I don't understand why Chad's children didn't talk about how much Chad loved their Mom, how he was a great father, and a good man. Chad didn't have a single witness defend Chad as a person and a human. However, Tammy had quite a few co-workers and friends talk about how kind and lovely she was. Chad is apparently so terrible that no one will lie on the stand and say that he's a good person.

IMO that statement helped the prosecution more than the defense. Chad's desire to leave a loveless marriage could definitely be motive for murder.

Does Prior imagine that everyone on the jury is as mean spirited as he is? He doesnt realize that most people instinctively recoil when hearing that level of contempt. It is like he thinks the average person will eagerly participate in his vituperative sneering rather than withdraw from it. Contempt is not persuasive, it is abusive, and it doesnt engender reasonable doubt! A more neutral tone might help his arguments. They are weak arguments, but his delivery undermines them further.

John Prior’s habit of being a condescending schmuck to sympathetic state witnesses doesn’t seem like a smart move for a defense attorney. If I were on the jury he would disgust me which wouldn’t help his client. It would make me think he’s trying to make me discredit the witness because he doesn’t have any other defense of their testimony.

To see Chad manipulate his children… have his lawyer include in their subpoena to not watch any of the trail in order to reassure the children testify without knowing any facts or truths. Then have his children testify to a storyline he and his lawyer have laid out for the trial, knowing the children would be committing perjury. And today, with Garth’s co-worker revealing the horrible situation Garth has been put in since coming home from work that night… just, a complete lack or care of anyone other than himself (Chad). The whole case is sad, and unbelievable.

Go back and watch time stamp 3:03. It’s the moment the State calls Mackay as a witness. Upon hearing the name, Chad shakes his head, drops his shoulders and leans on his elbow. It’s a subtle gesture of defeat. He knows what Mackay is about to testify to.

Prior's obsession with racoons is only overmatched by his obsession with "proving" LE was rude and insensitive to the Daybell "kids" by not informing them of the exhumation. There was an active investigation at the time. Those children could have been complicit in the death. And even if LE were not considerate of the Daybell children's feelings -- so what? Two dead and butchered children were still found in Chad's backyard. The autopsy results on their mother still came back as homicide. I honestly cannot see what point Prior is trying to make. None of his b.s. about Gibb or the 7 racoon gatherers or possible insensitivity to feelings changes one thing --- Chad led a cult and conspired to have 3 people killed.

I think nearly 2 months of Prior screaming "dug her up!" at the jury is more disrespectful than investigating a death without informing people who could have been complicit.

The state and LE can't take matters into their own hands. (Sorry I feel strongly about this. They periphery people can face consequences of their actions but not by being treated poorly. No wonder Garth was so quiet and his mannerisms were noticed as reserved! He was forced by his father to stick with the story that Chad found her and called Garth for help! He found her the 911 call he sounded confused he said he found his mother on the ground frozen and proceeds to say I don’t know then monster man takes the phone all those hours before Garth knew his mother was gone! As far as Emma she clearly held her mother in low esteem and impeached herself with a lying testimony with outstanding rebuttal witness testimony caught on video her own words!

Poor Tammy. Poor, poor Tammy. It occured to me today that although Emma is pretty awful, her reality must be absolutely horrific right now. Her mum is dead, and somewhere inside her she knows her dad killed her mother. Accepting that is too much for her to bear so she's clinging to delusion. Thing is, if she was totally sure her father hadn't killed her mother, she wouldn't have lied. She knows, and she can't cope.

That's what the Daybell children are doing. Emma carries out her NEED to believe an untruth to keep going. That's how its done.

I honestly believe he knows Chad has a very poor chance of being acquitted and is deliberately setting this up for appeal or even mistrial. It won’t work if that’s the case. Had to be on the replay crew for today's testimony. I know Prior didn't have much to work with, BUT, his "witnesses" for the defense seemed to have LITTLE to NO importance/impact for Chad. I would even venture to guess that these defense witnesses HELPED the STATE MUCH more than the Defense. Maybe I missed something?? Regardless, it seems as if we are closer than ever to getting a GUILTY VERDICT!!! I CAN NOT WAIT!!! It really is a shame that the Law Enforcement Officer can't defend his good name and call Joe out as the liar that he is! But I completely understand the ruling of Judge Boyce.😢 #JUSTICE4

And not just any children, the children of your father’s new wife! It’s not as if Emma grew up in that home, she grew up in Springville, Utah. The Daybell’s had bought this property in 2015, just 4 years before Tammy was murdered. It’s NOT her childhood home. Creepy as could be!

