If you go through all of the emails in the unsealed files, you will see that Elaine is honestly as shady as AH. It is honestly scary. Ben Chew even mentions in one of the motions that he was "warned by others" in their profession about her (basically unethical) behaviors and tactics. She is known to lie, twist things, and play the victim professionally as much as AH does personally. I truly believe Elaine's willingness to be shady is why AH has kept her. There is a big difference in defending and deceiving. She plays on the wrong side of the ethical court.

In my experience (as a dog litigator) clients hire people who look like them. We do complex civil litigation, and the most unethical companies usually hire lead counsel similar to them, who then fills the team with other attorneys like him or her.

The amount of saturation on the photos is crazy. Some things may appear clear but that’s only coz the pics have been so highly saturated & darkened. U can see the face, the background looking so badly highlighted & edited with different colouring. How this got through in the uk is amazing. Still no bruises anywhere just bad skin.

FYI, "DD" is disk dump, actually usually in lower characters dd. It allows a disk to be copied right down to the lowest level of raw sector data. "checkra1n" (it's a '1' here) is to jailbreak a mobile device. Jailbreaking means giving root access to a device so everything can be read with full permissions. A hash is a checksum that would change if any differences are made to a file, so they're asking if the copied image or files had the same checksums as the originals.

This reminds me of the Wagatha Christie case in the UK where the forensic expert 'accidentally lost' the passwords they used to encrypt the phone data dumps, making them useless. When the person who owned the phone was told this, they then 'accidentally dropped their original phone into the North Sea off the side of a ferry'. The judge didn't exactly believe those stories and made it very clear in the ruling. 😂

For anyone wondering what “imaging” is, here is a very simply explanation to the best of my ability: It’s when you take a device and snapshot everything that is on it, as it was (or at a specific time) and copy it on to another device to keep the original intact while grabbing what is essentially a copy. These aren’t just them taking a few images. They’re taking what is essentially the whole phone and putting it on to a hard drive and then browsing through all those files. Due to how they work these images can be pulled from records kept by the companies so even if you delete the texts you can still pull them up. What’s more, because when you delete a file- you don’t actually destroy the data- you just change a flag that surrounds the data to “open for rewriting” you can actually go through those old deleted items and piece them back together using special digital forensic tools. This is why when you “reset” your computer it asks you if you would like to spend extra time securing and erasing the data, because you’re essentially having the computer create junk files to replace all those deleted files so even if you use forensic tools it is less likely to be able to be pieced back together, and why it is recommended you do this process 2 or so times. Which can take **hours** depending on the size. Hope this helps.

I hear them say they provided the images alot but there is a big difference, between an image and the data of an image. Heard side wasn't giving up the digital info for most of these photos I believe to understand.

Deuters said the text was doctored because he says there are no dates. He said in 2016 he was "willing to testify" but she never deposed or called him to testify, which is odd. He did submit a statement in the UK and in Australia.

Stephen Dieters gave an interview with TMZ on June 3rd discounting much of his texts with Amber were heavely doctored. He also stated that he never knew if any acts of abuse to Amber. Also claimed he would testify to the lack of violence from Johnny. Stating that Johnny has never been violent toward anyone .

I worked on forensic software. For those curious, the first step is to make an image of the device. This isn't copying files, but making a bit-accurate copy of the storage media. The forensic software will then analyze the image and create a list of all files AND of deleted and hidden data. With most devices, this can be done in a day. What takes time is going through tens of thousands of files and possible files. One complication is software/hardware which encrypts everything on the storage media. iPhones do this.

I get what he's saying. I studied philosophy as a major and took an Ethics of Law class. My perspective seemed quite different than a lot of the pre-law students. They would always say the defendant was innocent/guilty. Whereas I said FOUND innocent/guilty. Yes, evidence and levels of certainty but ultimately there is A truth as to what happened and juries CAN be wrong. That doesn't mean I think we should toss the system out but... I get what he's saying. If he KNOWS he is innocent, nothing is going to change that. No more than you could convince him that grass is purple. No number of people looking at it from the outside could convince him otherwise. And he knew and accepted that going in- that for as much as he is certain of his innocence, he might not be able to convince a jury. But he still felt he needed to try.

