Copyright laws needs to reformed bug time. The big companies are clearly misusing the laws to shut down those who talk about alternatives and criticism of their products, policies etc.

Its not a problem with the law, the problem is that KZitem automatically sides with the big corpos, if you were to hire lawyers you would eventually win but in most cases its not worth it.

The world's is." He explains it really well and in detail But basically, if KZitem doesn't side with the corporations they become liable for actual copyright breaches So it's safer for them to just not get involved

@@TS-qr3rk Again, I heavily recommend the aforementioned Tom Scott video He explains the subject really well But KZitem CAN'T do anything If they do and make a mistake, they are liable But there is a law that says "if you just allow corporations to take content down, you won't be liable as long as you don't interfere" and so that is what KZitem HAS to do KZitem legally CAN'T interfere in the process or else it will fall on them Even if they want to do something, they can't Tho Even if you were right and KZitem could do something OP would still be right Since a reform on copyright laws could make it so KZitem (and other platforms) have to side with content creators and stop corporations from just taking videos down like that It's "innocent until proven guilty" after all So it should be the corporations' responsibility to prove a non fair use breach of copyright instead of the creators proving fair use (tho, the big corporations have lawyers so things wouldn't change)

@@FanTheDeckyeah that's a lot more worrisome than people think it is too. Because unfortunately there is a significantly more burden of proof on proving innocence. It's also a lot harder to get a judge to even hear a case. In fact, a judge has to approve the lawsuit before it even starts. The bright side is that they do not take precedence into account. So regardless of the outcome it will not do anything for or against other cases

@@DracossaintWhat's worse is that it's about patent infringement on game mechanics. It's an absurd idea, and I have no clue how any legal system would allow it. One of the patents that Nintendo were allowed to file was also filed months after Palworld came out, and they're still suing over it.

I got a video taken down featuring EmuDeck a couple of years ago... with no showing of downloading roms or anything piracy related. I appealed it and Google/YT still said nope, it violates guidelines. Meanwhile every other channel makes multiple EmuDeck videos. In a way, I'm glad it happened to large channels to finally talk about this problem to a larger audience.

(Gamefly still exists) But lets be clear there are shady practices the companies pull as well. As an example, Pokemon bank. You can not collect all pokemon in a version these days without a pokemon bank account. The fact they split the versions of pokemon with no further incentive beyond this version has x pokemon and this version has y pokemon. My point being, these companies pull shady crap too. Inversely, movie and TV piracy is back on the rise with the partitioning of content across many different paid services, regressively restricting access. When you ease access to content, and make it available at a reasonable price, people buy it. When you're like Nintendo and keep your first party games near MSRP for nearly a decade, the people who can't comfortably afford $50-60 games aren't going to patiently wait for a sale that will never come, they're just going to pirate.

Veritasium handles sponsors very well. He simply says "This video is sponsored by Some Company. More on them at the *end* of the video." And then it's at the end of the video. It's so brief, that it's not even worth trying to skip because the beginning disclaimer will likely be over before you reach your keyboard to hit your right arrow. Technicals and Internet Historian also do what Wulff does and make REALLY funny sponsor skits that feel like extensions to their videos. However, this still isn't as good as Veritasium because most people still will realized "no matter how dressed up this is, you are still trying to sell me something and that's bad no matter how funny".

The only problem I have with grey area tech is how flagrant many people are about using it for piracy. This is being a "heat score" and just attracts the attention of companies who are legally obligated to defend their copyrights. For example, making updates to your emulator so that it can play a leaked copy of a Zelda game a month before it was set to release is a major heat score. One youtuber did a video about how the dumper could ruin used games by getting people inadvertently banned if Nintendo sees two copies of a game with the same UUID on different accounts. He was shocked when several people in his comments said that buying, dumping and returning games was exactly what they planned to do. I want grey area tech to continue because we need things like open source replacements for Mario Kart servers that have since gone offline or ways to play Dreamcast games after the laser has died on our consoles.

From my point of view as someone who stopped buying Nintendo consoles and games some time ago now. Their constant bullying and weirdly selective what can and can’t be shown that changes all the time, all their medling in tournaments and just about everything really makes it very easy for me to write them off as a company I don’t want to support. I am just one person at the end of the day but I am doing my part to show that there is a consumer breaking point where the brands toxicity outweigh whatever quality their product might have.

