In Kyiv, Ukraine you can park wherever you want as long as you are not blocking someone's drive or gates. There are no parking charges. It works extremely well. The UK on the other hand has become a basket case of rules, regulations and excessive fines against law abiding people who have done nothing wrong. It seems like Western Europe and Eastern Europe have switched places in terms of freedom with just the odd one or two exceptions.

Wish we could do that here. I imagine it has something to do with Ukraine being relatively massive compared to the UK, with a smaller, less dense population and lower rates of car ownership. It's a fact of life in the UK that if you let people park for free, people would clog up car parks at hospitals, schools etc. and that would actually make life worse for people. Imagine if parking was free everywhere - you'd have millions of vehicles parked near workplaces and entertainment venues constantly because why would anyone get on a slow, dirty public transport instead? Parking regs are a necessary evil, but they are too harsh and perhaps a bit too excessive, especially in cities.

I can't see any way out this mess other than for the government to step up with efficient and comfortable public transport like other European countries. Sadly voters see public spending as socialism yet love to complain about privately run alternatives to national projects 🤷

Never hurts to be able to take a photograph of the machine(s) when they are exhibiting a fault. In the past when this happened at a nearby car park I called the parking company to inform them of the faulty machine and ask if I could park there (useful when the automated message before you speak to somebody contains the phrase "All calls are recorded for quality and training purposes.")

@@paulbeddows6014 Not always, but sometimes you can trigger a divert to human on fully automated lines by pressing the * or # buttons (provided they are not used for options), or numbers that aren't given for any options. Some systems will keep repeating the current menu's options, and some will inform you that due to an issue they are unable to continue the call, before hanging up. But, if you ideally need to speak to a person on what appears to be a fully automated service, it is worth a try.

Too many vested interests in this whole parking business, to the extent I label it a scam. Try this nonsense where I come from (S. Africa), you will find the parking machine in question very quickly doused in diesel and set alight, or filled with expanding PU foam. Last year, I was stung by Parking Eye. In the very small hours of the morning I had to take my sick mother into the hospital's ER. We eventually came out, it was still dark, birds just stating to tweet. I went to pay at the machine, and it just showed the pic from the day or so's earlier visit to the hospital, which was during the day, and for which there was no charge as it was a free period of time. I'd tried another machine - still didn't show the correct pic. (should have shown me arriving in dark and different part of the car park). I went back into the hospital to see if the reception could help - no joy. I took a photograph of the screen as evidence, which clearly showed that the photo on the screen was one taken in broad daylight, and it also showed the actual time and date at that moment I took the shot. Anyway, I was going to contact Parking Eye, but it was a pretty stressful time, and basically, well, I forgot. A few weeks later, I received a parking charge through the post. I appealed, thinking that it would be a straightforward admission that it was their machine's fault and that the charge would be dropped, but no, the appeal failed! I could have argued and taken it further, but like I said. It was a stressful time, and felt it easier to just pay. I suppose that this is what they rely on!

ParkingEye are bastards. I got one from them parking at a hotel in Hemel Hempstead. Apparently, the space I’d picked wasn’t acceptable, despite the hotel receptionist telling me it was fine. As I had a lease car, they paid the fine and docked it from my salary. Numerous attempts to contact ParkingEye were met with absolute silence. They had their money and didn’t care. I gave up in the end and complained to the wall, which was far more communicative…

Appeal is a strange word particularly in law, to councillors and their agents along with private parking companies regard "appeal" as an admission of guilt whereby they want to have the power to give or refuse mercy. I have a different approach if there is no working machine or I consider it to be entrapment. I take photographs and witness details to contest their claim(s) on receipt of their invoice I write back, never online, to require their evidence of proof of their claim, I never refuse to pay. My requirement is photographic evidence of the vehicle and operator of the vehicle. As keepers of these vehicles not owners the paperwork has to be sent to the DVLA.

