😢😢😢😢 i fostered a little 3 year old boy years ago, hes 17 now. His mother was positive for Marijuana and never denied her use of it, but was always adamant that she never smoked in her home or in the presence of her child.. PER the 2 caseworkers that placed him in my home Marijuana use was the ONLY reason why he was removed. She was a young mother, she was the ONLY parent to ask me how her baby was doing while in my care. She was the ONLY parent to talk to me about her child, his likes and dislikes. She thanked me all the time for taking such good care of her baby whole she did everything mandatory to try to get her baby back. This was a gorgeous little boy (really looked like he could have been a model for toddler clothing etc) I can still hear VIVIDLY the comments of CPS higher-ups commenting on how he was so adoptable because of how gorgeous he was. Mom completed every class and passed every test, had a steady income, safe and secure housing YET he was adopted out to a dentist in the next county over. Goal of CPS is family reunification and I truly believe her son was stolen. I closed my home to fostering shortly after he left my home. I run into her from time to time, shes married with a few kids and her sons (new) grandmother will on occasion send her photos and updates of her son. No doubt he has had a comfy upbringing but its not a crime to be less financially stable and i believe that combined with the fact that bio mom was young, Hispanic and naive played a big role in to why he was taken from her

We have an open investigation with cps. Our daughter tested positive for marijuanna and now they came and interrogated me and my husband. We didn’t know we didn’t have to submit to their questions and I admitted use during pregnancy. We are scared. I agreed to a drug test on Saturday this week and they want a follicle & pee test. Should I tell them I regret agreeing and not go. Or what do u suggest? I’m in Texas. Thank you in advance we just need guidance. Lawyers aren’t available until after the drug test and I don’t want to make the wrong decision

Long story short cps said they submitted a urine sample that I had left behind after a verbal altercation with the nurses. I never signed the label but apparently they submitted it anyway I'm afraid these assholes are up to shit. Because in the report it falsely claimed that I was on a specific drug #fishy. I'm wondering why it was specified? Because that is probably what is going to show up on the tampered report. I was never served court papers for them to send the urine off 😢🥺. I kept trying to tell my husband to call an attorney but I'm guessing he didn't want to pay for one even though I Know we have the money. I think someone in my county department is making these calls. Claiming to be anonymous because I now have two cases that state similar things in the report but just added info.

It's nothing more than government sponsored kidnapping and human trafficking. Never say yes to CPS just like the cops don't talk to them don't let them in your home and call the school and threaten them with immediate legal action if they allow cops or CPS to talk to your children. We just need to understand our rights and take them back.

Yea you have the right to say no..but cps treats a refused test as a failed test so that will not work.. this information on video is not fully accurate and still can get you in trouble.

My granddaughter was taken away 3 yrs ago, from my daughter, child's aunt. at a court house, she was 10 years old. the CPS worker has not answered my daughter's calls, or returned her calls. we have not received any information about my granddaugter. they just took her. Thank you.

My exes aunt keeps telling me to talk to them bc I have nothing to hide. I explained to her the last time I allowed them into my home they turned and told lies. So now me and my entire family refuse to talk to them at all. But now they’re coming after my kids father. This has been going on for 6 yrs the past 5 yrs I did family based once and every allegation they came with I had ruled out but they keep coming

My three children were stolen from me because I tested positive for marijuana. It has been over a year and I’m still taking drug test… all coming back negative. And they still won’t give me my children even tho I have a house, their rooms all set up and everything.

Welp only wany to solve this . They did it not me I tried and tried and with everything going on, and finally get a misdiagnosis’s they don’t care . So like I told a lawyer if you’re not gonna go on actual facts then be prepared . I said in Texas this shit would have never gotten this far , I don’t mess around with kids specially mine. I’ve yet to find a DCS worker , lawyer , or judge who has been in my shoes and seen what I’ve seen as a first responder. Then they get pissed when I call them out in the open” because it’s not politically correct but it’s 10000% facts” not my fault .

