Sprint used to show the messages online and at some point they stopped. When I was trying to look at recent ones I called sprint to see why I couldn’t see them and they told me I needed a subpoena to access them. He should have kept the text messages, but in my situation (I save all of mine) my roommate deleted the thread of messages between us because she knew it could be used against her… Just saying that’s how sprint worked before they were bought out.

She never kept tabs on the amount because she never intended on paying him back. Also, why does the Judge keep insisting that there is something romantic going on? Yes, that's mostly the case, but not always. Both parties agreed it was a friendship, nothing more. I think the Defendant definitely used him because he always paid for the alcohol and marijuana. It's not nice, but not enforceable(at the time).

We all need to be our own best advocates to not trust someone simply because they are educated or are a “professional” (by designation: doctor, lawyer, pharmacist…). Always be observant because you might be surprised by what you don’t know.

the plaintiff was her dealer - pure and simple. waayyy back in the day people used to joke about what to do if you were ripped off in a drug sale, and the response would be "well it's not like you can take them to court for it" - apparently that is no longer the case! And with multiple transactions a day - this was not for pot! No way, no how. This is for crack, coke or H. PC is getting some strange cases, just watched one last night where a guy paying for sex from another guy sued him because he wanted more than what he got - now we've got drug dealers suing their customers - this is rich 😂

Here's some ideas: If you can't seem to stop loaning out your money, tell the other person you Need your money returned to you in ONE payment just like the way you loaned it to them & get everything in text/writing (on paper with them signing and a date for repayment) OR learn how to tell other people *"No."* Why? Because the longer you give people time to Re-pay you in *"Payments,"* the more excuses they will come up with why they Can't pay you. I hope he learned something here!!!

She was clearly using him for what she could get out of him & dragging her foot paying him back by pretending to be into him. And sadly, he was trying to buy her affection, but when he wanted to go to another level, she didn’t, so he tried to enforce the tab instead of continuing to allow her delays. She admitted it was a loan, multiple times, and even contradicted herself. Sadly, it was all about marijuana which can’t be enforced. Honestly, all he had to do was say she was lying about what it was for and he might’ve had a better chance. Let this be a lesson. You can’t buy love and affection. Nobody’s right in that circumstance. And certainly should never give anyone THAT kind of money.

They do tell you a subpoena is needed to get your text message recorded. It’s not as simple as pulling it up online unless you’ve subscribed to an enhanced messaging feature, and even then there are limits. I worked for a mobile phone company 16+ years.

Judge made a big mistake saying this was an illegal transaction. The transaction was a loan . Completely legal. What the defendant did with it after is extraneous to the transaction of the loan. Loan someone money, so they don’t have to pay it back because they spent the money on illicit substances ? No. Someone would ask a defendant what they did with the money to verify it was actually loaned . Not to determine that the defendant used it for illegal activities . The defendant knows she still owes the money. She might still pay it back out of friendship, regardless of the judgement. And they might end up in a relationship .

It's NOT illegal and it's the same thing If he had loaned her money for a car and expected it to be paid back. And what really gets me is her reasoning. It's decriminalized, It's a misdemeanor. She clearly stated that even if she wanted to enforce the contract she can’t because she’s a JUDGE. Judges legally cannot enforce a contract that goes against public policy. Weed is decriminalized but you can still receive a ticket for it.
