Mr Gerhard Papenfus, I would like to thank & commend you, on an excellent & clear discussion on some of the wide-ranging ramifications to the proposed EEA Act, specifically, the negative harm that such a Bill would do to our Economy & triggering stagnation in Businesses. -I do believe that you have crystallised the thinking of business entrepreneurs & concerned South Africans, in a few thought-provoking sentences such as: -Our biggest concern is that it (EEA Act) is bringing the question of race right into the debate. It will force employers to make appointments on the basis of the skin colour of a person. Now that is taking us back. -Gerhard Papenfus, CEO of NEASA Any business that elects to appoint somebody on the basis of skin colour is simply not wise. -Gerhard Papenfus, CEO of NEASA -Interviewer: the ANC-COSATU are saying that Business is misinterpreting the EEA Act. What do you have to say? There is no misinterpretation of the EEA Act. The regulations are very clear, for instance: In a particular sector, within 5 years, 50% of your workforce must be black That’s it. There is nothing more that you can read into it. You have to explain to a government official (inspector) why I have decided to appoint “this” person, instead of “that” person. -Gerhard Papenfus, CEO of NEASA -The main thing that we want to explain, and we hope that the Government understands that, is that you cannot interfere in the right of an employer to appoint the person that he wants in that job, whether right or wrong. It is the Business owner, the entrepreneur, is the one who takes the risk. Employers are becoming very hesitant regarding appointing and replacing any Employee due to the current situation and uncertainty. And even in the case where employers can't make their targets, they have a list of justifiable reasons that they can select to ensure they remain complaint. These scare tactics, are just to rile up support against anything the govt does to try to redress the effects of past laws.

However, please look at it from my perspective, as an Indian Business owner who is trying to grow his business and create jobs. If my business grows BIGGER than 50 staff members, then I am BANNED from hiring an Indian or Coloured (because the quota is 0.01%); If my business ALREADY has 10 Indians, I have to FIRE them or retrench them because I am then BREAKING the law. So where is the LOGIC in job creation? I love this country, but I don’t like these new discriminatory laws. A human being should be hired based on MERIT (called Meritocracy) irrespective of race, gender, religion, or ethnicity. We all know that the brain of a person is not found in the skin. Please re-read the quotes from the above interview, and my comments that follows, thank you, stay well: The economy is not growing. Now, if the government says that I want x% of this skin colour in that job: my question is: How are you going to get there? The economy is not growing. Do we now have to retrench somebody to get there (to meet quotas)? Remember, that every person that you retrench, will be challenged (in labour law court), so who will pick up that bill? If you have 50 staff, then if you hire 1 Indian or Coloured, you will receive a hefty fine, because 1 out of 50 is 2%, whereas the target is 0.01%. This means, that if a business has 1000 staff, they can only hire ONE Indian or Coloured - they are BANNED -If I (as an Indian), have worked hard from a young age, I have put my families money in the business, I have worked night and day and sacrificed my health, and now when I reach the target of “more than 50 employees” it means that I have to get rid of my wife and my son who have joined me in the business because 3 out of 50 breaks the law. It also means, that when I die, I cannot give my business to my 3 sons, because 3 Indians out of 50 (or 100 staff) is BREAKING the law -The EEA Act is severely discriminatory to the Business entrepreneurs and Captains of Industry. Business has been reticent to hiring black South African as a passive aggressive strategy to undermine the new political dispensation. What they should be bemoaning is the fact that we still need employment equity for the hiring of black South Africans in a country where they’re an overwhelming majority. This notion that hiring a black person is less about competence and more about the color of their skin is rooted in racism in and of itself.

Reticent? That is your perception plain & simple. What you should be concerned about as a business is 1. Does your staff reflect the culture of the area you are doing business in. I.e. If you are in a predominantly indian area you should by rights hire indian people. It isn't racism, it is simple business sense. The arguement is stronger still by the fact that no matter where you go in this world - this is an accepted practice because people group together to form a community with mutually accepted rules, religion traditions & cultures. You must serve the community & culture in which you do business by aligning with them in order for your business to thrive and be accepted. Imagine if you will ... a pure white scotsman opens a fish & chip shop in Umlazu and hires only pure white scots people to sell to the predominantly black people - do you think his business will thrive? The first error is that his business is not aligned with the race it serves and secondly does not serve the customers in a black language such as zulu and thirdly the staff have no understanding of the culture and traditions of the people of that area and could very well not be preparing the fish & chips with a flavour that is attractive to the people eating it. In Phoenix, people who buy fried chicken prefer spicier and hot spices wheras in a white area the speciality would be milder and less spicy. It is natural for people to group themselves according to their cultures and race and those lefties are continuously blinding themselves to that fact. Lets stop with the bs and focus on what is common sense instead of this impractical illogical bs woke ideology called communism, that seeks to control every aspect of our lives and make us conform by denying us of those very things that make us unique individuals who can decide for ourselves.

It is sad that the ANC is even more racist than the National party ever was. South Africa is the only country in the history of the world where the majority feels it is necessary for laws to give them an advantage over minorities. This is rooted in self-doubt, hate and greed... If you feel that you cannot compete on an even playing field, what makes you think others would not think the same because of this? Remember, businesses can only be forced to employ black South Africans in preference to whoever might be the best candidate...In South Africa. That is why any business that can leave and set up in a country without similar restrictive laws, will do so...and they will have electricity. The sad reality is that, if there were no race-based laws, there would be many, many times the number of good, well=paying jobs for Black South Africans. I guarantee that this amendment will lead to massive job losses. By 2025, the rate of unemployment in South Africa will exceed 65% BBBEE afraid...BBBEE very, very afraid....