I think Nintendo acted fast to prevent the dumper becoming too popular. Now LTT on the other hand is so popular already that people often blindly take words of Linus and his crew for granted. So the damage is done on Google's side, Nintendo however does well fighting their issue. The Mig Flash and dumper being hard to obtain doesn't help.

Eh, it's not like it's a big secret. You only need 3 words in any search engine, and you'll find one of the most used extensions for the job. Plus dozens of other sites and extensions. It's funny that the one I use is also featured by Google on the Chrome store.

I don't think "downloading" in an "unauthorized" manner exists. Just to watch the video YT has to stream it to my computer... they are already storing the video in MY ram... Old media and abandonware (things that are no longer made and sold by the companies that produced them like consoles or old games) can not be considered piracy from a logical perspective because it is not impacting their finances, emulation is about art preservation the DMCA laws must be remade because companies like the big (N) or maybe we might vote with our wallets to make them understand that we don't like what they are doing.

All the cable TV DVRs we've had have had the ability to record any TV content you wanted to the device. As more advanced TV services came out, multiple simultaneous recordings were a big selling point. Of course, they make it difficult to take those recordings off device to keep or watch on something else, but it's still a thing (in Europe at least).

The last thing anyone should consider is whether something will draw the ire of a corporation. Corporations don't make the law. Something is either legal or it is not. What corporations do, though, is take advantage of their infinitely deeper pockets to manipulate the law to their own ends. The only way to combat that is for individual consumers to vote with their wallets. The ire of a corporation can only be countered by the ire of the consumer en masse. Anything else perpetuates the ever increasing stanglehold corporations have over every aspect of our lives. They will back down if they think it's in their economic advantage to do so. Make it more costly to fight game backups than they lose to piracy and they will find a way to embrace and faciliate game backups. We've seen this before.

This is a natural outcome. Small businesses need their customers to survive, corporations like this make it so customers need them or think they need them to survive. They can do anything because most people will just do anything to keep giving them their money and data. The current cultural and political climate will not allow for anything different, and people have been addled to consumerism so as not to even know how to take action, let alone have the guts to take it.

The other issue with many games now is there's no way to backup your save files. If a game doesn't allow for cloud saves and something happens to your Switch, your save is gone. Tools like the Mig Switch allow you to back up those saves to your computer.

Corparations are a higher issue than countries themselves. They have more power and no regulations than countries because countries are scared of making something. If European Union, where I live, makes a law on something, companies will continue their things elsewhere in the world. That's why I fear that even our countries are weaker than corporations. If we fine them, they'll continue their business because it's just a low price compared to what they can have in one month. For example, if they have 10 trillion and the fine is 15 million USD, it's like they lost 1.5 cents if I had 10 thousand USD on my account, it's nothing. They are just higher than countries, and if we fight them, it would be a potential financial loss. That's the geopolitical side of the thing. If even countries can't do that much, we as consumers are just tiny electrons in the grand scheme of things and nobody could help you.

I mean "piracy" is a legal term with a very clear definition. It, like fair use, determined by a court not Internet opinions. Saying something is "clearly fair use" only makes sense if a court has determined as much. It remind me of a convo I had with someone was talking about EDP445 being guilty. "by that definition, EDP445 is innocent" and I replied "Well yeah, that is what not being charge of a crime means" we might not like it but is true.

Skipping sponsors is not piracy. I do agree that ad blocking is. Ad blocking prevents the ad from running completely and has zero chance of payment occurring. Sponsor segments are usually already paid for already in someway.