Let this be a warning to anyone who gets a PCN. I got a parking charge notice even though I had a valid parking ticket displayed correctly in my vehicle! When I appealed it they upheld the PCN despite sending them a photo of my valid ticket! The reason they gave was the street name on the ticket was different from the street I was parked! I hadn't noticed this at the time, neither do I purchase a ticket from a machine on one street then go and park on another street! So out of great personal expense, effort and time, I went back to the same machine and it printed out a ticket with the incorrect street name, this was weeks later!! Luckily there was a traffic warden close by, not the same one who issued my PCN incorrectly unfortunately but I explained my situation, he still didn't believe my account, waited until someone else bought a ticket from that machine and confirmed it was printing incorrectly. After a lot of emails, appeals, phone calls, time, stress and general faffing about, I got my PCN cancelled, no apology, no explanation, just an excuse that I should make sure the details on the ticket are correct! Which I thought was a bit out of order, rather like their machines! Thinking about it after, I noticed every vehicle on that street also had a PCN, that machine was printing out incorrectly for weeks! Wouldn't you think a traffic warden with just a little common sense would realise the error and have it corrected? By the time I had been down again to buy another ticket, which was after the first appeal, so weeks later, it was still not fixed! I wonder how many tickets were issued incorrectly, how many just paid the fine without checking? How many appealed like me but were refused, so just paid the fine? In my opinion there is an element of dishonesty here, someone must have known there was an error but continued to take advantage of the situation, issuing further fines. I did try to recover my costs and it did cause me a lot of stress and anxiety but this fell on deaf ears through the appeals process, they just refused to engage any of my concerns or requests!

@@David_Trowbridge I went to considerable time, expense and effort gathering my evidence, only for it to be rejected at first, even though I had a photo of my ticket, correctly displayed in my windscreen etc etc I had to go down again weeks later to prove their machine was at fault and gather more evidence, surely the owness is on them to provide ticket machines that produce valid tickets, not me to check them? The whole incident just made me realise there is an element of dishonesty going on, as multiple traffic wardens must have been aware of that faulty machine yet continued to issue PCNs. There were 4 or 5 other cars displaying valid tickets but with PCNs on their windows. I can only assume this carried on for weeks?

@Lancashirelad Same, I very rarely park where there are parking meters, I'll park just outside town centre where it is free and walk in, 15 mins walk. But on that occasion I had to park closer, so chose that area as it was close but a cheaper zone. My personal hate are those parking areas that have no meter where you have to download an app, register, log in and make a card payment! I'm an IT tech have been using computers since 1981 and I honestly struggled with their system, it was awful, probably spent 40 mins or more just trying to log in, nevermind make a payment! I only wanted to park up for 10 mins!

It precludes those who are not tech savvy or who have no mobile phone etc Like I said I struggled with it and I'm a IT tech with over 40 years experience with computers and tech of varying kinds. It seems to me more and more meters are being replaced with this setup, presumably to reduce the costs of the council etc In reality it just makes parking up.more difficult and probably results in less people actually paying because they can't be bothered with the faffing around for parking up.

I parked with a pay and display ticket and it was only when I returned to the car did I notice that the clock was an hour out due to summer time/gmt. So buying a one hour ticket was giving 0 time! It was still an hour out two weeks later.

If the machine is faulty take a short video showing you putting money in or take a picture of any signs saying machine not working but make sure you can tell it’s that parking machine so get some of background in shot.

As i don't drive anymore this is one problem that i don't come across. But trying to get from A to B on public transport is no fun either. Buses and Trains either run very late, or don't run at all, and that is when they are not on strike!

Had this situation a while back when going to one of the restaurants the car park was for. Machine didn't work, went to the restaurant to ask for advice or other payment option, they couldn't help so we left and went to another restaurant.

Yep, happened to a friend of mine, parking meter out of order and they sent him a invoice for £60 for trying and failing to buy a ticket, a whole 6 minutes gate to gate. I used the popla appeals scheme as the spivs at parking eye just rejected his appeal out of hand. It is nice to say that popla found in our favour and even nicer that it cost parking eye to lose.

