Divorce in Court - When Rights Are Wrong
with renowned Judge Philip Marcus
In this episode I speak with Judge Philip Marcus about rights vs responsibilities, custody vs care, visitation vs spending time. The terms used in the legal language of divorce are all wrong. Judge Marcus explains how this can negatively affect a parent's attitudes and the well being of their children. We explore the ways to counter the harm to children so they can thrive.
Judge Marcus was born and educated in England. After obtaining his LL.B. (Bachelor of Laws) degree at University College London, and qualifying as a Solicitor, he moved to Jerusalem in 1978. He was admitted as an Advocate at the Israel Bar in 1979 and obtained his Master’s degree in Law (LL.M.) from Haifa University in 2008.
He was appointed a Judge of the Jerusalem Magistrates Court in 1995, and served as a Judge of the Family Court from its opening in 1997 until his retirement in 2012.
Judge Marcus, having built on his background as a judge, lawyer and activist for change, is currently a consultant, a researcher, and a writer and lecturer on Family Law and Family Courts, professional ethics and jurisprudence.
He is a consultant to committees of the Knesset (Israel’s parliament) on all proposed legislation concerning children, the elderly and persons with disabilities.
He is a member of national and international organizations dealing with families in distress and therapeutic jurisprudence, has lectured in many countries on five continents, and is consulted by countries and organizations around the world about Family Court system reform, including, where necessary, proposals for changes in the law.

What I Do
I'm a toenet rabbanit (halachic advocate) who specializes in helping my clients navigate their divorces through the rabbinic court system in Israel. I conduct mediation sessions with the couple together or I represent only one of them in mediation with the other spouse and their personal advocate. In both these scenarios the goal is a comprehensive divorce agreement ensuring that everyone’s rights and interests are protected. When amicable resolution isn't possible, I advocate for my client in the rabbinic courts, through litigation.
Why I Do It
Divorce will always be painful but there is far too much unnecessary suffering going on in the process. After going through my own divorce, I wanted to use my experience to help others stay focused, be true to their goals and not get sucked into the emotional traps of waging a war.
How I Do It
I help you clarify what you really need, and help you stay focused on what is important to you. You need to feel listened to and validated. I create good realistic strategies with lots of support. I also won't let you get carried away into meaningless wars and I won't let you give up so fast. I help you create a balance which reflects your values and your needs.
