This is the deposition of the defendant general surgeon in a medical malpractice case in Prince George's County. Miller and Zois, LLC filed this wrongful death lawsuit against this surgeon who specializes in weight loss surgery.
The Plaintiff was a woman in her mid-30’s who consulted with this doctor for removal of her gastric band after she developed indigestion. Gastric bands were popular weight loss devices in the early 2000’s but often caused complications, including gastric reflux.
This surgeon attempted to remove the gastric band laparoscopically using a camera placed inside of a tubular device called a trocar. The trocar has a blade at the end of it and it is used to go through the abdominal wall and enter the abdominal cavity, where all of organs are located, including the kidneys, stomach, spleen, and liver. The camera helps the surgeon see the different layers while he is cutting his way into the abdominal cavity.
As you can imagine, knowing where you are during this surgery is critical to preventing injury. While using the trocar, Dr. Amin lost his way. He couldn’t tell where he was in the patient’s body. He then pulled the camera out and put his finger in to feel around. Still not knowing where he was, he put the trocar in the abdominal wall “without the camera” and pressed down. To his surprise, the trocar popped through and hit the patient’s aorta, the main blood vessel in the body.
Just to put this in context: the aorta sits in the back of the abdominal cavity near the spine. In order to reach that location, the surgeon would need to pass all the other organs in the patient’s body. That only happens if you don’t know where you are and you are pressing too hard. As a result of the aortic injury, the Plaintiff nearly bled to death and had to spend weeks in the critical care unit.
Plaintiff tried this week long jury trial against this surgeon and his surgical practice Washington Surgical Specialists, LLC in Prince George’s County, Maryland. After hearing all the evidence, a jury returned a verdict for the Plaintiff in the amount of 1.2 million dollars.