If you enter a car park with number plate recognition systems and go to the meter to pay where you are required to enter your own registration number, the machines will accept payment, you will get a ticket issued and then if you check carefully, you may find you made an error typing in your registration, that paid issued ticket is marked as void and you will also get a pcn for non payment, even though the parking charge was paid, albeit with the wrong reg. Quite annoying, because the car park operator has not lost any revenue.

If private parking companies were legally bound to pay compensation to the recipients of every speculative and defective PCN they issue many of these problems would go away. At the moment they have nothing to lose because most people pay them out of fear.

I had to visit a post office twice in one day 5 hours apart. It’s a private car park managed by a questionable firm who’ve sent us a charge of £100 saying I parked there for five hours. I did not and refuse to pay. I informed the post office and was told they are doing this to a lot of people including elderly who have to return to the chemist if their prescriptions are not ready. We are not parking there for hours just having to return later in the day for whatever reason then they say pay now for £60 or it will be £100. I feel sorry for those that have paid it. They should be stopped.

From experience the insurance for delivery work shot up from 400 fully comp to £1500 that's for 40 plus years driving experience so I would hate to think what a provisional young rider would have to pay. Apparently domino pizza cover their riders but I'd like to know at what cost.

This is a law that loads of people violate as most insurance doesn't cover commercial use and my insurance provider warns me not to drive to work as that's considered commercial use which my insurance will not cover. How many people drive to work in their car they only have insured for "personal use"? So it's a legal grey area, you "have insurance" as far as police can determine checking your car's reg on their database but does it cover how you are actually using the vehicle?

The law should be changed. The manner in which a parking fine is issued is disgraceful and amounts to a demand for money, for which you HAVE to appeal if you do not wish further action, and that IS your only choice. At no time is the notice specific of the contravention, or exactly what the penalty is for. I received one, which was controlled by ANPR, which was faulty and subsequent appeal upheld. The letter made no apology of inconvenience, and only stated that I would not be pursued…. so I complained that the letter was unacceptable. Firstly the issue of the PCN was in contravention of their code of conduct, (BPA) that they should check the validity of ANPR notices, before they are issued.I also complained to DVLA, that they supplied my information, in my opinion without due cause, as Parking Eye had not followed the code of practice, set out by BPA. DVLA replied, detailing the exact reasons for the issue of the ticket and why my appeal had been upheld, something Parking Eye failed to do. The culture of these companies, guilty until you prove your innocence and threatening behaviour needs to be addressed.

I got a PCN at my local Aldi. Shop there every week, enter my reg after every shop (you choose and verify the entry photo of your car and reg), yet I still get a PCN! Can't prove that is obviously a problem with their logging system as they have the data and hopefully terminal logs of user input. Not shopping there again, just seems like a rip off by the private company as they can say you never entered your reg and you have zero proof that you actually did! I'm going to be videoing EVERY time I enter my reg from now on to prove I did it and it accepted my entry. Robbing B'stards.

"By telephone, BY APP" I am NOT installing some unverified software on any of my devices to park in a space. I don't care if it's the car park at Buckingham Palace, that is not a *viable* alternative. That would be like asking the person to write their bank account number and sort code on a large board for everyone to see as a way to pay. The law totally fails to ensure that apps are secure, GDPR does not understand what really counts as secure and really only covers "meat space" failures like leaving papers on a desk for anyone to see. Not to mention if the negligence is committed by a company that goes bankrupt then they are judgement proof. Too many times I have stopped to charge my car and they only way to pay is totally unreasonable demands of access to my devices and personal information in exchange for some electrical current.

I work as a recovery/road side assistance. And have recovered a broken down vehicle from one of this type car park. Vehicle could not be repaired there and then,so was a straight recovery. I could not have got my vehicle into a bay if I wanted to, it is too big to fit. So I had to block some cars to load up. I did not hinder any one by doing so and was loaded relatively quickly. And considering that I am driving a sign written vehicle with strobe lights it was pretty obvious what I was doing, and I wasn't one of the tourists there for a jolly afternoon. I was removing a broken down vehicle from a parking space, making room for the next person. A couple of weeks later my employer called me to inform me that I had been given a penalty charge, which they had paid and removed the sum from my wages. Has common sense left the building with common decency?

