Consider this. Polish laws around ip is different from ours. If i remember correctly there is a stipulation where the party who was paid may ask for more if the value of said property was underestimated.

I'm Polish and I've read the Witcher series not to long ago in its native language. He is an unbelievably amazing writer. He is very good at balancing multiple storylines with perfect pacing. Too bad he's an out of touch asshole, and he doesn't deserve a single dollar from CDPR. CD Projekt Red is a huge source of pride for us, they took out a huge loan from the Polish government a few years back because they refuse to release a bad game, or one with micro transactions.

@4nemek Well if you didn't follow the story of this i suggest going back to old video of YongYea, but in a nutshell the author accepted only 1 time payment when they made a deal long time ago because he thought the game would flop then suddenly asking money on CD Projekt because Witcher its so popular now (known in the entire world not just EU) and worth a lot.

It sounds like he wasn't confident in his work and story. The failure to strike a deal that includes royalties for a story like the Witcher is reflective of his own insecurities. It doesn't matter that he thought videogames were an inferior form of media, he should've stood by his work. George R.R. Martin stood by his work and went from a struggling writer to earning 20 million a year...

Sapokowki it a great writer to be sure but he is a bit of an arrogant tit CDPR made the Witcher a World wide brand. Before the games the Witcher was only really relevant in Poland and now because of the success of the game series the Witcher is now global having the books translated into over 150 languages. Sapkowski has made millions from the success of the games selling his books he should be thankful that CDPR respected his material and did a damn fine job to not drag it through the mud.

I can understand being bitter when an adaptation of your own work becomes massively successful and you are getting zero royalties from it. But YOU are the one who turned down the offer. The fact is, Sapkowski probably made more than his fair share by proxy of the fame that the games brought to his novels. Throwing a tantrum about the fact you made the wrong bet despite profiting off of the deal anyway is both greedy and childish.

Just remember that everything you playing the Whitcher is not a CD project red‘s idea whatsoever everything was created by that author and now he’s getting screwed. He signed it, he got what he asked for, and now he wants to change the price of what he got paid for. Also He stated in the past that his books made the game popular but it was other way around. He got money from selling his books after the game released, then got fame from CDPR creating one of the best games ever made based on his books, he just doesn't want to admit to the superior succes of the game over himself, we can see that in his statement about not believing in games.

I'm no lawyer, but in Poland the copyright law seems extremely fishy... I think it's stated that if the author's payment turns out to be very low compared to buyer's profits, it is in author's right to demand additional payment, no matter if it was a gamble or not. Sapkowski definitely lost a lot of my respect with that case tho

Remember cdpr are polish too - i'm sure their lawyers knew all of this- both back then and now- and their statements about this situation suggest they are confident- it might be in the fact that they didn't buy the license to his actual books- just to use his setting in their own games - which in no way effected the guys original licensed works (except gave him more sales).

@Karricjusz that's a (semi) universal aspect of contract law, however not quite the sense you outline and not a worry here. Effectively in order to prevent predatory practices and curb monopolization and abuse of small businesses or less educated individuals, contracts and deals struck must be of appropriate parity. Both parties must get what they feel is appropriate payment and more importantly both parties must reasonably understand the value of the contract. In essence like Hudhouse99 said, it's to make sure if EA went and bought the rights to Harry Potter for £50, to use it to make a new Magic-based Battlefield game with a £150million budget , it means J.K can turn around and go "Hang on, I wasn't aware of the true value of an IP, you were since you invested millions into it in order to make billions." However that DOESN'T just mean you can sell whatever for anything and later on demand a chunk of the profits; if J.K doesn't value movies at all, that doesn't mean EA are obligated to make her understand and force her to take more money. That's why that law doesn't really apply here. CDPR didn't deceptively acquire the license or (as far as anyone knows, and Sapkowski certainly never suggested it so it's unlikely) deliberately take advantage of Sapkowski's lack of knowledge of video-game valuations. They offered him a sum of money or royalties and he took a sum, not because he was duped, but because he didn't think video-game royalties would ever amount to more than the sum. Notably his complaint has only come about after W3 when CDPR made it big, and not after the reasonably successful W1/2. I think the key point is that at no point has it been suggested CDPR particularly 'underpaid' for the license. If the claim was "You cheated me by paying such a small amount" it'd be a different ballgame. Instead the claim is that his payment was fine at the time, but now CDPR has made so much more money, he deserves a bigger slice of the pie.

This seems like the best possible outcome. After the ham fisted attack, CDPR has handled this with grace. I'm just so absolutely pleased with CDPR; I want to play their games because they make some great games (as an OG Shadowrunner, Cyberpunk 2077 is a wheelhouse game for me), but now I want to buy their games to support them. It's nice when a company can make me glad to give them my money; when it goes past value and starts encroaching on respect.

