They're not quite telling them what food they can sell, they're telling them where they can open a business. And they're doing that because that is the literal purpose of zoning. This property was zoned residential and not commercial. So in order to open a business, that type of business would already have to be codified to be allowed in a residential area, or the business would need to request a zoning variance. They can outright say no to granting that variance, in which case you cannot open the business there at all, or they can place conditions on the grant. In this case, they had an agreement to grant that variance with the provision that only certain types of restaurant would be allowed (which included sandwich).

@@ozzyjames87 That is certainly something that can be lobbied for in your neighborhood, but the overwhelming majority of people do NOT want zoning to go away entirely. Yes, it's great to say a grocery store being close to home is a good thing. But is it just as true to say a chemical plant being close to home is a good thing? Or a loud factory or foundry? I certainly agree that residential zoning should allow for some classifications of business, and that sentiment is likely where the original agreement in this story came from, which allowed for things like sandwich shops to open. There is a whole spectrum between hard-line zoning, and "you own the property, there are no restrictions on what you can do with it", and at some point there will need to be some sort of consensus on where the line is drawn on that spectrum.

@@mykeride that is an excellent explanation. I agree that some businesses should be allowed in residential neighborhood like convenience stores, restaurants, or even ice cream parlors. But the business that should be somewhat away from residential neighborhoods such as chemicals plants (who knows what the health effects were if there was a massive leakage), oil pumps, slaughter houses, or any other business that might lower the homes property values.

Back in 2006 a judge in Massachusetts ruled that tacos were not sandwiches, now we have a judge in Indiana ruling that they are sandwiches. Only the Supreme Court can settle this now.

@@Veretax in the Massachusetts case it was more defining what a sandwich is and noting that tacos and burritos did not meet that definition. Qdoba wanted to open a new location, Panera had a contract that would block other sandwich shops from opening there, and Panera claimed that Qdoba sold sandwiches. Judge decided that Qdoba's food did not qualify as "sandwiches" so Panera couldn't block them.

A burger is any type of cooked ground meat, or meat substitute, FORMED INTO A PATTY and placed between two pieces of bread. A sandwich is ANY other type of food, including sliced meat, or no meat, placed between two pieces of bread. Both burgers and sandwiches, unlike open face "sandwiches", that aren't really sandwiches, are meant to be eaten by hand. Since tortillas can be considered bread, and tacos do not contain a ground meat patty, a taco IS a sandwich.

All fruits are vegetables, but all vegetables are not fruits. All fruits/fruiting bodies are made up of vegetative material, so are considered to be vegetables. But a piece of celery or lettuce does not contain any fruiting bodies, so are just considered to be vegetables. I recall my city council dealing with a family home/business that existed before any zoning. The issue was allowing a house to be used by an employee instead of the owner as the owner’s son was quite settled in a nearby house. Eventually I pointed out that if the house looked like a house from the street the city shouldn’t care. One “fun” are is government wanting to switch between spirit of the law vs letter of the law when it benefits the person in power.

@@javabeanz8549 Eh... sorta. Crisps are wafer thin, Fries are skinny, and Chips are chunky. All made from potato, all fried in some fashion, its just the thickness and shape that varies. Then you have Roast Potatoes and Jacket Potatoes, which are both air cooked, with the difference being if the skin is left on or not (Roasts can optionally be pre-boiled). Lastly, there are Boiled Potatoes which are boiled with or without the skin (potato variety matters here), and the Mashed variant which is without the skin and then smashed. Hopefully that sorts things out!

To be honest, this should have cost taxpayers nearly nothing. The government staff are already hired on salary so it wouldn’t cost the government extra to run this case. The business owner pays court costs which cover the cost of the trial in the court system. Cases like these usually cost very little for the taxpayer

@@dtcdtc8328 No, but they are paid an annual salary, meaning that having 100 cases throughout the year would cost the exact same to taxpayers as having 10,000 cases in that year. The government did not hire anyone new to handle this case. It was all done by current employees. Does a car garage have to spend extra money on labor when you bring your car in for an oil change? No they already have the guys there working 8 hour shifts to do that. Thus it doesn’t cost the garage anything extra for you to bring your car in outside of the oil and filter.

In Ireland Subway sandwiches were classified as a pastry because of the amount of sugar in their bread. The reason it mattered there was that sandwiches were classified as something that was not taxed but pastries were and so Subway had to start collecting this tax making their meals quite a bit more expensive. The court basically said Subway bread falls under the same category as cake.

