Honestly they cannot stop you if you resign right away worse if you were a permanent staff, and let's say example you have health issues and need to leave ASAP and don't wish to share that with them you don't have to.

what if the employee resigned before hand sample: november 2021 filed and effective february 2022, but it was not acknowledged by the immediate superior then the employee continued and filed irrevocable resignation on april 2022, is this acceptable by law?

Hope you can see this. I worked as a consultant, technically my contract expired over a year ago but I was still acting as if I was a consultant/employee doing regular employee duties. This past week they brought me in as a full time employee. With the changes as a full time employee I have to clock in, so they credited me for a week of work as a new employee but didn't acknowledge me as my last week as a consultant and hasn't paid me that fee. What can I do?

Start na agad sa new job ko, but I understand na need ko magrender ng 30 days pero willing naman po ako magrender while nasa new job na ako, adjust ng time siguro. Question lang po, di nya ko kasi na tackle to especially in these era of pandemic: What if the employee resigns due to fear of unsafe working space? Like, unsanitary yung workplace and one might get COVID from it. Like, the employee is often getting sick since working but is fully vaccinated. Hello Atty, meron akong napasukang company, tapos under probation pa ako. tapos gusto ko na rin magresign next week dahil sa trato niya sa akin. pinapahiya na niya ako sa other colleagues tapos ako na lang yung nakikita tapos ganon na yung mga pinagsasabi niya sa akin. They insult me often.

What if hindi po nakuha ang first salary nung 30th which almost a month kong hinintay to pay my bills, support my family and ma-sustain ang pagpasok ko sa work? Against na nga po sa Article 103 ng labor code ang ginawa nila. 5 days na po ako di nakapasok kasi wala na ako talaga mapagkukunan ng allowance. Worse, instead mag-special payout sila, isasabay na lang daw nila sa 15th yung sahod na hindi nabigay.. Sapat na rason po ba yun para mag-immediate resignation?

Paano po attorney kung nagfile ako ng resignation at hindi ko na tinapos yung 30 day advance sabihin mating naka 20 days pa lang yung resignation ko at yung natirang 10 days ay inabsent ko na lang sa dahilan naman na yung 6month contract ko ay natapos na at wala rin silang bagong kontrata o regulazation na pinapirmahan sakin. Gusto ko man po ilaban yung immediate resignation ko due to uncomfortable working environment dahil I really feel that all employees that day are bullying me indirectly, I prefer to be silent na lang kasi baka mabaliktad pa ako ng company at ako ang matalo. I have recorded the scenario/talks that day but the record is not so clear so that I may have evidence. I decided to immediately resign bago pa matuluyan ang mental health ko. I am going home crying thinking bakit sila ganon sa akin. And now, I have the difficulty to apply in a well-known company because I don't have COE.

Thank you for this info atty's/ How about those with employment bond? Based on signed contract, voluntary resignation will require me to pay the bond (employer spent amount in training). But I am currently having mental issues (panic attacks/anxiety), can I use my medical diagnosis as a reasonable cause for terminating my probe contract early, without paying such bond? I hope you can enlighten me on this. Thanks.

Check the contract if the bond excludes mental health situations. If not, try negotiating with your employer on this point. If not, then you'll have to comply with the obligations you agreed to, including the employment bond.

atty. Paano kung nagawa mo ang emidiate resignation dahil tinatakot ka na kapag mababa ang benta mo until this day magbaback to agency ka den ikaw n ayaw mawalan ng trabaho naghanap ka agad ng kapalit na work is this posible?

Hi po Attorney, sana ma notice. Allowed po ba mag file ng resignation habang naka maternity leave kasi naka hanap na ng bagong trabaho which is dapat after 2weeks ng job offer ay mag start na sa work?

Hi If your currently on matternity leave and decide to resign are you allowed to do it? With 30 days notice before maternity leave ends?

Hi I have a concern. I hope you can help me. I'm only at my job for 2 weeks and I really wanted to resign on my job because the work does not fit me and does not make me happy which affects my mental health. However, I already signed a contract with them before I start on my first day. May I ask if there's a legal case or consequences that I face from terminating my 2 yr contract by staying only on the job for 2 weeks?

Sir ask ko lang po, 3 days after ko pumasok want ko na po mag resign, and nung 4th and 5th day ko po di na ako pumasok kasi po di ko na po talaga kaya, and now po nagpunta ako ng agency asking for resignation kasi may balak po ako lumipat ng work, ayaw po ako payagan dahil daw po sa kontrata, and sabi na sasampahan daw po ako ng kaso, pag pinilit ko daw po mag resign, sana po matulungan niyo ko, thank you po