But for some reason almost everyone knew Pratchett, Tolkien, Hobb and a ton of russian fantasy writers. Thought I must admit, you might be true about the 90s, as I was a kid back then. I read the first book of series around 2009-2010. I remember how hard it was even to buy it and now every damn book store has it on the shelf. So book and author himself he did get quite a lot of poppularity because of the witcher games series, didn't he?

I mean pretty much the single largest reason the books were even translated into english is beacuse of the video games. The later books weren't even released in english until after TW3 was released. Can guarantee it'd take much longer, if it'd even happen at all if the games were never made. So while yes, he made a mistake by not taking the royalty agreement, he still won out due to the huge amount of advertisement he got for his universe. And that's not even including what he's probably getting for the Netflix Witcher series.

Completely agree with that last statement. The witcher 1 sold a lot in Poland because of the books. Enough for CDPR to make the Witcher 2 and that's when they started translating the books into English. The last of which was finally finished just a few months ago. Having said that there is a clause in Polish(EU) law about this that when an IP is way more successful than expected the one that sold the IP has the right to ask more money. But on the flip side of that. If Andrzej had gone to CDPR and began the discussion more pleasantly I'm sure they would have hammered out a deal without any press even hearing about it.

This was probably the author's plan. He did know about his BIG mistake about royalties knowing the law would probably be on his side were CDPR to have success. What he didn't know was perhaps how big CDPR's balls are, but he also knows he is a hero to the game companies' founders. Just check the difference between the Witcher Netflix show date and these claims and controversy. And I smell American corporate interest here, as usual.

@JosieCat You have a point. But it was only two books. The Last Wish (2007) and Blood of Elves (2008) were translated into English around the time of the first Witcher game(2007). However Time of Contempt didn't get translated until 2013 and the rest of the books came after that. Well after the popularity of the Witcher 2 (2011) sparked interest into these books more than the first game had.

Sapkowski just needs to take this as a lesson learned, not to sell himself short, and if he thinks he's owed more than he agreed to because he missed the opportunity years ago, he can quite simply "git fukt".

2:25 that’s an understatement if ever I heard one, I heard that even his “”friends”” don’t like him that much, when your friends say stuff like he is hard work it’s probably time that the ghosts of Christmas past present and future come pay you a visit. Heck if anything Sapkowski should be paying CD Projekt red for making his books famous outside of Poland, it’s absurd I know but also kind of true, before the Witcher games the series was pritty unknown to the world at large, yes they had there cult following that loved than and can’t wait for the next one (like were is the next Dresden files book Jim?) but that cult was quite small and now because of CD red netflix is making a show that’s going to have superman in the role of geralt and you can’t tell me Sapkowski got pay poorly for that deal?

He didn't sell of the rights to the witcher- he still owns the franchise- he just licensed out the setting for the games. He still owns the books and rights to license the franchise further. And his sales for the books have increased hugely since it became a world wide hit. Before the games almost nobody outside of Poland had ever heard of them. It also got him the Netflix deal. He should be grateful.

I have no sympathy for the author at all. It's no one's fault but his own for being such an ass and not taking what CDPR offers him way back then. He can't get money now just because it's done really well that's just tough luck. I hope they give him nothing as that's what he deserves

CDPR is a shady corporation they cut a deal for the first game but didn't even gave him a cent for the 2nd & 3rd game. They took his own ideas and making huge profit they have to give him a better deal and stop screwing people.

Oh, this burns me so much! How dare one creative person insult another creative endeavor? He made his choice, he needs to live with it. He is still making money as a consultant with the Netflix deal and from his books. He is still being paid for his creativity, which is the dream for most creative people (myself included). I would love to see my stories on different mediums instead of just book form. Sigh . . . Rant over.

He wasn't always like this, he grew bitter over the years, I remember back in the day when people asked about the story in the games he politely said that the games weren't part of the official canon but that he trusted the writers at CDPR to deliver a good alternate world.

Legally speaking, the Polish law protects artists from making stupid license deals like the one he made. Still, the sum his lawyers asked for is outrageous. This could have been settled quietly without all the media attention. I hope they can overcome the differences in an amiable manner so that we can see more quality works from the Witcher world.