I absolutely HATE tacos and burritos.. because I HATE cheese, it is the most vile and disgusting "food" I've ever been forced to eat. And it all STINKS. Yes, I can smell it from across the room -- even the fake American cheese. When my wrapped up burger is placed on the counter, I can really tell you if it has or doesn't have the nasty gooey slice of grossness on it. I really can. When I used to eat McDonald's garbage (long ago), and they placed my (as I ordered it) Big Mac without cheese on the tray, many times I could tell them it wasn't mine because it had cheese on it. The package would have the grill sip on it saying "no cheese" and they'd look at me weird and say, "this is without cheese" and I'd open the box or tell them to open it.... and there was the nasty cheese sticking out. I was correct 100% of the time. When I lived in the Midwest, my McD's order was wrong about 98% of the time -- on the first, and sometimes, second try. When I moved out west (Arizona, Nevada, etc), they messed up my order about two times in about 15 years. :) Yes, I truly hate cheese. Except I can eat pizza... (with a regular amount of cheese & without several cheeses), I don't know why, I can't explain it... but if I eat a sandwich with cheese, I'll gag and vomit if it has cheese on it.

Under these conditions in his video, the guy with the shoestring budget cannot even begin because the rich guy got there first and blocked all his competitors. The extremely over regulated atmosphere in some states (Cali,, NY, IL. etc) also make start ups and small business possible for the wealthy but not the little guy with all their fees and ridiculous & restrictive requirements.

Steve, your fictional expert example isn't that far off. An outfit I used to work for had a building in Arlington, VA with one tenants being the National Hot Dog Association. The best thing about them was every year on National Hot Dog Day we got free hot dogs.

In Ireland a court a few years ago ruled the bun for Subway sandwich was cake and not a staple food because it contained about 10% sugar content. This was important because cake is taxed a higher rate then staple foods. Subway was not happy.

If a hot dog is not a sandwich then neither is a hoagie or sub style. They both use a single roll style bread which is cut. The original dish crated by the Earl of Sandwich was meat between two peices of bread so it could be picked up and eaten with one hand while he held a hand of cards in the other. So maybe that should be the defining character 🤔

You want to really blow their minds, tell them this: Fun fact: Crispy tacos are an American invention. Possibly started in Texas, but a guy named Bell, of Taco Bell fame made them popular. Soft tacos were harder to work with so he fried the tortillas. Made them easier to stack the ingredients in. Now, "soft" tacos are much harder to pin down because many cultures around the world use a similar technique to, I guess, eat. Example, you could say a Greek Gyro is a taco. So, did they invent it? It's a bread like substance with meat in it. So, did Mexico steal from Greece? We may never know. (Gasp!) So as usual, whoever goes "Reeeee!" over cultural appropriation is firing on half their cylinders. Which infinitely amuses me.

There was a truck stop in Newton KS that offered a "plated " hamburger. It was a bun, open faced with a double meat patty, and the French fries could be substituted out for mashed potatoes, where the liquid condiments were poured. The pickles, lettuce and tomato were on a separate plate. The drivers loved it, they sold hundreds each day. No one complained. Many drivers and other professional enjoyed a change from what looked like a fast food "pseudomeal" to a "Burger like mom would have made". I think they still do that

This is why places like Italy regulate definitions of food. For instance bread can not have more than 5% sugar in it otherwise it is considered a confectionary. Subway was in trouble for that a few years back.

The Cube Rule of Food Identification defines a sandwich by the location of the starch relative to the other ingredients. A sandwich has starch on the top and bottom but not on the sides. (A hamburger is a sandwich unless it has another piece of bread in the middle, in which case it becomes cake.) A taco has a U-shaped starch configuration (open on the top). Therefore, a taco is a taco, not a sandwich. A hotdog is also a taco, not a sandwich. An open-faced sandwich is toast (a single layer of starch with other ingredients on top).

A hot dog is a sandwich on the basis that it follows the same construction of a taco. Since it has been ruled (at least in illinois) that a taco is a sandwich then a hot dog is one as well. A U or V shaped carbohydrate consisting of either corn or flour holding a protein in the middle of it. Arguing that both hot dogs and tacos are similar in that composition they are indeed both sandwiches.

This is one of those "Scientific designation" vs "culinary designation" things. There is no scientific (or botanical for that matter) vegetable designation. So if you're dealing with "Fruits and vegetables" you're automatically in the culinary realm.