Soo can we sue them then because they took my daughter and refused to even put her with family the adoption was already planned before they even got her. 🤔 They falsified my drug tests numerous times! Now the fosters are trying to change my daughter's whole name at 8yrs old, that is weird 😐 she's kind of old to be playing change my name games. I literally still have joint custody these people just disappeared and I found out they live 45 minutes away from me and I haven't seen my daughter in 4 years when I'm supposed to be getting visitation money sure does talk because these people have gotten away with not following any court orders and I have already been thrown in jail twice for refusing to pay child support to some rich fraudsters

I have a question. What if the only allegation is a positive hospital screening that was never confirmed and I told them that I don’t drug test without a court order so they made a jurisdiction finding just so that they could order me to drug test. Also they have had my son for over a year in foster care. He was detained without any court order/warrant within a few hours of his birth even though he was not coming home with me due to being premature and was in the NICU for a month and a half. Discharged straight into foster care. I had hired an independent expert witness who testified that the medication prescribed by my OBGYN for hypertension called Labetalol is known for causing false positive screening results. It’s even on the website stating that. And no confirmatory test. How the heck can they remove a newborn without confirmation? I am in California btw.

I'm not sure how California law works as we're only licensed in Texas. First, what a terrible situation! In Texas, there are limited circumstances where the State (including CPS) can force a parent to take a drug test. Here, the Court can't order a test as part of an investigation and can't order a test as part of services unless CPS has already been awarded conservatorship after an adversary hearing. Second, you are right that Labetalol can cause false positive for amphetamines. It sounds like you took the correct course of action by bringing in an expert. That's what I would have done here in Texas. Finally, if you do not already have an attorney, then you absolutely need one to help you through the appeals process to correct this horrible situation. I am so sorry your family is going through this.

My daughter was taken and they did a hair follicle test and said she was positive for methadone cocaine and fentanyl. I took a piss test and was negative. I don't know what to do. I use to have a drug problem but been clean since may 10th 2022. I scheduled a drug assessment and I'm hoping I get my daughter back

They tricked me and it took me almost 2 years to fight them away. At first they said they knew the allegations were unfounded but that I should go live at my sisters house WITH my daughter until it was all cleared up. Before I knew it they (with my sisters help) said I had to leave her house without my daughter. I didnt know my rights and I paid a heavy price....although I did prevail after a long battle. They are used to bullying people into submission but I played their game and won.

@@MatthewHarrisLawPLLC I would have done more research into my rights and put my faith and confidence into that instead of blindly believing that my family would back me up. I had zero support because they didnt believe Id be successful. I made it a point to NEVER see failure as an option and I played their game by their rules and managed to win. They tried to make me attend in patient rehab but I knew rehab wouldnt take someone with a clean hair follicle result so I put it off until I had a clean test result so CPS had no choice but take that requirement off the table. There are ways to fight them while also appearing to be completely compliant. While it was no doubt the most difficult and stressful time of my life Ive also gained a strength and confidence I never knew I could have....no will ever take my kids away ever again. No one. I would really like to help other parents in this situation but Im not sure how to go about it.

I just had a new born and they removed me from my parents home and threatened to take my baby if I didn't move bc I tested positive at the hospital and my parents admitted to smoking but they haven't talked to use since then nor did they check the ppl they made me move in with and one of us have taken a drug test for them the whole situation seems fishy but I'm scared I'll make things worse, they also claim they never heard of the new texas law say they can't remove kids for thc not to mention my parents smoke it legally and I wasn't even in their custody when they did use thc

Well, you first need to know that CPS can’t take possession of a child based solely on a parent's positive drug test for marijuana. If the child tested positive at the hospital for THC, then that can actually be grounds for removal. If you tested positive while pregnant, or the child was exposed to THC while you were pregnant, then that could be used against you. So I have not used any drugs have my meds but a test came neck positive to come back confirmed negative but have patches on get urine and swabs weekly because that false one them they didn't irder the patch and urine came back positive is it the labs

I have a question. I could not pee bc I have the WORST shy bladder when people watch me pee, so I wasn’t able to pee. I only smoke marijuana (which they said is allowed) but I genuinely cannot pee with people looking at me and now they keep marking my drops as dirty just because I can’t pee. What do i do ?

Wow! I can honestly say this is the first time I've encountered this. I'm surprised that this hasn't come up before because I do know that this is a common issue. Instead of a urinalysis, you could also submit to a hair test. No shy bladder issues! All of this is presuming that there is some sort of Court Order that requires you to undergo frequent/random testing for CPS. If there is no Court Order requiring you to test, then you should definitely speak with a local attorney to find out what your options are.

@@MatthewHarrisLawPLLC some agencies say if you don’t test, or fail to take a test/ and or miss a test, it will be marked as a positive test. I do believe that’s usually written into the case plan and signed off by the court however. But yea, it’s not uncommon to say any miss will constitute as a fail. Granted I would think that an inability to pee due to people watching you should be brought up to your attorney and discussed with the court about using another method to better accommodate the parents needs (This information should not be construed as legal advice and should only be used for educational purposes only).

