The actress playing the inquisitor did a great job in this episode. Her reaction at the audacity of these cadets to lie to her face and try to deflect questions is very believable. It really shows how adults perceive children who think they know everything.

I think having Troi sense their emotions and report on whether or not they're lying would be classed as some form of interrogation. It's like using a lie detector on someone; there's certain rules about when and how you can use it. The same kind of principle extends to full Betazoids too; Using their mind reading abilities specifically to extract information for the purposes of trial would be classed as a form of interrogation, and as such would not be allowed in a court room. You could, however, use these techniques in an actual interrogation/interview setting as that's where you would be gathering information and whatnot.

The actor who played both has come out and said that while that was an early concept for Paris, the two characters are polar opposites. Locarno is a suave charmer who puts on a guise of politeness and selflessness while at his core being a morally bankrupt narcissist who will trade his friends' lives for personal glory. Paris is a brilliant kindhearted man who deeply cares about others, but puts on a bad guy facade because the mistakes he made lead him down a bad path and he doesn't see himself as worthy of redemption. Only when forced does either let the mask slip.

"The Fifth Amendment provides protection to individuals from being compelled to incriminate themselves. According to this Constitutional right, individuals have the privilege against self-incrimination." while that is referring to the modern day US Constitution, it is a very safe assumption that they have similar articles and I highly doubt the Federation courts would rule against "thinking about something" being functionally equivalent to forcing someone to answer a question or forcing them to testify, thus using telepathy to interrogate or question someone would be a violation of a fundamental Sapient Right and thus anything picked up by telepathy would be inadmissible as evidence and blurting out "he's lying" or "I sensed him think about when he was murdering them" would result in an immediate mistrial just as much as if a bunch of evidence that was acquired without a warrant were to be presented also "I sensed [x]" would literally be hearsay and thus also inadmissible so to answer your question directly: because they actually respect Sapient Rights and understand the basic idea of "those who surrender liberty for security will have neither" as shown extensively in a different episode involving courts that did, incidentally, include a betazoid, and given the entire premise of that that episode is seems almost as if it were done as a direct answer to your question

Sure, but also, this character is kind of irredeemable. He's a liar and a bully who puts his own career ahead of the truth. He does the right thing at the end, when he has nothing left to gain by letting the others go down, but that's the bare minimum decency. On the other hand, Paris's crime was inspired by higher principles, by wanting to help people who needed it. He rebelled against the institution of Starfleet, but not its spirit.
@yamato6114

@MGower4465

A lot of that is simply because the same actor played both roles, and both got into a lot of legal hot water. I expect there was some cross-pollination when the Paris character was built, but not an outright copy. A critical difference, two, really, was Paris completed the Academy. And Paris's father is a senior Admiral, its improbable lower ranked officers would have risked his ire by drop-kicking his son. Even if Admiral Paris verbally supported the decision. There's also the similar story Paris tells about why he's infamous, he made a mistake resulting in death, and falsified records, only to confess. But Paris, unlike Lacarno, was on active duty, piloting a shuttle and crashed it, killing three other officers who were oassengers on the shuttle. Lacarno was not actually part of the collision himself, and no one in Nova falsified data, just took advantage of incomplete data to lie. And Lacarno did not confess, he took the blame after Crusher confessed. This rumor would never existed if they had used a different actor.
