Most sewers run out the front of the house to city main. But there could have been an easement where the sewer was running, and behind the house. A contract is a contract. My feeling is, there is no way if this guy was a good excavator and not such in a hurry I don’t understand how he did not feel the pull that pipe. I worked with the excavator and he could feel in his hands at the controls of the machine that there was something in the ground a lot more smaller than a cast-iron pipe

Cases like this are exactly why contractors have contracts that say they are not responsible for damage they cause when It is impossible for them to know that damage is going to be caused by their work. There was no way for them to know there was a pipe under there, and like the judge said, why wouldn't they go and tell the homeowner when they wouldn't even be responsible anyway?

UHHH, the sewer pipe was completely removed by the contractor's crew. Yeah, they didn't know it was under there, and it wasn't supposed to be, but it still would have been a responsible thing to inform the client of the issue, so that it could be resolved as quickly & cheaply as possible. But no, they just covered it all up & T.S. on the client.

The contract was clear the defendant was not responsible for damaging the pipe. But there is no doubt the excavator/hoe operator knew he destroyed 12' of iron sewer pipe. The plaintiff's were 100% in the right that a couple hundred dollar repair they would have to pay for now turned into a $2400 repair... Bad verdict.

@@jawdroper22 this is not correct I literally award projects to contractors for a living. If the contractor has certain verbiage such as “we are not responsible for causing damage” I’d ask for follow up and clarification. If the response is deemed not acceptable we proceed with a different vendor. The difference for my industry tho is my vendors have insurance for cases of this. There is a difference for pre existing conditions and there is usually a clause for that but literally saying you will not cover damage you caused is definitely a cause for pause in any contract.

I understand the plaintiff's point of view. They are saying that if they knew about the damaged sewer line that they could've fixed it for less money. The problem is that there was no way to prove the line wasn't already missing before this excavation.

Contracts these days make companies liable for NOTHING. Same as with apps, no one reads all that malarkey. They should have to be simple bulleted points, 15 max - not as long as the IRS tax code and twice as complex.

If they had someone put a camera in the sewer line, there is a device on the camera that sends a signal out that can be read above ground that is within 6" or so of the line. It can easily be marked or flagged for anyone that is excavating. I have had this done and I know exactly where my sewer runs.

811 only locates, the utilities that are reported by the utility themselves. They’re not gonna find your sprinklers, they’re not gonna find anything metal, they’re only gonna find things such as electric, water until the meter, after the meter it’s a homeowners responsibility,and other such reported lines. They don’t go on a fishing expedition for anything is put in other than that.

The contractor covered up. They should pay 1/2 for filling in the ground and putting tile over their mistake. The damaged pipe is not covered by contractors mistake only.

Never sign a contract that states you're responsible for excavation damages. There's no way a 12 foot piece of metal pipe was missing from the sewer lines and the pool installers didn't do it. The couple started the piece missing connected to the lines going to the street. A house that old would have had sewer issues prior to the pool's installation.

As a contractor I laughed at the people outside that said he was responsible. The contract always prevails unless they can prove indisputable evidence the contract was violated. Their opinions are just that opinions.

The landscape company I work at has the same clauses, however we call the 811 number and anything that is missed by the locating company is not our responsibility. I've been to houses where clients didn't know where their utilities were. If some utilities are questionable call and request them get checked. Sewer pipes and septic tanks are the worst for us. Newer houses have risers on the septic tanks so we can see them and stay clear of them. But older homes may not have them so that is brought to the client's attention to get the septic pumped, located and have risers installed.

Standard contracts case. Defendant put in a waiver of responsibility for something like this and the plaintiff signed off and agreed. THEN actual issues arise and now they are shifting blame. Sorry....you signed the waiver. Very easy case. They could only win if the area was marked and they still damaged the sewer line.

When installing fios underground in my neighborhood something like this was happened by workers and though I didn’t panic,the workers were apologetic and quick to repair it. The foreman on the other hand was even quick to deny,get aggressive and then condescend to suggest I be grateful for the better outcome. Ffs

This is how contractors get away with gross negligence on a daily basis. The contractor shows up in court, no witnesses from the incompetent crew that damaged the sewer line to testify as to what took place. Just the contract which releases the contractor from ALL liability that every unsuspecting client is going to sign, not understanding that they have no recourse in the event of total incompetence.

Come on plaintiffs, they did not know the line was damaged, you can not hide backed-up sewage and they would not have been held responsible anyways, meaning there would be no reason for them to try to hide it. The defentant would never intend for the decking to be caused to be torn up, afterwards.

I just had a drain field replaced and I have owned the house for five years it has an inground sprinkler system that I didn’t put in. The gentleman I dealt with told me he would do his best not to damage him, but could not be held responsible. If he did I needed a drainfield I signed a contract. He ended up digging up one sprinkler line, I repaired it because just like me he has no idea where anything is that in the ground in my yard but I know where that line is now. I mean it’s just a cost of doing business. How can they blame him he knows about as much as you do about the house let alone buried under the ground.

Really they had plumbing cameras put down drain and it was good then they work on it now drain is missing ? It's one thing to damage it but to cover it up and home owner pay to have finish work done only to learn now have to redo it all, defendant should part responsible in this. I would never sign anything like that.

I worked for a utility company for 34 years. That was their personal sewer line, not the responsibility of the contractor or the locating company. That line should have been moved before the pool got started.

Simple contracts case. Read the contract prior to signing. If you see something you don't agree with, ask to have it struck from the contract, have both parties initial it, sign and take a copy.

I would have sided with the plaintiff if the township never came out and spray painted the ground for pipes or electric lines. But seeing as the township came out and did that but did not spray paint for pipes it makes the plaintiffs case harder. Compounded with that disclaimer in the contract and the husband and worker joking about the pipe being broken, definitely a losing battle.

The contract is completely right. They are not responsible for the broken sewer line. However, if the excavation guy was not in such a hurry, digging the hole I cannot see how he did not feel the pull of the cast-iron pipe. I had an excavator who would dig for us, and he had this feeling in his hands at the controls when there were something in the ground. I would jump in a hole and sure enough it was either a water service, something that did not feel right. Rest in peace Billy.

Had nothing to do with the sewer pipe, they just claim that the contractor hit and broke it. The sewer line is owned by the homeowners not the utility company, so because the pool company did not know it was there as with the homeowners, (homeowners) are now screwed per the contractor’s contract.
