Exactly. Unless he was using the equipment like a crazy person, swinging it around his head, he wasn't negligent. Or maybe weed whacking in a rock garden. Was the grass neglected until it was so high that it hid the rock? (the rock that wasn't supposed to be there). How would that be his fault? From what I can find online, he did the ethical, moral thing in offering to pay for repair. Nice guy. Since he made that agreement, he had to pay. But legally, he wasn't responsible. It should have been covered by homeowner's insurance. Edit: It's like rocks on the highway. They're called road hazards. If another vehicle hits a rock on the road and kicks it up into your windshield, they're not responsible. No one can be expected to spot pebbles & swerve around them at high speeds. That would be insane. If a rock falls off the back of a dump truck or is thrown by a person, that's a completely different scenario. They're responsible. Random rocks on the ground? Not anyone's fault. Rocks happen lol.

I don't think many people know Judge Milian's father & brothers are construction people & Judge Milian knows as much about building stuff, as she knows about the Law. She is a genius on many subjects. I ABSOLUTELY think she & Judge Mathis are the king & queen of the Courtroom.

Unfortunately one can’t always know that there are rocks hiding under the grass or shrubbery. Having run a mowing crew where we also used weed trimmers, I can tell you that it is common for the trimming line to pick up unseen rocks and sticks and throw them with a great force. We required operators to use face shields for that reason. I know of one incident where a face shield was not being used and the operator had his eyeglasses broken. We had glass mirrors broken on the trucks occasionally because of thrown rocks/sand.

The answer to whether you can be held liable is "it depends." If he were on a riding mower, clearly the answer is no, unless it was an area you could see with the naked eye was inundated with rocks. If they were weed whacking a very overgrown area, again, the answer is no. If they were on the edge of an area inundated with rocks, then the answer is yes.

I am a landscaper and even I say, the guy is responsible. But this is why you carry insurance and if you don't want to include your insurance, pay the bill. 400 for glass seems reasonable. 2400 is not.

I’m glad the judge is a handy man however not everyone is and she needs to stop thinking every lady is as savy in construction as she is. She goes way too hard on women even men about stuff that she’s knows. Construction prices isn’t common knowledge

Harvey is wrong. Whenever anyone does yard work, especially mowing, all loose sticks, branches, stones and miscellaneous objects should be removed from the area. It’s primarily a safety reason. Guess he doesn’t take care of his lawn himself!

The Judge got it exactly right, of course. The problem for the guy is now he has a judgement against him which will be reflected on his credit score for years. In most states the judgement will stay on a credit report for 7 years but some states allow for 10 years. That's going to haunt him for years to come.

How can the plaintiff walk into court and claim they need a whole new door when their own guy says the door can be repaired, and the process just got delayed! I think they started out doing the right thing then decided they just wanted a new door and figured they could get the kid to spring for it.

The Mom is creeping me out. She had to stand up there with him at the end and nod her head in unison. Gross. The guy has a built-in hesitancy because he's so used to Mommy jumping up and knocking obstacles out of his way. I really hate to see these women that are still trying to wipe their kid's ass at age 30. His defeat shows in his posture, and she can't even butt out when the judge lightly tells her to back off. Judge Judy would have tossed her from t he courtroom. Her control freak issues over her son are both sad and disgusting.