So I paid cash and a blank ticket was issued (it did have a small time stamp). I did not have a phone on me so I displayed what I received. When a friend arrived I returned to the meter with his phone to call the parking people by which time notice had been served (20 mins). So I paid, the co failed to provide me with the correct document (timed receipt). Worth an appeal?

At a car park in Birmingham the machine would not accept cash and no other option to pay. Called the number on the machine and was given a code to leave on my windscreen and assured there would be no charge and they would fix the machine. Sure enough, when I returned 1Hr later, no penalty notice and machine fixed.Proof that you don't always need to be confrontational.

One wonders if the machines are non functional by design? Most parking areas that l have seen have large signs asking you to pay from your smart phone, I can perhaps see that meters may well disappear in flavor of on line payments. No need to empty said machine and vandalism / theft, a thing of the past!

Also... take a video of yourself attempting to pay. Narrate the time and date and the problem you have. This happened to me in a hospital parking lot and the appeal was easily succesful as I had irrefutable documentation (the video) that I had at least made a goodwill effort not to avoid the charge.

Do the signs say to display the ticket or is there a camera ? I regularly use a chain of hotels that have had non working machines for at least 8 years, no camera, I leave reg number with reception just in case, they do not ask for payment. I suspect that the contract with the ticket machine company ended at least 8 years ago and was never renewed lol

Aren't public car parks paid for in Council Tax, why do they have to charge us again? Give a fair limit on free parking. Like 2 hours, this stops people leaving cars to go to work. I only ever shop in an area that provides free parking, I never use local towns because i don't want to pay for parking on something I feel we already pay for. Plus their charges are unreasonable.

It would be classed as drunk in charge of a vehicle rather than drink driving. Yes you can be prosecuted. And not only if keys in the ignition...If the keys are in your possession / anywhere inside the vehicle at all. You would need to prove there was no likelyhood of being able to drive.

Under Section 42 of the Vehicle Excise and Registration Act 1994 It is an offence to not fix a registration mark or for it to be obscured. It is irrelevant as to where the vehicle actually is.

@@shornsparks20005 Firstly I am not condoning what you do. To do what you are doing to avoid paying for parking is probably illegal as you are very likely in breach of the parking rules in the car park. Removing the car identifier to avoid identification sounds ridiculous. I am not a lawyer, and have just read up what I can find online. The VERA act does not specifiy that the registration only has to be displayed on public land. Using common sense here, it looks to me like the concept of private land is where you can keep an unregistered vehicle. And that is correct. But where a vehicle is registered, then moving that vehicle to private land does not remove that registration. There are comments online about people being charged for having a vehicle in a car park without a number plate. There are also comments about publicly access car parks being treated as public land. These comments make sense to me. I suspect if the police saw what you have done they would charge you. You would then be explaining yourself to a judge and I doubt they would look favourably on you when you explain what you have done. As a final point, removing or altering the number plate may lead to your car being treated as abandoned. The car park operator could then remove it at your cost. It seems a lot of risk to avoid paying a few quid.

Thank you for your reply I only usually do it if I am parking somewhere and I have gone over the time or it is one of those ridiculous ones with the cameras that are just trying to catch people out and I alter one of my numbers so the computer system will not computer as you leave as it needs both to match to compute auto the comment as it could be treated as an abandoned vehicle if it takes as long as it does to get reported abandoned vehicle around here you would have about 3 months of free parking not against paying the parking charge against some of the scammers that are trying to rip people off like when visiting elderly residents and getting a parking charge notice as the system is set up purely to trap people as bad as it is it's just a nice little treat to beat the system that's all

one, having explored, unsuccessfully, all other possible options ( short of not electing not to park there - just in case) could post a note in windscreen of vehicle with date and time of parking with explanation machine not working - AT THE TIME - and hope the management are prepared to “hold their hand up” and be lenient….?