Unfortunately, I'm not familiar with New York law. It could also depend on whether or not you have agreed to work services and submit to such tests. If they just showed up on your doorstep, and asked for a drug test without a Court Order, then you have a lot of protections from such a warrantless search. You should definitely speak with a New York CPS Defense Attorney.

If you already took a CPS Drug Test, then you should contact a local CPS Defense Attorney immediately. If the test result comes back positive, then you'll very likely need an experienced attorney to have your back.

Who can I talk to that's over dcs my removed my daughter from me friday the case worker lied about lot of things that's on the petition it even said they receive the results of her hair follicle on the 24th but didn't come get her till the 3rd which was Friday they won't tell me how she is nothing. Didn't contact family or nothing I thought they were a place that kept kids with family because of trauma they didn't wanna cause they yanked my baby from my arms feiday with her screaming places her somewhere she don't know who she is with. Dcs is not who they say they are they are all about money

I had 9 cases with cps the 1st time they made me and my wife she was my fiance at the time mind you we live in Utah I ended up before that drug test I got arrested for false rape allegations which I have been fighting for 3yrs which I'm innocent and have infinitive proof so didn't take that one but later we got another case I've been a long time mj user for medical purposes only well we had alot of drug allegations over a yr span my wife was forced to do a hair follicle test 1 time and then we both had to test and I had MJ and she had nothing but her Dr prescribed meds Adderall and Xanax the 1st tests were done at the AP&P office and they were inconclusive so we had to take another a wk later same thing so how I beat mine was I filed for my card boy did that piss them off I had custody of my young son who was 6 at the time of my arrest he went to his mom's who was using meth and heroin and drinking well she got 2 cases so before family court he moved back with me mind you CPS didn't like that we did that without their consent so the 1st court appearance when they brought it up so when I spoke I told the judge me and the mother were talking and decided it was in my son's best interest to move him back with me mind you I won the judge over so each appearance when I talked the judge sat and smiled and was very interested in what I had to say this went on for a yr and at the last date my worker recommended case closed the GAL wanted to keep it open but the judge shut her down and closed the case and had given me full custody in the beg even with my criminal case open and closed the case and I now have a block on my name so any allegations since most of them were made by a CPS worker linked to my criminal case there is a block on my name not to investigate cause each time they did in those 9 cases everything was in order even with the drug testing I'm gonna file charges against that worker and do a FOIA request to get all complainants names so I can file against them that's how I beat them

@@MatthewHarrisLawPLLC how do I stop the judge from violating my rights tho I started studying criminal constitutional and common law I told my attorney almost a yr ago what motions to file he didn't about 2 months ago I threw a curve by telling him the civil rights act of 1866 enforced 1871 that lit a fire withing a few days he had filed the motions I asked him to months prior how do I tell the judge my due process was violated and he should rule an aquitall in my favor the det omitted statements negligently investigated he never interviewed my witnesses at my house influenced a state agency to not show up for 3 subpoenas he blatantly disregarded proper procedure didn't read me my Miranda rights I think my next court date I'm gonna ask the judge if I can address the court and advise him on the civil rights act and remind him his qualified immunity is about to disappear then advise him about depravation of rights under color of law I have a really good question for you is it normal to have 4 diff judges and I'm now on my 8th prosecutor I'm not a career criminal I got my 1st charge ever when I was 38 for smelling like MJ at my own house I'm now 50 are they jealous cause I'm tattooed and have piercings and never had a criminal history what is your take on this to me this whole entire case has been unlawful during my arrest which happened at my job which I was I high up supervisor they assaulted me which I didn't have a weapon or show aggression (Terry vs Ohio 1968 holding) they molested me (unlawful search and seizure under color of law) and I sat in jail for 88 days they finally got me a lawyer about a month and a half in during the interview I asked for a lawyer 3xs and the det told me I don't get an attorney and booked me in jail not to mention the undercover cops he had watch me at work for hours at a time I'm just at a loss how they think this is justice sorry I'm blowing up the messages but is it me or is there wrong doing here

Oh man, that is just insane. Obviously I don't know all the facts, and since you have an attorney it wouldn't be ethical for me to comment on their course of action. I will tell you this though. If you want your attorney to take a specific course of action, put it in writing, ask them to counsel you on the pros/cons, then give them clear direction in writing of the decision you've made. Lazy attorneys are terrified of directives in writing. I hope this helps!

