@@umarzain8861 Ho saktaa hai aapne kisi aur source se yaa loan le kar ghar khareed liyaa ho, aur baad mein apnee property bechein to bechne par jo capital gains accrue hota hai, wo pehle khareede ghar ke saath adjust ho jaata hai Purchased a flat, in say 14th February 2022 from accumulated income or loan for full value of 50 lac. Sold old house and earned a capital gain of 50 lac in December 2022. The net capital gain will be Rs. 0. But if you do not purchase a house to live in by 13 February 2023, then you gave to pay capital gains on the sale of your old house and the amount will not get adjusted

Yes first you need to get a loan on your name and get the property transferred to you , once you transferred it to yourself you could adjust the capital gain

Good afternoon sir , sir mere father ka in heritence mai mila house jo 2001 se pehle mila hai sir ab is house ko sold kar rhe hai to buyer kah rha hai ki registry se pehle wo building ko plot karwa dega phir registry karayega? To sir kya aisa possible hai kya ki plot ke sale consideration ke against building ki cost of acquisition and cost of improvement claim kar sakte hai kya with indexation? Pls reply

Hi Sachin, Very nice and informative blog by you. I have a query- I and my wife have 2 residential flats, one we booked in 2007, got possession in 2013 and still living there. second we booked in 2010 but yet not got possession, we will get in 2023, this is delayed by builder for >10 years. we have home loan on both the properties by different banks. My wife is inheriting 40 Lakhs upon selling her father's property. Can we foreclose our existing home loan with that amount and take benefit on long term capital gain tax? Please advice

Very informative video ----Can you help me with below 2 clarifications. - I have sold my property last month and buying another one before ITR filling., Do i still need to open Capital Gain account with bank as you mentioned? 2) The new property that i buy is on my Wife's name, and since it's a big flat - my son also is planning to sell his small flat and contribute in the same. So can he also take capital gain exemption. New property would be on my Wife and son's name. ( 50-50)

Sirji, Please help me understand. I booked an under construction flat in Feb 22 by taking a homeloan & started paying EMI. My agricultural land will be sold by converting it into 10 NA plots. Each plot to be sold to individual. I will be selling all my plots in the period Aug 22 to Mar 23. So, can I show capital gain earned by selling plots used in buying a flat which I booked in Feb 22 & will be completed before Mar 25? What I need to do with homeloan already taken? Wanted to how 2 years will be calculated if plot selling period is Aug22 to March23.

Sir, I sold my residential house on 3.4.23. Net LTCG after indextation benifit works out to 20lakhs. Invested 15lacs within 6months of sale in 54EC bonds. Can I claim rebate of remaining 5 lacs under section 54 towards instalment paid on 31.08.23 for flat booked in 2019, possession of which is expected by the end of Dec 24. Plz clarify. Hello sir, mere relatives Jo senior citizen hain unki pension aur income zero hone ki Wajah se house sale Kiya aur extra stamp duty deker 23 Lakh Jo black mae Milna tha use white Kerwa liya. New house house bhi liya per abhi bhi 20 Lakh capital gain hain. Jin ki zero pension, zero income source hain aur koi property bhi ek Gher ke alawa nahi hain. Kya unko bhi tax dena jaruri hain ya exemptions hain for a 70 or 75 yr old persons.

Ya sec 54 sirf vo applicable hain jinki sirf ek residential property thi aur vo ikloti unhone sale kar di ab unke paas kuch nai hai ....ya sale karne ke baad sirf ek aur residential property hai jisme vo rehte hain aur doosri sale kar di vo bhi sec54 ke liye eligible hain

I have purchased a plot of non-agricultural land in 1990 by Rs.80,000. Now I have decided to sell that plot by Rs.10 lakhs. Circle rate of that plot is Rs.15 lakhs. Please calculate my actual capital gain tax figure , which I have to pay to income tax authority? Please also note that, trying my label best I couldn't find the circle rate or fair market value of that plot as on 01.04.2001. Now I want to pay the actual capital gain tax to income tax authority, so that no future problem arises. Please calculate my actual capital gain tax figure.

Sachin sir. It was amazing "catch" the way you have deciphered Capital gain investment rules. I was under the impression that every sale has to be invested in seperate property. However your explanation clearly made it understand that 2 sales can be invested in one property. Also the idea to investment in family members name

@@expertcasachinNamaste Sir ....agar paper pe buyer lower consideration dikhaye to save stamp duty than actual consideration amount n I disclose full consideration in the returns which will be paid 100% through bank...will it be a problem for me?? The value of consideration shown on paper is almost 5 times of the prevailing circle rate. Your insight would be very much appreciated.

I had only one residential property and sold the same on 30.06.2021 of Rs.2.62 crore and bought a new residential house property on 01.06.2022 of Rs.3.18 crore and deduction claimed U/s 54 of Rs.1.76 crore and capital gain became nil. Please confirm can I claim deduction U/s 54F of the same property which I bought on 01.06.22 for remaining unclaimed amount of Rs. 1.42 crore (Rs.3.18 crore Less 1.76 crore) in next FY 2022-23 on LTCG on sale of equity shares of Rs.50 lakh entire FY 2022-23.

सर मैंने मेरा घर बेच दिया। १४ साल तक मैंने होल्ड करा था। २२ लाख घर की कीमत और ६ लाख की रिनोवेशन कराई थी। रिसेंटली ५७ लाख में घर बेचा। अब, इंडेक्सेशन के हिसाब से आज का खर्चा ६७ लाख दिखा रहा है। मतलब मेरा लॉन्गटर्म कैपिटल गेन तो नेगेटिव हो जाता है। इस केस में मैं क्या कर सकता हू ? क्या मैं कैपिटल लॉस दिखा सकता हूँ ? या फिर कैपिटल गेन जीरो हो कर मुझे टैक्स नहीं पे करना पड़ेगा?

Bhai one query papa bought one property on 28/7/93 amount rs30000... Later on gifted it to his son on 11/12/2020. Then son sell this property amount 800000 on 17/6/2022 . How much taxable income from this how tax is calculated for businessman son...? How much long term capital gain if it is ? Son has many other properties also.. and son also invested 3 lakh in new project in this financial year

Hi schin My wofe have a land ( residential plot) to sell But for my new home (under-construction flat) i had taken loan on my name , although registery is still pending ,its only triparty aggreement So the question is my wife is planning to sell plot , but not able to understand how will she be able to save LTCG Is it possible, to change the registry name of our new under-construction flat to her name ( the loan is under my name) and take the benefits ??

यदि मैं बिल्डर से फ्लैट क्रय करने के लिए पूरा भुगतान 5 वर्ष पूर्व कर चुका हूँ परन्तु बिल्डर किसी भी वजह से उसकी रजिस्ट्री अब करता है तो ऐसी स्थिति में फ्लैट खरीद की तिथि क्या मानी जाती है? कृपया बताने का कष्ट करें।