The thing is Ambers team keep using old version of software to extract data from her phone and laptop, also they were handing data to Johnnys team in unusual ways the format were all old versions, Ambers team were pretty much were trying make the data harder to look into. Usually hackers will do these types tricks when they are trying to manipulate data or confusion in data, so I can see why Johnnys team want to do this. I can tell ambers data extraction has been definitely been cooked. I don’t know if your going to get the docs that explains why his experts refused some of the extraction data from ambers experts, they mentioned it was tampered with by purposely using old version of software when data from her phone and laptop, also they were handing data to Johnnys team in unusual ways Ambers team were pretty much were trying to kill Johnnys expert team by using unfit software that takes longer to confirm the legitimate results.

Stephen Deuters DID testify in the UK trial!!! And he said, under oath, that he "never saw Depp use violence against Heard, and would 'absolutely not' stand by and allow it to happen!" Stephen Deuters has been vocal about AH being the abuser, a sociopath, and manipulator. So those texts were either planned, or she was demanding that he tell Johnny he kicked her (IF and that's a big IF, it happened, it was probably accidental and she was just wanting to make JD feel like sh!t about it), and like you said, he was just appeasing her. Of course they don't want that testimony said in court. The text, without context, sounds much better for them. I can hear Elaine now.... "but your honor!!! Please!!! I can't let him testify that he never saw Johnny be physical with Amber or that he has seen Amber hit him.... no way! But come on, your honor, look at this text! It's GOLD!! Stephen has said those text were doctored. Which would explain why they couldn't find them on his phone when the forensic exam of it was done. He adamantly denies ever saying that or texting it.

@@Ashley__Rose I would assume it was court ruled. If AH would have brought up the text (like she did Kate Moss), THEN JD could have called him in as a rebuttal witness. But since they "weren't allowed" to use the texts, JD couldn't use his testimony to refute it. That's my best guess, but I'm honestly not sure.

It most likely would not have been possible because this was a civil trial, not criminal. Companies can be very protective of their data, it would not surprise me if the phone company fought it & won.

The thing is Ambers team keep using old version of software to extract data from her phone and laptop, also they were handing data to Johnnys team in unusual ways the format were all old versions, Ambers team were pretty much were trying make the data harder to look into. Usually hackers will do these types tricks when they are trying to manipulate data or confusion in data, for example confusion in data Ambers expert sent Johnnys expert the EXIF data for some pictures indicate they were taken in the 1970s and 1980s, even though EXIF data was not invented until mid 90s. So it sounds like they went out of their way to find a back door to manipulate the data, there were so many widely confusing errors in EXIF just didn’t make sense at all, on top of many things they would send them extracted data and than they wouldn’t provide them the password to the drive. so I can see why Johnnys team want to do this. I can tell ambers data extraction has been definitely been cooked. I don’t know if your going to get the docs that explains why his experts refused some of the extraction data from ambers experts, they mentioned it was tampered with by purposely using old version of software to extract phone and laptop, Ambers expert team were killing Johnnys expert time, using unfit software that takes longer to confirm the legitimate results. Sorry English is not my language, but just looking at the way they are extracting datas smells fishy, and can easily lead to rabbit hole.

Part of the replay crew today. I’ll be listening on my long commute home. Thank you for making this community a place of thoughtful discussion, and leaving politics and such at the door. Such a breath of fresh air compared to a lot of social platforms. It’s so frustrating and disheartening how many people engage in othering each other because of differing views. At the end of the day, we’re all in this human experience together. At our core, most of us have the same basic needs and wants. The law nerd community gives me hope for humanity.

There’s one thing I learned from Law and Lumber recently- When Judges put on the robes, they are essentially getting in to character. They are becoming the personification of justice. The robe blocks much of her, and in her elevated place above the court, her position is a literal and physical reminder of what she is. She is, by and large, roleplaying, except a lot more complicated. She is shedding her own beliefs and insights and fully dedicating herself to becoming this unbiased individual to the best of her ability. That is, at least what judges are supposed to be doing- and many do. Sadly we all know some have since, especialy in the SCOTUS are abandoning this dereliction of duty.

