The bank isn’t responsible because it’s the couple’s account and they knew it wasn’t their money to spend in the first place. They were ridiculous to believe they would not be held responsible to pay it back. They owe it plus the fees. Those facts are in that book they give you, when you open your account and periodically update and notify customers of. Stupidity is not a legitimate legal defense.

My husband and I once had over $3 million mistakenly deposited into our bank account. Although we were very poor and could have used more money to pay for necessities (certainly not luxuries) we didn’t touch a dime and simply waited for the mistake to be corrected, which it soon was. Adults certainly know right from wrong. We knew the money wasn’t ours. And we have no regrets choosing right.

@time2132 No it isn't. You are under no legal bind to keep any money that's accidentally deposited into your account. It's unfortunate, but that's just how it works. Knowingly spending money that you know isn't yours could potentially get you into legal trouble even though it was the banks fault. There is literally no instanse where someone was allowed to keep an accidental deposit... just look it up for yourself. The court would rule in the banks favor and you would have to pay it back one way or another.

I was saving money for 8 months and my income tax and never looking at receipt, then I received a letter stating I had 10 thou, I contacted the bank 5 times and went in person and they claim is mine, so I spent it then the letter came that I owe the bank money... I owe nothing I verified 5 times and went in person , that took a month and they still said is mine so is mine this happened 20 years ago and I took it to court. I paid nothing back. I had proof.

Yes that is reasonable, but that isn't the case of the couple. They knew it wasn't theirs, and to make sure they wouldn't have to give it back they spent it fast and avoided contact w/the bank. It sounds like you made a reasonable effort, which is probably why you were able to keep the money. It is like w/ stolen property and being caught w/ it. If some guy is selling brand new Apple computers that retail 5K for $50 the idea is a person knows they are stolen.

It’s quite sad that so many people feel the couple didn’t do anything wrong just because the bank stuffed up. You don’t forget that you have an extra $120k in your account. They knew that money wasn’t theirs. Yet they chose to spend it instead of contacting the bank about the error. They’re thieves, plain and simple. Legally wrong and morally wrong. And “the bank” is a teller or someone who probably made a typo when depositing or transferring that money. Being dishonest just makes things worse for the person who made the mistake. And if that money is not recoverable, the FDIC has to cover it. Fraud increases insurance premiums and fees for innocent people. It’s not a victimless crime.

I had someone steal $500 from my account to put it on someone’s prison commissary, and USAA refunded the money immediately while I was on the phone with them. They do a bunch of nice stuff that other banks give you crap about. But I don’t think a rando couple should get a windfall for no reason just because banks are a-holes.

So, the fact that "banks are nasty" justifies irresponsible behavior? What evidence do we have on hand to prove that BB&T is universally evil to all its customers? The wise and noble thing to do would be to report the discrepancy. Now they're in huge debt and will have to scramble to sell all the stuff they bought, which would not have happened if they would have done the right thing. This couple is just as devious as the so-called banks everyone here lambasts, but yet they still keep their money in them. P.S. the teller likely lost their job over this error.

The folks that work in the branches do not benefit from the fees, etc. that the higher-ups decide to impose. But they sure as hell pay the price when they screw up. Personally, I think people that spend money that they know isn’t theirs should face criminal charges. It wasn’t just an honest mistake. $100 discrepancy could be an honest mistake; $100,000 is definitely not!

If the beneficiary is entitled to the money and did not know it was accidentally wired, they can keep it. Revlon lenders said they believed Citibank was wiring prepayments for a loan. After all, the money accidentally wired was the exact amount "to the penny" Citibank owed them, although the loan wasn't set to mature for quite some time.

@Luminosity OGz Actually, in order for something to be considered a theft, you have to have taken someone else's property from their own property. The fact that the money was not taken by the defendant but actually placed in their account by the bank itself excludes any felony theft. The only thing that can happen is since it lies with the fault of the bank and the fact that the money was spent by the defendant would be restoration of said funds.

That's why they weren't charged for felony theft because they're allowed to pay the money back. To further explain this, look at the law. When a thief steals from someone, they are charged for the theft and not allowed to pay it back until after they are charged and that's only sometimes if they feel the thief has no records of theft prior. Listen to yourself! Clearly you know nothing.

There was a dude, once, who had something like this happen. He withdrew the money and put it in a safe deposit box. He DIDN'T SPEND A PENNY. But, he got a lawyer, and the bank had to negotiate with him to get it back. He didn't have to give it to them. This probably varies, state to state, but it seems like his was the smarter way to go about this.

Same scenario happened to a friend of mines. Was only 20k but nevertheless, he asked me what I would do. Well, I told him to consider it a loan that he would have to eventually pay back. He paid all of his Bill's and paid his car off. Now he has a structured payment of $50 dollars a week for 5 yrs. Mind you his car-payment alone was over $400 a month

These newsmen are a disgrace. I don't go shopping on money I didn't earn. They knew it was not their money and they didn't care. What is wrong with this generation. Has honesty gone out the window? Hope you have learned a lesson.

It happened to me once years ago. $1,000,056.00 showed up in my account one day, but they immediately locked me out. Still, I can say I was a millionaire for a couple of days!

Nope, because more than likely, that money would be tied to some criminal activity and the intended recipient of that money may not hesitate to use violence to recover that money.

There are procedures. You call the police and report it found. If no one claims it after 30 days then it's LEGALLY yours.

When this happened to me I was a newly divorced mother of three. It was a ridiculous amount of money. I swear I almost had a heart attack. I called the bank, and they took care of it. No problems. But it made me so depressed. That was brand new home money😮

I worked for banks and we alway's had these mistakes but see the bank files for errors and omissions claims and gets that money back regardless. So the money they want you to give back they will actually keep and wipe alway. These banks do this all the time. I quit working for banks back in my 90s. Retired now but one time we had 1 million and we didn't know where it came from so we have to send it off to lost and found where only the federal keeps the money. So sad true story

This happened to my sister. She woke up to 6k and she called the bank and they thanked her because, they were supposed to deposit that into someone else’s 😭

This is why people shouldn’t win the lottery either. They can, but they really shouldn’t. Most people don’t know what to do with themselves when they experience a windfall and end up worse off in the end. Hard work and saving will make people more cautious before being so care free.

I've heard of other instances of things like this happening and when the people contact the bank to report the mistake, the bank insists that everything is correct. Personally, I think if you DO report it and the bank tells you that it's not a mistake, you should be legally allowed to keep the money.

Hmmm. 7-10 days deposits are settled transactions. After that, I would think the bank has to file proper production to negotiate a settlement. Just grabbing it back after so long doesn't sound like legal banking procedure.