@@MatthewHarrisLawPLLC it does and trust me I have no prob giving him directives I have all emails and texts with everything I tell him I have prosecutor and attorney misconduct from the bar code of conduct hand book I'm dangerous to them they keep hoping I will just take a plea and go to prison for something I have 100% proof of innocence for no I believe in the constitution and law and seeing the way the improvise pervert and adapt laws to fit their agenda is disgusting but I'm sure they didn't count on me learning law I'm in the network with all those auditors that are on KZitem that have been getting tyrant cops fired and jailed my attrny hired another attorney to help with my case and the first time we met he talked condescending to me saying he has seen alot of internet attorneys fail a month and a half after that meeting he called to check on me after my PTSD episode I had during a zoom meeting and he said Donny I just want to say you are very well read in law I'm impressed that means a lot to me I used to be a shift manager at mcds I was new to my law study then my other manager that was scheduled texted me him and his uncle were detained so I started the process having him ask if they were under arrest or detained then he acted like he contacted an attorney I asked what the charges were and his uncle was driving a car that was reported stolen they said in the trunk was 10 gs of bud and an unknown amount of meth red flag why weigh only 1 falsifying and fabricating evidence then they said my manager left a print on a car he never touched and had a match in 15 mins forensics doesn't work that fast so I said have them test his uncle they denied I said 18 USC 1983 he texted me back they are getting a test ready then I told him tell them you are filing a mental duress case against them what started with 15 cops with each charge cops were walking out by the time I got to mental duress there was 2 cops left I wanted all names and badge nums in just over an hr I had them walking out charges dropped the 2 cops took off their badges gave fake names and offered them a cash bride not to file the mental duress can you say owned ha ha I told my attorney about it and he was impressed I told him now if I did that in my early stages imagine what I can articulate in front of a judge now with what I know

I’m a RN who worked with CPS and APS. I think its wrong to help people evade drug tests when there is suspicion about abuse in the home. I’ve seen some really, really horrific things in my career that children and elderly people have been abused of and CPS and APS barely have the resources to handle the worst of situations. I hardly think they’re harassing innocent parents and caregivers. Please help the victims. Not the abusers.

I certainly appreciate the work that you do, and I'm absolutely with you in wanting to protect victims of abuse. However, if CPS/APS can't build a case for abuse without testing parents, then they have a pretty weak case to begin with. Just think about that for a minute. What does a parent's positive hair strand test, months after use, prove regarding parenting ability or abuse? There must be some nexus between the use and the abuse/neglect. Witness reports and outcry statements made to professional reporters by the victims are far more valuable in prosecuting abusers.

You are NOT a federal employee but a CONTRACTED NON GOVERNMENTAL OFFICIAL and that YOU are NOT PRIVILEGED to be informed as to the WHYs when CPS OR APS seizes children AND ADULTS and that you're ONLY provided with ONE SIDE OF ANY STORY that they provide you and that via contract, you're to never question their authority nor have contact with "ALLEGED PERPETRATORS" if in fact you feel, based off what you've watched in their actions not corresponding to alleged charges as questionable OR to talk outside of, visit outside of any other places besides designated locations under watchful eyes of someone they pay to have visitation with their family and if you were to ever do anything outside the scope of your contract then your working relationship would be terminated as well as your contract not being renewable for at least two years so your opinion is narrow given these facts and one question you should ASK yourself is this....If NOT A MONOPOLIZED JOB SECURITY Industry then WHY is it that CPS/APS ALONE have FULL CONTROL and NEVER CONTRACT OUT for the HOTLINES?? HMMMM ??? IT'S pretty clear WHY, because there's no transparency, no accountability and ALL ONE SIDED FRAUD, manipulation of the MASSES in CONTROLLING THIS ONE VERY IMPORTANT PROCESS and that when NONE are allowed to compete for this CONTRACT for HOTLINES then that's what Intelligent and Professional People call a MONOPOLY and thank you for helping where you were needed but that you ONLY are a Baby in the UNDERSTANDING of JOB SECURITY BY SEIZING CHILDREN AND ELDERLY IS ABSOLUTELY NECESSARY IN ORDER TO MAINTAIN THESE JOBS but that Everday, Normal people view this as HUMAN TRAFFICKING..anytime money changes hands when seizing anyone away from their ENTIRE FAMILIES instead of Letting other family care for them and PAY STRANGERS instead makes no sense whatsoever other than leads to EVERYONE KNOWING IT IS FOR THE JOB SECURITY they cannot!!!

ALWAYS two sides to every story. While CPS is there to protect the child…they too have been known in many cases…to make the wrong, obvious or negligent choices that get a child killed.