If i had a doller for every time complete strangers have told me stuff-stuff that i would consider deeply personal-out of the blue, id buy everybody here a round of "chud is over party" drinks. An example off the top of my head-lady telling me about how her and her husband were both diagnosed with different cancers, going through different types of treatment, how the disease and treatment affected their libidos differently, and how that was affecting their sex life. I swear to god thats the absolute truth; the interaction was a few months ago. People be sayin shit. When theyre going through difficult things especially... Anything can come out any time.

Just want to comment on expert witnesses. The reason the experts came from out of state for the defense, is it is almost impossible to get an expert to go against his colleagues. It is an unspoken agreement amongst experts within a judicial area. I worked trial litigation for over 20 years in the 7th Judicial District in Idaho. Finding expert witnesses was a huge endeavor in medical and personal injury litigation.

Sounds like Garth didn't know what to do after finding his mom and went to bed waiting for his Dad to come back, and his dad came back around 6 am and tried to put Tammy back in bed and dropped her and called Garth for help to put her back in bed.

Impeaching Emma's testimony. She said under oath that she declined to get the autopsy results because police wanted to question her, and her attorney told her not to speak to them. The recording proved that she lied. The officer told her two or three times in ten minutes that they just wanted to review the autopsy results with her, and had no intention of questioning her. That's why it is important.

I think he wants to show why the children didn’t trust the police to cooperate in the investigation. Detectives have told me they prefer to do death notifications with suspected homicides instead of the hospital, because the family is most likely to answer questions at that time.

If Chad and Garth were colluding, they wouldn't need to make up a story about Tammy falling out of the bed; they could have just put Tammy in the bed. Chad was making up the story to his son. That is the story he told his son because his son found her on the floor.

I am having a hard time believing that Tylee was stabbed to death primarily because there would be screaming. I know that’s gruesome to say, but she would be screaming loudly and they are too worried “what the neighbors think” to do that near others. I am going to assume she was murdered away from the property and then “disposed” of on the property. But I don’t think she was killed there. At least not if the method was stabbing. She would have likely been killed in Alex’s car or in a remote location and then taken to chads property. If she was asphyxiated which seems to be their go to method, then they could have killed her closer to other people without sound. I think she likely died by asphyxiation and then stabbed after death to “reassure” the demons leaving the body. I think these people are too wimpy to chance killing her by stabbing and daring getting caught doing it.

Not a lawyer, but I googled hearsay + impeachment. It appears that a statement is not hearsay if offered to impeach a testifying witness. McKay's testimony was used in the rebuttal case to impeach Garth, so it is admissible as far as I can tell. But I am also hoping LYK covers this so we can get qualified legal analysis and more context from someone who actually knows this based on training and experience and not Google searches!! 😂

@@punkypower8138 Correct. It is not hearsay, because the statement is not being offered to prove the truth of the matter asserted, but to impeach a previous witness. In other words, Mackay was not testifying to prove that Garth found Tammy's body. He was testifying that Garth made a statement to him re Tammy's death that contradicts what Garth testified to in court. Some hearsay statements can be admitted because of an exception to the hearsay rule (statements of a co-conspirator, for example). Other statements that seem to be hearsay, are admissible because they are by definition, not hearsay. "Hearsay" is not just something someone else said, in the way that non-lawyers use the word; it has a very specific definition in the rules of evidence.

If anything it harmed his case further. Seeing the information laid out by the defense experts made the death and destruction of Tylee Ryan so much more brutal. The jury will see this most likely. I was at work while listening to this livestream today, and it just hurt my heart 💔 to hear of how that dear young lady’s body was maimed.

Well, her body COULD have been burned elsewhere, it COULD have been burned whole... which opens up a gruesome image of how she got all the strike marks on her bones. It's suppose to raise reasonable doubt...I think he missed the mark.
