When you think of gambling, you might envision Las Vegas or Reno. But there are actually more Indian casinos in the United States than in all of Nevada. How did Indian tribes come to be major players in the gambling business? It all started with two tribes hitting the jackpot in California versus Cabazon Band of Mission Indians.
The Cabazon and Morongo Bands of Mission Indians operated casinos on their reservations, offering bingo, poker, and other card games. Most participants were non Indians who entered the reservations to gamble. The tribes offered higher stakes games than allowed by California law. The state of California sought to stop the games. The Indian tribes sued, seeking a declaratory judgment that California had no authority to enforce state gambling laws on reservations. The district court granted summary judgment to the tribes, and the Ninth Circuit affirmed. The Supreme Court granted cert.