As heard in the audio from Australia where JJudge is saying we will tell her and agree to anything just to get her on the plane and away from Johnny.

Dueters text that says he kicked her has EXACT same time stamp as the previous text he sent, down to the second. That is not possible, it would be at least be a few seconds after to get it wrote out and sent! And they do not match up with stephens phone records like depps team said.

I could be wrong but I was watching Brian from incredibly average and he was on Jaxs you tube page called Movie Myths and Monsters and Dueters was at the UK trial and gave evidence about being on the plane. He said something along the lines of his text was to just appease her as she was Always making something out to be something it was not and was making a drama. Depp told him just to say whatever to keep her from having a drama and that They were ALL on the Plane and she was berating Depp the whole flight and that the kick as she describes it was not what happened. he says he now realises he was being set up. they go into better detail on there. worth a look.

No wonder Dennison was so eager to grab copies of Everything Hughes was USING as Post-its to Refresh her Memory while being questioned by Elaine!!! What are the odds Curry was up all night going thru those copies of Hughes' work product she tried to hide in her little briefcase she had with her while testifying? I bet Curry had to go over all of this with Dennison before he cross-examined Hughes the Next Day. Unbelievable....Yes Elaine's team was up to no good with all her paid experts! How many times have they pulled this same crap with other defendants? I would try to reopen my case if I had faced Elaine in any court prior. They should be granted. Thank God Depp had the money to pay attorneys & experts to keep fighting Elaine on this trickery!!

@Emily D Baker: re when you’re reading Stephen Deuters text - earlier in the podcast we learned that this text was never handed over to JD’s team in the same way that other electronic evidence. You also mentioned that Stephen Deuter’s phone was searched and there wasn’t any trace of this text on his phone. I think that’s what @The Real Laura B was trying to tell you.

Wait. In the actual response to the motion, Elaine said "Once the Order was issued, counsel for Ms. Heard provided the inventory list that was ordered, and on November 19 began suggesting..." which very much so implies that by November 19, the inventory list had actually been provided. BUT in her email to Camille on November 19, Elaine said that AH's team expected to provide the inventory list "early next week" - ie. had not provided it yet. Just. ELAINE. People can see the fucking dates. Surely if everything else you're saying is correct, then why would you need to misrepresent the dates?

While I personally don't think people should go to jail for many drug related offenses, you must respect the laws of the country your are visiting. It's "unacceptable" to assume a person's home country's laws should be the only ones abided by. She pled guilty. This is the consequence. The us govt needs to stay in their lane here.

I'm sorry but I think this is a crazy take. Respecting the laws of other countries is one thing but that doesn't make the punishment any less ridiculous. I'm not an expert at all but if I'm not mistaken there are pretty sexist/homophobic laws in Saudi Arabia for example and I wouldn't say that it being "law" automatically makes it righteous and respect worthy. Steven Deuters most likely placated her. His declaration about the airplane kicking story and the fact his main bodyguard says to placate her or he placated her in Australia on tape makes me think that. They wanted to minimize the chance of her abusing him in any way. Johnny is the type who avoids.

@@nikit0r in Deuters deposition he said they did have a fight or more her yelling at him and at one point he tapped her shoe in a playful way. The way I read it or took it, it was like a child after getting yelled at by their mum they try in some way checking the temperature(as in are we good again or if I do sth cute or funny she won‘t be angry anymore). He could not have kicked her from his sitting position but to her this tapping was disrespectful and became a kick in the back. If you read the depo and then the texts from May 2016 right before the TRO you can see she has a pattern. She does sth yet she starts texting all sorts of ppl saying JD did sth. This fits to the recording saying she has texts to her family/friends cooperating her stories(it‘s the one audio were she says „and then the plan is to put makeup on and take pics of the bruises).

The only reason she continually defied court orders to turn over her devices is because nothing the court would do could be WORSE than the fallout of the information contained on said devices becoming public. i.e. she had some shady, shady shit on there that would have blown her narrative to undeniable smitherines.