Well, corpos have been blocking us from copying and replaying our own games for years! I refuse to pay for YTP simply due to Google's entire use of ads. They already make money by selling my data without consent, I refuse to give them MORE money so that they can make more money off of me. Copyright laws are insanely outdated, and were always designed to screw people and empower massive corporations to bully the little guy. When music copyrights went through in the 70's, artists were wildly outspoken about it, but still corporations forced it through because their corrupt laws benefited them. Nintendo loves hiding behind the fact that Japan doesn't have fair use laws, but that only extends to Japan, internationally they should be losing that power, but everybody is terrified to fight them due to their insane financial portfolio. It's why I'm never buying another Nintendo product as long as I live, even though I LOVE pokemon and the old Zelda games

I for one now know about the MIG dumper and want one. Not even really because I want to backup my games, but because Nintendo doesn't want me to have one. As for KZitem. I pay for Premium because my family uses KZitem Music. That said, I still use add blockers especially on devices I don't bother to log into youtube with. It's not as easy to get away, but slowly I find viable alternatives.

Even though we love the products from certain companies, once we buy them, they’re ours. The transaction is complete, and we can use the product freely. Otherwise, it would be more like renting, similar to the new sales structures where you pay a monthly fee for product use. Plus, big company conglomerates often keep their users tied to their systems, making them dependent. This way, they can easily shape behavior if users step outside the boundaries set by the company.

I skipped over Linus' video because there were other videos on my subscription page that I chose to watch over his, and it was taken down before I got to watch it, and TBH I didn't even realize it. BUT after his "apology" video showed up, I clicked on it and watched, and THEN I remembered skipping over it and it just not ever showing up again.... BUT like you said, his video was right there in my suggestions, but from someone else, so I watched it. AND I learned some things... some very useful things :)- THANKS LINUS AND RANDOM RE-UPLOADER!!!!!!!!!!! The problem is emulation is and isn't piracy. IF you are backing up for yourself it isn't. So making a copy of a game for yourself is completely fine. But making a copy and loading it up for others to access then puts it into the the realm of piracy. Total Biscuit talked about this before and mentioned how it was in a legal grey area due to a lot of these being in a legal grey area. This isnt just an issue with software, but also other media. Add in that companies are now doing remasters, re-releases (not just video games) it raises even more questions. This is something, honestly, that you should bring in a lawyer that specializes in copyright to talk about. I think on reddit the videogame attorney once went into depth about this and explained it quite well. Its kind of the same thing about people claiming to understand fair use, when the vast majority of you don't. Its a legal defense to make you look more sympathetic in court. The rule of thumb is less is more, and I can see Nintendo's legal argument about talking about the copying. I have no skin in the Nintendo game and can claim they are quite bad at what they do legally. Honestly the dude should challenge them legally. As for ad blocking, even the CIA and FBI have recommended that we use them to protect ourselves from bad operators online that would use that to gain access to our systems. The problem isn't service, its just straight up greed. You have sites that are 70%+ ads. Then there are the ones that have pop-us, do the hold your browser hostage. Hell even KZitem has ads that run before, after, and during the videos. Then add in the fact creators have to add in damn sponsorship ads on top of all that . I don't believe any creator that claims they do sponsorships they believe in. Plenty of people have shown the stuff required for reads, etc. involved in these. So to a segment of us, it just shows you are only interested in money you get from it. If you believed in something, you would just say check this out without needing compensation. These baked in sponsorship reads compounded ontop of the self promotion of creator merch, etc. is too much, but not one creator stops to go oh, well is this going too far. Plus you got the ones who shill without even doing any disclosure that their getting paid. Even worse is now that KZitem wants to run ads the second you pause a video. So there goes, stopping the video to read something. So honestly I put the content creators as part of the problem with their own greed in wanting to make more money as part of the service issue. If you werent monitized on ads, then sure sponsorship I can underestand. But trying to milk as much money out of us as you can is pure scum behavior. and makes you just as bad as the corperations you bitch about

There's also a gray area for abandonware. Take the Alien vs. Predator arcade game for instance, it was a bad ass beat em up made by CAPCOM that apparently, can't be brought back because of all the trademark ownerships it has behind, added to it being not so popular. So the only way you can experience this game, as far as I know, is via emulation.

Some More News also does a great job with sponsors. Not only is he funny, he also pretty openly hates the ads hes reading off, acting more like a hostage than an advirtisor. The AG1 ads in his videos are amazing, not for the ads themselves but rather because I'm always wondering how extreme the ads can get before they finally drop him 🤣

The issue is that, by stating in the ToS that you don't OWN the software, you're only indefinitely licensing it for an unspecificied time until they decide you will no longer use that software. They want to monopolize and gatekeep. Nintendo is famous for this. Linus, and I can only extrapolate given his historical position, COULD be very tentatively poking the bear in an attempt to start the war to change the outdated boomer legislation of the 1980s and corporate monopolization.

