I don't know the laws there but here mere possession a weapon while intoxicated is not a crime. Here, it's a crime if: 1. Intoxicated, 2. In the persons hand and loaded, 3. The person is not engaged in legitimate self defense. So even if you are drunk and someone attacks you or someone else , you could defend yourself or defend the victim of the attack. It would be unlawful to be hunting or target shooting while drunk.

You are not allowed to carry a firearm when you are drinking. It is a felony. He should have charged both of them for that and her with the OVI also. Again cops are treated differently than the rest of us.

Melissa Mccarty the night wasn’t over, they both may have been charged or may be charged at a later date which would effectively end their law enforcement careers. I guarantee that this will be pleaded down or the firearms won’t come into play, she’ll get the OVI and hopefully she wasn’t more than twice the limit which would make her “super drunk”. In this day and age of Uber and Lyft, it was hubris that let them think nothing would happen and it’s so easy to avoid.

And I have yet to watch one of these "drunk driver" vids where the cop didn't treat the driver with respect, as long as they were being respectful as well. In my state if you refuse testing you automatically lose your license for one year. Cop or not, she should of gotten it all via tickets. Crossing a line like that, in an intersection like that, with nobody else on the road late at night would be a reason to follow someone to see if they're having trouble controlling their vehicle. If the guy was driving, he'd of gotten both from this guy, no doubt. He didnt slam him solely because he was looking out for her. Didn't want to ruin her night even more by locking up the husband on felony charges. Add to that, if ur not a scumbag, they generally will easily get reduced to a misdemeanor even a summary charge many times.

It doesn't just apply to cops though. Before these cameras, police routinely had a bit of leeway, and could decide to give you a break if he/she felt like it. Now, you are effed if you are pulled over for anything remotely serious. They have no choice anymore.

Agree the officer should have been fired he was ridiculous. I am not going to charge you with having a loaded firearm while drunk and driving, he has respect for them what a bunch of crap. He did not take the gun from the passenger. Protocol is to make sure there are no weapons on the occupants of the car no matter who they are investigating. The officer without body cam would have let her after being found drunk to drive home. He is not qualified to be the dog catcher.

And when they would start going off about something like the prices or us not lending them our phones, we would say things like “our hands our tied it’s company policy for us not to lend you our phone we can get fired” when we in no way ever had any intention of lending the crack head covered in puke dropping rocks everywhere our phones. Really seemed like the arresting officer was trying to get the bad cop off the road with as little arguments as possible.

I've gotten out of many charges, as a civilian, because the cop cut me slack. They do this all the time for ANYONE (if they can) ...I think primarily to keep things peaceful. It leaves you feeling thankful and thankful people are less likely to retaliate. If you're a prick though then, yes, they're gonna throw the book at you. So, if you find you're always getting slammed by the cops, well, be nicer.

In TENN it makes no difference if it's recorded or not it never goes past the LT. on call and dam sure never reaches to court and judge, Last week 9 TENN officers shot and killed a man with a box cutter he never made a move towards them and they never used their tasers or K-9,, It was 15 of them but only 9 did the shooting and they were so bloodthirsty that after a supervisor yelled CEASE FIRE they kept shooting and one bystander said I THOUGHT THE MAD DOGS WHERE GOING TO LICK UP THE BLOOD,

You are exactly right I know it to be a fact, if you know any / have anybody in your family that is one they will either tell you that's why they hate the body cam and because they couldn't do it like they did in the " good ole days " that's the reasons why and they were pissed about it before it even was an order to have them.

that depends. If you live in a police state like the USA, then it doesn't go that way. There IS special treatment for cops, they "serve and protect"... themselves basically. Citizens can just watch and take it

I've gotten out of many charges, as a civilian, because the cop cut me slack. They do this all the time for ANYONE (if they can) ...I think primarily to keep things peaceful. It leaves you feeling thankful and thankful people are less likely to retaliate. If you're a prick though then, yes, they're gonna throw the book at you. So, if you find you're always getting slammed by the cops, well, be nicer.

It's also a very common way of neutralizing the situation. I say that all the time to customers and no cameras are on me. It shifts the burden to the system and protocols and away from the person initiating them. Understand?

I can understand saying it but the way he's acting, it's pretty hard to claim he wouldn't have done it differently if he wouldn't get caught. I was being a bit dramatic about the "that's all we need to know." With everything presented, I would put money on it that no camera = drunk goes home with nothing bad happening.

Expect the FOP to loudly protest any disciplinary action. Because obviously patrol officers should accept the OVI excuse "I just live down the street" and "I'm a police officer if that makes any difference". This is EXACTLY what gives police a bad name. When police fck up they should own it and not think they are above the law, that they think applies only to little people without badges.

Except they DON’T do that to “everyone else”. If the person being arrested can get someone to come pick up the car in a reasonable amount of time they do. My friend got a DUI years back and had someone come get the car. So yes, you are a cop hater

Joe surfer i reserve the title of crooked cop to cops who truly deserve it... this was a human being who made a mistake, cop or not. Hundreds of people make it daily. I firmly believe in harsher punishment for DUI believe me, but it doesn’t mean this cop is “crooked”

Including and especially the Judge's. NO Cop or court should EVER have the authority to take money for anything from a U.S. citizen. Also, the second amendment does NOT give government agents the right to be armed. It give's the people the right to own and carry a weapon at all times.

@@plutotech Thats between him and his boss. Im more concerned with someone's safety than I am judging them. They could have been Police Impersonators and one was sitting in the front seat with a gun with nobody watching him. I missed it if he run the license of either of them? He run the tag when he stopped them but you can change a tag in less than a minute? He was so obsessed with having to arrest a police officer that he threw his personal safety to the wind.

In my opinion, the officer did both the right thing and the wrong thing. He arrested her on the lesser crime, and let her off the bigger crime. The fact that she is a police officer, she should be held accountable for ALL illegal actions and/or bad/wrongful decisions.

Exaggerate much? Wrong. He had plenty of other opportunities to let her go. Could have ignored the odor of alcohol to begin with or just simply said she passed the eye test. He used the cameras as a diversionary excuse to keep the situation from escalating and having the offenders put the blame on him when he is already dealing with a drunk, angry husband with a gun.

That's all it took to talk about his and talk about mine. MIne is bigger than his too! Apparently the law around here only carries 9mm, not a 40 like mine. Same brand. Same size. Just mine is bigger than his where the Mag goes into. PEEWEE!!! Ya know what???He didn't charge me anything other than the 8 over..... And then he like the other one I had with me too. Colt 38 1906 police issue! He really liked that one. I invited him to my home to shoot it when ever he might be out in the WAYYYY OUT area I live in Az.

Jackson Smith thanks and agree. I’ve been in this officers predicament having to arrest a fellow officer. If the law is broken it’s broken no special treatment from me. And before any cop haters reply that I would treat a cop differently than any other citizen... I give people the same respect and treat everyone the way I would like to be treated. I used to have our local high school kids ask specifically for me whenever they got in trouble because unfortunately a few guys I worked with were arrogant and badge heavy towards them. They always asked if I was on duty for me to come detain them and talk with them. I didn’t show favoritism to them but I still respected them as long as they respected me. Truthfully on the most part my job was a lot easier when you’re not in shouting matches or over aggressive to escalate the situation worse or into something which causes me or the person I’m dealing with some sort of harm or even a court issue or civil suit because of it.