I'm fairly sure its not to protect them from being idiots- its more like, a big company take advantage of someone and offer a figure much lower than they KNOW it is worth- and the person doesn't know any better. So the company had operated in bad faith and exploited their lack of understanding. And from everything I've heard they didn't do anything of the sort. They even offered him a new deal with royalties a second time after the first game was a hit- and he again didn't take it. Also, he didn't sell the license to his actual work- just the setting for the games. He lost out nothing of what he already had - and I think that makes a difference too. I read some about the case and cdpr thought he had no case. Their polish lawyers know the situation way better than us- they would settle for a couple of million if they thought he had the law clearly on his side and they had no chance.

Heres the thing, that stupid decision is entirely his fault, he was given all the options in front of him. its not like CDPR hid the fact that he could get royalties. the law is on CDPR side here.

@@elevown Yeah, I'm not going to look up the exact wording of the law that addresses this now, but I think, all things considered, he has a case to get some settlement. Not the whole amount though, which is what CDPR meant I believe. Reaching a compromise that is satisfactory to both parties seems like the best way to resolve this.

Mike Pondsmith (the creator off Cyber Punk 2020) made the right decision by showing support for Cyber Punk 2077. But to be fair to Mr. Andrzej Sapkowski, maybe he couldn't foresee the success in video games due to his archaic views on video games being a simple binary product with no sophistication that can accommodate his novels (in other word, he is too old to understand video games). However, a deal is a deal and there are no grounds for Sapkowski's claims.

Sapkowski is one of those overrated pricks that blow up because their work was adopted to another medium and sold well. He's too old to understand what he's talking about and out of all the books he wrote for witcher series only 1 of them (The last wish) was highly regarded as a master class fantasy book before the games came out and other ones were debated a lot. Now it gets famous and everyone that wouldn't go that deep to read fantasy books is reading them because of the game, which ends up to the hype train.

He did exactly the same with Netflix. He resigned to be Netflix's Witcher creative director, coz he has no faith in it. Again. Here in Poland we all realized logn time ago that he's nothing but an old communistic dinosaur, who cannot keep up with world's media/entertainment progress.

Someone had mentioned in another video that the lawsuit was based around a Polish law which stated that if an writer sold distribution of an IP to a company and they made significantly more than the profit of the author's medium the author was entitled to additional profits even if they had separate agreements which were fulfilled.

Some people only want an excuse for keeping themselves ignorant (i.e. not touching a book ever). They are obviously the majority (being mediocre and parroting is easy). That doesn't mean they'll ever be right. I too want this to end peacefully. A Sapkowski-written Witcher game adventure? Sign me the fuck in. A Witcher Netflix show? No fucking way.

I did say this before when this story broke out but even if CDPR are under no obligation to do anything they should. Even if he's an Asshat 'keeping on good terms with the author is the best solution going forward. Besides the Asshat is the one soaking up all the negative press... It's not as if CDPR masterminded this whole situation lol.

As much as I like the Witcher series... there's nothing so compelling about the story that they couldn't move to another foundation for ongoing titles. It's a fantasy world with monsters dwarves and humans (etc...). The witchers themselves are the only semi-unique feature - and those could be morphed into a different monster hunter style storyline very easily. So... while maybe kicking him a few more bucks would be a nice show of thanks from CDPR... if he's too intransigent they could play hardball or even dump his ass with no or maybe limited damage to the studio (assuming they'r not so far along in dev of Witcher based titles that rewrites would be required). The magic of these games is primarily CDPR and they're outstanding game design.

That would make sense if Witcher was a generic series, but it isn’t. The slavic folklore wasn’t really present in a game before. You just can’t recreate a similar successful fantasy world as easy as you think.

Completely disagree. Witcher stands out among most fantasy for its adaptation of Slavic folklore. It has a completely different atmosphere than Tolkienesque fantasy. Also wouldn't say Witcher was outstanding game design. Most gameplay features were pretty standard. The writing and the world are what made the game so good.

Tbh, I would like to see CDPR or FromSoftware make a Vampire Hunter D game. There's over 25 novels worth of material all with unique monsters, villains, characters, regions, self-contained storylines and features a badass monster hunter as a protagonist. There was a ps1 game back in the day that was really bad, but it could work wonders in the right hands.

Uuuuuh, by law they sort of do have an obligation under Polish law: "Article 43. 1. If the contract does not indicate whether the transfer of the author's economic rights or the granting of licence was free of charge, the author shall have the right to remuneration. 2. If the contract does not specify the author's remuneration, such remuneration shall be set taking into account the scope of the right granted and the benefits resulting from the use of the work. Article 44. In the event of gross discrepancy between the remuneration of the author and the benefits of the acquirer of the author's economic rights or the licensee, the author may request the court for a due increase of his/her remuneration. " The question is whether the author was fairly paid considering his lack of risk in the contract made. Because the benefits resulting from the use of work was greatly underestimated.
