Update: The lawsuit was dismissed because she and city came to an agreement. The city "ended its practice of unconstitutionally forcing homeowners to upgrade city streets as a condition of obtaining a building permit." Meaning she won to do renovations without paying that ridiculous permit.

Actually that has always been the law, it is only since the 1920s that the Government took over maintenance of roads. Now, toll roads were used in the 1800s to provide better roads based on the tolls, but those were limited to roads that could be profitable as toll roads, otherwise the adjacent land owner had to maintain the road (Most did not, thus the poor conditions of most US roads pre 1930). In fact most non center cities municipalities were formed when locals got together and incorporated so they can pave the local streets and use taxes to do so, but even then these local government never took over the legal duty to maintain those roads.

How would that change anything? If she moves forward with renovations/additions without a permit, then she's doubly screwed if the city catches her. At this point, the city will be keeping an eye on her property to see if she is doing anything without a permit. Guaranteed.

I thought the normal way was for the community to hold a vote to issue bonds for road improvements. I have never heard of residential properties being responsible for their own improvements. Usually businesses have to make improvements, because they disturb or increase the traffic flow and stress on the current environment. In the video, there is a fairly recent business in the background and there is no clear indication it made road improvements.

Can you imagine in portland oregon they want you to get a permit to fix a sidewalk. Most of us do it without a permit. I have seen fools that get the permit and they make them tear it out and do it over again. sometimes tear out and do over 2 times.

Turns out this was just the way that the city didn’t have to deal with their own streets. To get any form of home renovation permit you had to agree to repair the street in front of your house. It’s since been changed because of the lawsuit but we don’t know how much she got in the settlement nor do we know anything else about it because God forbid there actually be precedent.

I agree, but the moment that project is started or completed, the city will step in, condemn the construction, probably tear down the whole house, and take the property away from the owner. City governments are notoriously petty, and not at all likely to be charitable to homeowners who don’t get permits.

She's leaving CA this month with her daughter because all the chem trails has made her daughter very ill. And it has affected her health as well as thousands of others in the area. It is very scary some of the things she uncovers. There is a vein of evil in this land that is meant to destroy as many humans as possible. The City governments are so corrupt. I know because I worked for the city. They were so evil you could smell the stench. That includes the cops, town hall, the mayor and local papers and news media. Sounds like the local government blew their budget on a fancy new town hall, then doesn't have the money to do anything they should be doing. I can't imagine sticking an individual homeowner with the bill for road improvements. Like others have said, I'd figure out how to get the addition below $50K, and plan on another improvement later for the rest. But first, I'd try to find out if the town had designs on my property such as to condemn it for somebody's pet project.

Go over the head of the highway Dept. by bringing your case to your local media station, your state congressman, and if that guy is in an elected position, make sure everyone knows his despicable plans. If a business strains the normal operation of a road, then the business, such as Walmart, should pay for upgrades. I don't see where what you are requesting strains the operation of that road in front of your house.

As a commercial and multi-family General Contractor I see this all the time. Cities and towns extort my clients by forcing them to improve or update streets, greenways, etc. in order to receive the approved permits. I once built an ADA compliant $20,000 greenway entrance ramp to nowhere. Literally dead ended into woods, but my client had to have it done or the city wouldn't approve their $1mil office remodel. The town or city probably doesn't have the funding, so they extort any homeowner or developer to make the improvements. I could maybe understand if a new neighborhood was being developed with millions in investment being put into new lots with an expected increase in traffic for that neighborhood. To try to extort people for any improvements over $50k is terribly excessive.

its not what the contractor is charging, it is what the city is valuating the renovations at. for (bad) example, if i do all the work myself, and renovate my kitchen, it only costs me $3,000, but the city decides that by doing that it increases the value by 15,000 .....

When I see stories like this, I'm soooo glad that my house is not in city limits. A few years ago, I did a major addition (> $50,000) and the contractor didn't have to report it to anybody.

Some Americans and asians wanted to build mini las vegas here in my country.. mayor wanted them to pay for some roads and even new school, so they just walked away.. and we lost huge investment that would be very very beneficial for locals (good paying jobs) and country as a whole (big taxes)..

Many years ago in Central-ish California so!e dear friends were going to give us two acres to build, of their several hundred, a home. They had planned on building on the front of their ranch and cut a driveway to the top of a hill, a lovely spot. Well...I did my due diligence and found that to move a single pebble and just put up a mailbox, before we even started any construction plan submission, anything, it would be $10,000 in permits and studies(bribes), essentially half what the land was worth. We live in Ohio now. I put up a barn, with an apartment upstairs, on my property and the permit was $135 I think. Done and dusted.