They can take it all the way to court. Ignore court papers and the inevitable default judgement, you get a CCJ on your file and it's a wrecked credit rating for the next six years. Some people get away with it because the smaller outfits sometimes won't bother chasing a single ticket but the larger firms just roboclaim you all the way to court. Bear in mind they have 6 years in which to chase you.

Had this problem only on Friday, everything fine when I parked, but later when I attempted to pay, all the machines were not working, and the advice was to use the machine at the exit, which machine took my ticket, but not my cash, I have later discovered by checking the bank to see if it had. I later contacted via their web site them informing them of the circumstances, in fact I phoned them as well, but got a very rude operator who hung up when I said if he did not give me an acceptable answer I would "lawyer" them. Thing is I am offering to pay for my parking but not any excess. I would be one of dozens affected by this fault all trying to exit the car park but not being able to pay. I wish I had photographed my ticket before the machine swallowed it, it was supposed to return it but did not, being of course faulty and not responding properly. At the time of exiting the barriers were permanently up so I expect a lot of people just drove out anyway. I also informed the Council while I was in the car park that people were stuck there apparantly unable to get out, so there would be a record of that.

I was in this situation where the machine was working when I parked but as I was paying, it stopped working and hadn’t returned my money or a ticket, fortunately the parking attendant was just on site and I explained the situation to him and he let me park there all day

Sometimes somewhere else is not available. Like in situation when you arrive on time for a meeting and you expect the parking facilities to be available but it's not the case and there is no time to go and look for some other place to park as it's going to be so remote that you won't make it to the meeting on time.

Excellent, as usual. I have a question. We all know that you can't enter a yellow-hashed box junction unless you can see that the exit is clear. But if you are in a moving stream of traffic, driving across the box, it seems daft to stop and wait for the car in front to clear the junction before entering. To do so massively disturbs the traffic flow. But if the traffic stream stops, and leaves you on the hatching, you are presumably then guilty of stopping in the box. What is the right/ legal thing to do, disturb the free flow, or risk getting caught in the junction?

Yes it disturbs the flow but you cannot enter unless there is space on the other side to exit the box

Generally speaking (forgiving a truly obstructed view) you should be able to have a pretty accurate idea if the car ahead of you will clear the box by enough to give you space; based on the traffic ahead. Now if the box is on the approach to a set of lights you have to account for the lights changing, but you really shouldn't be relying on what the car directly ahead of you is doing to know if you can enter that box. If you regularly find your choices are to enter the box following a car and hope they don't stop, or stop at the edge of the box until the car ahead clears with enough space for your vehicle, then you need to be observing further along the road.

But if the box is controlled by traffic lights, and you are second in the queue, you seem to be saying that you have to wait until the lead car has exited the junction, and there is a clear one car gap, before you can set off (at which point the lights have probably gone red again). I know it's an "edge case", but these edge cases are what makes this channel so interesting.

@@peterhewson4568 if you are second at a light controlled junction with a yellow box in the centre of the junction, you should very easily know well before the car in front of you entered the box if you can follow. Two examples: You are both going the same direction, so you have looked at your intended exit from the junction and the road is clear. There is no reason to wait when the car ahead enters the box, because their exit road is clear, so you will both cross the junction and continue your day. You are both going ahead, but there is a queue of traffic on the road you will both be exciting the junction on. The query is stationary, but there isn't space for both you and the car ahead to exit the junction, so you wait until there is. What if you can't see into the road you are exciting the junction on? You should be watching the other traffic following through the junction to determine if it is clear, or if there is a queue (drivers slowing down as they exit the junction). Regardless of any yellow box, you absolutely should not be entering a traffic light controlled junction unless you can clear it and exit. With the caveats that you can enter if turning right and what will hold you in the junction is the oncoming traffic, providing that your exit road to the right is clear. The situation you are describing is not an "Edge case", nor is it a situation where you are reliant of observing the car directly ahead of you to decide what to do. You need to be observing the road further ahead.