I have youtube premium and if there was a better way to tip every creator I'd do it instead (sorry I'm not patreoning 50 creators for a dollar or 2, there's just too many) but man I'd like to leave their infrastructure

I think YT Premium is more than enough. If you want to tip your absolute favorite creators from there, that's a bonus. Ik what you mean about 50 creators for a dollar or two. That adds up super quick. You can also do a Super Thanks in videos. I always think that's locked behind livestreams but you can just do it on normal videos.

The premium has gone up and it will continue to go up I was a premium user for so long but honestly $20 dollars (after taxes) for no ads and to be able to have your screen off when listening to music is crazy. Having your screen off is such a lazy attempt at a justification for the price.

first of all people should realize all social media corporations has their own agenda and serve for a specific ideology or purpose. they are not free speech platforms. if you play the game with their rules everythink works fine. but if you cross their benefits or ideology you get banned no matter you told the truth or you are rigth. its that simple.

KZitem is basically a monopoly and I think that's the real problem. When I was a kid I used to visit many different video sites like MyVideo, Clipfish, Dailymotion, but ultimately they all either disappeared or became so underused you just can't get any of the content you like there

I love KZitem premium! The ad-free part is great, but I also like the bundled music service. I mix and match corporations so that Google and Microsoft don't own all of my data. Maybe that just means that more corporations can now dig into my data...

There are no Fair Use laws in Japan. Nintendo can come after you if you put a few seconds of Mario if they want. They mostly choose not to, as it is a bad look, but they can and have done it.

Ad-blockers don't even work on youtube anymore, even the built-in Brave ad & tracking shield. Now i'm getting ads from some shady people on yachts trying to sell me some courses on how to get rich quick. We all know this is bs. I'm moving over to rumble more and more, but not all content creators are there yet. Been Degooglifying for a while now.

This expands far beyond gaming, into every aspect of our lives. The people and businesses with great wealth hold the reins of power, and their goals are to obtain more wealth and power. We pay the price for their ambitions through our wallets and by surrendering an increasing number of our rights as consumers and citizens. I'd advocate for a particular political solution, but there aren't any. Realistically, there aren't any solutions outside of self-sufficiency -- a way of life that modern society cannot revert to.

Big corporations are just taking advantage of an old system. Figures, what can be done in a country where bribing is legal through the name of lobbing? What worries me more is the fact that new generation of gamers are coming and they don´t know any better and think nintendo is right or is the victim, and this is how it happens, until this is the new default, where people like us that helped create emulators or were part of the translation scene, will be vilanized. Yet THEY use the emulators we made.

IMO this is just another step towards 'big brother' saying what we can and can't do. Corporations need limitations, they can't control and dictate our lives. If they want us to buy their games, they need to make it easy and not cost an arm and a leg. It has to be consumer friendly. We should own the things we pay for, not have "keys and licenses" for the very same things we once physically owned and held in our own hands. I love when classic games are suddenly available on modern platforms, I immediately bought Turok once it was released on Steam. There are countless others. The suits handling the 'business' side of gaming is what will kill the industry if it's not addressed.

As I say everytime this happens, people need to stop blaming youtubes copyright system and blame copyright law KZitem knows how bad the system is, they would love to change it, but can't without getting sued into oblivion As for youtube taking down Linus video? That one I'm indifferent on, youtube holds the right to remove anything they want from their platform, it's their platform, their rules, rules they can enforce however loosely they want, freedom of speech applies to public places, and youtube being run by a private company isn't public space, public space applies to anything operated by the government and funded by tax payer dollars, and freedom of speech should stay like this, otherwise someone could be screaming the most vile things in a Walmart and legally, couldn't be kicked out

Nintendo is a horrible company towards customers. They price their console and older games as if they were top tier and their games are below average on quality - see latest Pokémon games as example - they restrict a lot of content and the worst part for me is how the reviewers and “game journalist” eat from their hand.