I've assisted a lot of our California clients relocate here to Texas for the same reasons. One asked me how he would go about putting up a fence around part of the rear of his new facility. I said call a contractor or we can punch it out in an afternoon. He was dumbfounded that his permitting fees were a few dollars (flagging the underground lines) and it was done in a day. All for less than the cost of just the permits back home. And no bribes to the city council or a multi month wait. He currently employs about 300 people and is still growing.

@@jackwyatt1218 In my client's case the permit included flagging off underground lines. The person gaining the benefit paid for the service. Who should pay for the service? The taxpayers? Maybe raise taxes on everyone so business can get the service for free?

Yes but I think that’s technically what the city wants. Also I think she wants to stay there because of memory purposes. That is where her and her husband lived and died. There’s a lot of memories of her husband. It seems like it would be a shame if she had to move and give all of that up.

Dajuan Washington no it can’t. Local governments are responsive to local problems, but larger projects need coordination on a larger scale. People say less government but they actually mean less interference where it isn’t warranted. With which I agree completely. And not all people with brains are freaks, unless of course you’ve never met any where you hang out.

My township took 2 acres of road from me which is a private drive because kids above me were having a hard time walking to the bus stop . Not disabled kids . I always had the drive plowed by 6 AM on snow events . After the judge stole my property the township never got out to plow till the kids were in school !

When I sold my house in Massachusetts, I was slapped with a $4300 fee to upgrade the electrical wiring to code, after living there with no problem for 20 years. The excuse was that no insurance company would insure it but we had our house insured for 20 years! Sounds like a kickback scheme to me.

lol well don't think your property would fall under different standards, that's for the people on the City counsel and their friends. This is a PRIME example of why people need to get INVOLVED in their local government. If people are unwilling to serve then they should be showing up to ALL city business like Counsel meetings, school board meetings, zoning meetings etc. The Founding Fathers warned US that we would have to be VIGILANT to keep our Liberties and Freedoms from being taken by government. Sadly American's have become apathetic and lazy. Our Children and Grandchild are not going to have the Liberty or Freedoms the previous generations have had. Really really sad.

99% of the reason I got out of HVAC and Electrical contracting: every County had different 'rules' : every municipality had different 'rules': although it was supposed to be by certain established Universal code books............no wonder there are so many 'jerry-riggers' , 'bootleggers', and 'side jobbers'. They hurt the licensed people but, one gets what they pay for. Thanks IFJ for helping destitute people.

It’s a crying shame I have to be so sneaky just to improve my property. This woman could’ve replaced/enclosed/improved what was already there a little at a time and possibly gotten away with it. @@js4187 I actually agree with your opening remark, hell I do not even bother with insurance. I can say though my neighbor did some renovation and saved himself some money by declaring the renovated space as a garage, but what he did was create a separate living space so he could rent out the main house and live in the new space. Works just fine except he found out that because the space was not permitted properly insurance will not cover it. Wouldn't bother me, but he is stressed all out by it.

Don't pay your property taxes and they will steal your home right away from you. So ya, you don't really own it. Should we even get into, how my property taxes can be the same as my neighbors, and a big part of that goes to schools. Yet I have zero kids and they have a bunch. How is that even fair?

It is normally there to pay for an inspector who will validate it is built to code. It is not supposed to be used for this kind of extortion.

I assume that's rhetorical? Most areas in the U.S. are zoned. That's to protect everyone who lives there and buys in. If the zone is for single family homes, you can't expand your property to be an apartment building or night club, or you'd piss of your neighbors, just as they would piss you off. Same reason you can't build over a certain height, follow certain setbacks, follow code (lest you burn down the entire neighborhood), etc. If you want to be free of all government regulation, you could find a more lawless country I suppose.

You're still technically supposed to get permits to do the work. And the house may some day be yours, but the land will never be. You stop paying your taxes, the land is gone.

This town is unlike any other town in America. 90% of the houses were built in 1942-1944. This is where the nuclear part of the bombs were made. The homes were manufactured back east and delivered to a lot with a set of plans. Connect wall A to wall B and so on and so on. Neighbors helped neighbors put up their own homes. Most homes didnt have roofs for the first year or two. Just a canvas over the tops of them. In this case. She lives in a home thats called a prefab. The city won't give her permission (Permit) to do the remodel. If she does it herself without a permit. They will seek legal recourse to have the work removed. If it means tearing down the house they will. You cant put a child's pool in your yard with more than 1 3/4 inches of water without a permit. Can't paint your home or repair a fence or put in a shrub without a permit.

Currently in Algona Iowa. I was planning on building a new house on residential property that has been vacant since the 40’s yes 80 years. City ordered me to put roads, sewer, gutter, lights and all the same as this lady. The kicker is that there are public utilities available within 200 feet of the build site and I plan on buying the whole entire area and put a single family home. But City wants me to develop it and I do not, it has been undeveloped for 80 years already.
