If a woman is unmarried, authority over her affairs lies with her father. That is the man who will accept ruracio. The baby daddy is not his son in law and does not supercede his authority over his own daughter. Luhya men traditionally take their children with them, no coparenting. With other tribes I see the women end up with the children. In both cases whichever parent lives with the children is not answerable to whoever does not.
