A common political strategy for regulations. Is instead of lobbying to prevent regulation, those companies have proposals/legislation written which is significantly harsher and more aggressive, to kill their up and coming competitors ability to continue. Never forget that systems like this aren't generally the product of stupidity, but the result of malfeasant actors intentionally making them as bad as possible. It is also worth nothing that the neoliberal ideology as applied to government since Reagan, is to run government like a business, and pinch every penny, and require layers, upon layers of "accounting" in triplicate, bonded, sealed, assured, and held for a "reasonable" amount of time. For the purposes of ensuring that the most money is acquired, and least monies paid out. -It turns out that running government like business, is insufferable and insane for literally everybody involved. The notion of ease of use is actually anathema to the notion of business. Businesses engage in extreme levels of accounting to ensure they maximize profits, and minimize liabilities. When government does this, Lois, and millions of others across the nation find themselves in bureaucratic hell. The BS idea that government as a business was sold by the same people who espouse smaller government. Define IRONY.

New Yorker here. Based on the DOL phone lines, they aren't giving up on your call at 1pm. They're giving up at 9am when they open. I've spent days trying to talk to a human at the DOL who hangs up on you after 2 minutes of irrelevant phone try nonsense. I think their "phone center" consists entirely of one person who only answers the phone when they're bored. The "higher call volume than normal" is utter horse****; it's a standard call volume; they just removed all of the people who could answer the phones.
@pyrioncelendil

Or it's a standard call volume but everyone who's made it past their mandatory probation period have figured out that they're government employees paid a fixed salary regardless of however many calls they take, so they can just leave their phones off the hook and let the poor sap who just got hired and is still on probation take all the calls, and to the automated system it looks like high call volume because it just says that when there are no lines available to take the call immediately.

Also, if things are addressed to just the PO box number, with names omitted, then it would have been delivered and not returned. Like others are saying, I definitely believe that you should start some sort of Kickstarter so that you can get assistance on funding a lawyer. Every donation counts and I do believe that justice needs to be served (or at least attempted) one way or another. Worst case scenario going this Kickstarter route, you have the general support of your subscribers who will cheer you on and the subscribers who are able to, and genuinely want to, help make the cost of lawyering up into your life savings just a little bit less brutal.

When asking people, I'd refrain from mentioning consequences (e.g. my business was denied loans because of an incorrect business address). It's so easy to say "I don't know" and then you'll never hear the real answer. There is so much more you could be doing with your life, I recognize this. Thank you for taking the time to shout out the good fella in Albany. It's rare us phone people get to feel human. They pay me crazy good money to take the abuse in the leadership role, so I'm usually the first supervisor to volunteer to hop on a 'kudos call'. I love this arc for you. There's a lot of possibility here. The best thing is you're starting to draw a map about how things work, structures they're operating under and behavior demonstrated. Keep notes, keep times, etc. When you get to the root cause you have a few options: 1. Enforcement - ombudsmen can help, if they don't .. go deeper with them 2. You'll get the corrupt/negligence people rooted out - this is a first layer fix.. but corruption is probably deeper 3. Document - this humiliates higher level government types more than the party at fault. But journalists can help you later, doing this later helps the government cover it up. Keeping the journalists honest is easy, you're doing video documentation now. 4. If you do find the root cause, get leadership documentation at the time. When pulling the trigger on exposing it.. it's easy for them to wipe that under the table. Make it so their leaders at the time are documented. 5. If this went to court, I would suggest writing to the judge and talking about your case. This will hurt that orgs ability to make claims against businesses. Considering: You may be dealing with a conspiracy here, they're an organization that protects their own. So lying and mispractice may be involved. A lawsuit will probably only be very effective once you get to the negligent party. All of this prework is just research $$$ that would be burned up in legal fees, their research may be higher quality, but it may only result to the easiest person to blame due to time. Additionally this would be dependent upon demonstrating damages. [For things that you were prevented from doing (maliciously), and you're recuperating suggested outcomes] Talk to Devan/LegalEagle he might be able to explain that better.

You should consider doing a collab with other youtubers who are investigators and lawyers. They may want to take your case as a video project to weigh if a lawsuit could lead anywhere?

The way Louis talks to people on the phone is something else. Being so nice to people really makes them want to help him and you can hear that they are smiling. I hate the fact that hearing these conversations feels wierd and the fact that its not the norm in the world

My concern is if they screwed you over like this with blatant disregard, how many countless others have they screwed over? If they are allowed to continue to do this to others, how many other small businesses will be destroyed due to their negligence (or more likely malice)?

Three hopes: I hope you get this resolved quickly, I hope you convince one huge company from locating to NY, and I hope NY finds out that YOU influenced a huge company from moving to NY. That sir would be sweet justice indeed.

" huge company" would have the license holding in a low state tax "either-way", regardless where the fancy offices are. Note that the "real money" is made with "real stuff" like brand licenses and IP - not silly things like costumers. MacDonalds for e.g. is a real estate company and youtube is a money burner. If you believe that McDonalds sells burgers or that youtube generates ad revenue, that you have not looked at their business model.

@@sarowie thats why the only reason i go to mcdonalds is because they are open at 12am lol. else its always better to go to your local burger joint. its cheaper AND better because they are in the buisness of getting repeat customers. mcdonalds is just a holding company for land so cheap as can be while maximizing profits on the land before reselling it.

I always try just hitting 0 to break out of the IVR phone response. They usually have a method of dealing with people that don't have phones that work with IVR or don't understand the prompts. If you start the call it starts the options with 1. just keep pressing 0 until it starts to ring on a phone somewhere. Why not communicate them via letter. Much more admissable in court. Ask them what their complaints process is and how that works and start an offical complant. You're basically asking the checkout staff how the beef was made.

I can try to explain most of the items, as I've seen these things happen often. When forming an entity in NY, you are assigned a temporary number called a TF number automatically by the state. They do not know automatically your Tax ID which is issued by the IRS. They then send a letter to the address used when forming the entity asking you to call the state and provide the EIN/Tax ID to them so they can apply the EIN to the TF number and the TF number / entity goes away as they now have the Tax ID and uses this to track the filings going forward. However, if you don't call them and provide the EIN (which many people do as they don't think its important), the TF number stays in the system. You then later on start filing tax returns using the actual EIN, not the TF number so the NYS creates a new profile with the Tax ID. However, the TF number is still there. So now after a year of not filing a tax return for the TF number entity, they send a letter asking for the tax return. However, the TF number never had your actual address that you used to file tax returns, since you filed using your Tax ID number. Now how they got the wrong mailing address, is most likely coming from the company who created your entity mistakenly entered the wrong PO Box number or they responded to the NYS letter updating the address using the wrong PO Box. The NYS usually only asks for the first tax return and if you don't respond they just ignore it, but assume an estimated tax amount of 1,000 and start charging interest and penalties. Usually this is resolved quickly since once a tax return is filed, and they connect the TF with the Tax ID, the old balance is closed. However in your situation, the TF number was kept on file and the interest and penalties kept growing. Maybe this clarifies things.

Basically what was told to him in the previous calls on his videos... Not the part of the company setting up your business number.. That needs more searching. Maybe it isn't completely NYCs fault.

Don't spend the money on it unless you think you can win and get reimbursed, see what sort of court fees you'd be looking at. Also see if winning the lawsuit will pay for the lawsuit. i feel like you have enough proof to win in a way that matters.
