The DA is running Parliament via its captured judiciary system. They create laws as they see fit and law of precedence is ignored or reworked for DA.

Proceeding without opposition representation may lead to: 1. Legitimacy challenges: Decisions made without diverse perspectives may face scrutiny. 2. Legal challenges: Opposition parties may seek court intervention, arguing the JSC's actions are unconstitutional. 3. If experience is anything to go by, the interviews will continue regardless. The Courts and the Executive have shown time and again that they do only what's in the best interests of a certain neo-liberal narrative. They have no regard for legal and political fairness.

Wat I notice is that the constitution is the main act regulating many things in SA and through that the lives of the SA citizens. The constitution has been held as the best constitution in the world, except when parties by the likes of MK or people like the followers of Jacob Zuma, MK, Julius Malema, EFF, ANC factions as well as the leaders of those parties or factions within the ANC do not want to be regulated by the constitution, they fall back to the ANC's Human Rights manifest. So according to them then, the constitution is a document not applicable to them and must be scrapped, but when it suits their purposes the constitution is the correct document to be followed. In other words, SA is currently led by a bunch of hypocritical people that jumps from left to right whenever it sujts them, and they are followed by a huge number of mindlrss people following them as long as they can get a piece of the pie that is South Affica. Furthermore, this skewed and biased mindset is tgen further misused and exacerbated by the media through misleading interviewers and media houses like NEWZROOM AFRIKA.

That's what you seem to don't understand. The constitution is not only enforced against those you disagree with (like the parties you listed), but applies to everyone, including the DA, FFPlus, Afriforum, etc. This means everyone must follow all the parts of the constitution and do not get the right to choose which parts to follow. This means even land appropriation that must be returned to the rightful owners must be followed regardless how anyone feels about it. It also means the JSC cannot proceed as soon as Hlophe makes his resignation official. It also means the DA are not allowed to run a parallel government through the judiciary or army or any other organ of state.

The bottom line is any ground for John Hlophe's exclusion from the JSC is, having due regard to logic based on current law, wholly unjustifiable. To say the opposite is tantamount to picking one's common sense pocket.

I sometimes think that these 'experts' are extremely unhelpful. The law is clear on this matter; parliament's decidions must be rational for them to be lawful. The principle of legality is an integral part of the rule of law enshrined in section 1(c) of the Constitution.

The problem with giving the judiciary an allowance to override separation of powers based on rationality, is that every decision made by parliament can be obstructed indefinitely based on the sole political aspirations of any judge in the country. If parliament runs to the constitutional court to defeat the case, the judge can then obstruct the implementation phase of the decision. This is an extreme case scenario but it is just to emphasize the danger of giving an organ of state to overpower the country. I wouldn't be surprised if there is some law out there that allows the military the legal powers to perform a coup if the think the elected government is not acting rationally in their opinion.

No, it's not. His appeal must still be heard. People must stop developing opinions based on dislike propagated by biased media. They must develop their opinions based on facts and the law with regard to the appeal process.

The law and constitution clearly states that people have a right to appeal and sometimes they win. Furthermore,there are no laws in the constitution that prevent him from sitting on the JSC. None at all. This is a fight for power and influence by the DA and during these interviews, appointments in the Western Cape where,Hlophe was the head and ruffled many privileged feathers due to his fight to make the judiciary representative,will be made.