27:14 If I recall correctly, Stephen Deuters was set to testify, but was excluded when his wife, Gina (?), was excused from court because of Eve Barlowe's little stunt. Of course we don't know for sure, but he was supposed to testify for Johnny and word had it that he was going to debunk the kick on the plane thing.

Deuters has made multiple statements to media outlets in the last few years that these texts were heavily altered from their original form. That's why they were different format, etc; there were clues such as the repetition of "appalled" and so on, and if you compare them to other texts attributed to him, the wording and structure are wildly different.

FYI ALL: The text between Stephen D. And AH specifically about "he feels awful" about what he did etc. That DID come in!!! I clearly remember watching that during the trial LIVE. Not all of it came in but that part, in particular, was discussed in court in VA.

They didn’t call him because a text that came out from Deuters used in the UK trial was: “Sociopathic show pony. Machiavellian overlord. Talentless c-t,” Deuters wrote in one message about Heard in 2016 after she and Depp split, the court was told.” Deuters did not like AH per various texts messages he sent to others not just Depp.

What get me with people doing illegal things in other countries......the amount of media attention, politicians getting involved and the amount of money that goes into it and we still have homeless people, homeless veterans, not enough done to support our returning troops that have fought for our country. Really makes me sick.

Having seen the Deuters texts, I found something rather interesting. There were two text messages allegedly from Stephen Deuters that came in at the exact same time, right down to the second. One of them is the one that kicking is mentioned. But if you read the entire conversation, it doesn’t flow. Something isn’t right. It looks like it was injected somehow.

Why would they specifically decide to use outdated of Cellebrite, in my opinion they clearly knew it’s not supported for updates by the manufacturer, and it gives them back door to manipulate datas. For example , Ambers expert sent Johnnys expert the EXIF data for some pictures indicate they were taken in the 1970s and 1980s, even though EXIF data was not invented until mid 90s. So it sounds like they went out of their way to find a back door to manipulate the data, there were so many widely confusing errors in EXIF just didn’t make sense at all, on top of many things they would send them extracted data and than they wouldn’t provide them the password to the drive.

Britney Griner: Unfortunate circumstances. Unfortunate timing. I feel for her. However, I believe she has to take some responsibility for the predicament. She's been playing off-season for a Russian league since 2014 (Wikipedia). After so many years of living and playing there, she didn't know that cannabis was illegal there? And, that the penalties were harsh? It was her responsibility to educated herself on the Russian legal system and the consequences involving cannabis. Was she relying on a doctor's note? Not much of an education system that teaches very little about the world beyond the borders of the USA. Note: She was detained several weeks before the invasion of Ukraine and became a convenient pawn after sanctions.

(As a russian) The problem with authoritarian countries is that EVERYTHING is allowed when you're at a certain level (of wealth-power, as they mean the same here). You won't even get a slap on the wrist. You'd be free and even encouraged. Some people don't realize that that's the way authoritarian regimes get the blackmail on you, so they can use you if they need. She made a mistake and was unlucky.

She was detained on 2/17/22, a week before the invasion. Tensions were already rising by that point. Maybe a convenient pawn, but the arrest predates the sanctions.

i wonder if her being gay was a factor in her arrest as well. not necessarily on the reason for her arrested, but if that gave them extra incentive. Russia is a bad place for LGBT right now

@@seeglines why? You’ve never made a mistake before? Yes, it’s a huge mistake but it’s also something that is physically small and in your daily life not a huge deal. For it to be in her luggage unintentionally isn’t really that far fetched. And she’s made it very clear she takes responsibility for what she did.

I may be wrong but it’s my understanding when Stephen Deuters was deposed he denied knowing anything about these text messages and he they couldn’t find them in his iCloud account anywhere. There is an email somewhere from Depps team about it.

LOL! As you were reading the motions/excuses regarding the metadata & devices, you shouted “My cat unplugged my internet” and I though you were making fun of AH’s team, as in that was another one of their excuses for failing to turn over devices. As in “my dog ate my homework”, Your Honor!

Amber’s team didn’t call Stephen D to testify about the text messages because he said they were doctored. If called upon to testify he would say that that conversation with Amber didn’t include the reference to the kicking episode.
