enough, but then they decided we should accept an accusation and do away with due process, a safety for anyone accused in this country. When do you want a room full of lawyers to take away your rights to be innocent until they prove guilt? Rich greedy? Humans are greedy, the difference is, are they giving anything back, or just taking? When did a poor person give back? If you took the rich people's money (which is theft) then when that is gone, who is generating new innovations, new technology, new jobs, new ideas? Who is funding them? Not one thing you enjoy right now came because a poor person dug up an idea and funded it with dirt. I think you need to research and figure out if the problem is the US or global. Perhaps you can tell me how well other countries are doing, last I looked, they were sinking long ago, everyone just wants the tax paying american to shut up and give the money. Guess what, we ended slavery. For the long term.