The ANC is so desperate for votes. But instead of doing the right thing by dealing with the wide-scale corruption in the public sector, improve education and health, improve service delivery, etc, they focus on more divisive and discriminatory acts which further impoverishes the business and economic sector. If the education system was not so poor, and the unemployment rate not so high, then bbbee may have been acceptable.

The thing is that someone is employed with certain credentials which is a requirement of the position. Two years later an additional person with the same credentials is also employed. Now the first person has worked for the organisation for two yrs and has received an increase every year. So this person is now ranked as level 2. New person is ranked as 0. Thus, same credentials different salaries. Because the employer has put levels of responsibility and pay expectations on the employee.

I'm a 52 yr Indian professional born and living in Durban, with over 25 years of experience in risk and compliance management and auditing. I'm unemployed for the past 4 years. So if I decide to open a consultancy firm and as it grows, I employ my kids, nephews, nieces and other family. As my business grows, my staff complement grows to beyond 50 in the next 10...15 years, will my business be non compliant to this law?

People should be hired based on merit (qualifications, hard work, honesty, good manners and ethics, a mensch), irrespective of race, religion, gender, ethnicity or language. To hire the right person for the right job is called Meritocracy. If ESKOM or SAA or any department or business or Franchise has a problem, then hire the right person, don’t hire a skin. Even though I am a doctor, please do not expropriate a farm and give it to me. I know nothing about farming. Do we have great surgeons that haven't spent a day in surgical school? -Henry Mintzberg I don’t know how to milk a cow or plant mielies. If I have to run a farm, I shall first go to the University of Stellenbosch, study Agricultural Science at their fabulous world-class Faculty, and then visit some International EXPO’s to learn the latest farming and agricultural advances (including machinery, chemicals, organic farming, science and technology) and only then will I attempt such an endeavour (hopefully with a wise old Afrikaaner farmer as a coach at my side).

I do agree, we can't use race as a basis of employment, however, the suggestion came from a noble place, black representation in place's of senior/skilled employment, are unrepresentative of our demographics at the utmost least, even with a stringent measure, as BEE in place, "Business", would rather pay hefty fines, than employ blacks. Business, has been given nearly 30 year's, to balance out the Economy, this hasn't happened, Governments hand is now forced, to do something extremely radical, like this Amendment. Something extreme must be done about our horrible level of inequality, "Business" doesn't seem to find any urgency in addressing this, Government is now intervening with this measure, pity, only on senior level, he should also look at second line Management as well.

You make a valid point. However, the latest amendments warn severe penalties for businesses who have more than 50 employees. You can only have 0.01% of your business with a coloured or Indian (male or female), irrespective of their qualification. If you have 50 staff, then if you hire 1 Indian or Coloured, you will receive a hefty fine, because 1 out of 50 is 2%, whereas the target is 0.01%. This means, that if a business has 1000 staff, they can only hire ONE Indian or Coloured - they are BANNED. This is racism and injustice - IF a company breaks the law by discriminating against a highly qualified Black, then Punish THAT company, why punish the whole country, and those of us small businesses who are trying to survive and create jobs. If my business grows to more than 50 staff members, then I get punished if I dont abide to the race quotas - this will affect the Economy and job creation. Where is the logic? -If I (as an Indian), have worked hard from small, I have put my families money in the business, I have worked night and day and sacrificed my health, and now when I reach the target of “more than 50 employees” it means that I have to get rid of my wife and my son who have joined me in the business because 3 out of 50 breaks the law. It also means, that when I die, I cannot give my business to my 3 sons, because 3 Indians out of 50 (or 100 staff) is BREAKING the law -You are looking at it from a potential “employee” point of view, but the EEA Act is severely discriminatory to the Business entrepreneurs and Captains of Industry. It means, that if the Bill goes ahead, and if I got a Business with 100 staff, including 10 Indians and 10 Coloureds, I have to FIRE 9 Indians and 9 Coloureds immediately, no matter how HIGHLY qualified they are. So where is the Justice? This is racism. -If I have 50 staff in my business, and my own daughter has now qualified as a Lawyer or accountant, I cannot hire her in my own Business because she is an Indian and 2 Indians in the same business (father and daughter) is BREAKING the law because 2 out of 50 is 2% and is much higher than what the EEA Act allows which is 0.01%. So where is the justice for my own highly qualified daughter? This is very sad. This is not the South Africa that I voted for in 1994.

I agree, and i totally refute the amendment if i wasn't clear enough,also, I've made a submission rejecting it, and shared with everyone i know to do so as well,further, indians and coloureds don't control a majority of land ownership and stake in the Economy, i have no idea why they were targeted, neither am i stating whites should be targeted, i am merely pointing to the fact that we live in a horribly unequal country, and business, like the useless ANC, has done absolutely nothing, to address this inequality mess we are in, the score speaks for itself, there's nothing to defend it, especially in the condescending manner in which this guest is doing. All business do, is blame the ANC, which makes them just as pathetic, as far as im concerned, this decision, to do the right thing, should not be delegated to them, because they, like the ANC, have had over 29 year's, to sort this mess out, they unfortunately have not done so. No more excuses,pronouncements and rhetoric, we've been taking too much crap from business, they can't get away with placing everything on the ANC's doorstep, as the gentleman mentioned, "business" is the one employing, not the ANC/Government, Executive decisions are made by business, who should we hire, train, promote,fire etc. We can't let business get away with the crimes they have been committing, just getting away with the net score(inequality) that business, created. I do hold an employee view, in this regard, as a business owner ironically, as the quotas target's them, i don't feel pity for the employer, who has had nearly 30 year's, to sort this mess out, but just choosing to make excuses, this is were i absolutely draw the line, it's absolutely unacceptable and inexcusable, we must not take it any longer. We don't need another 30 years of this, big brother needs to intervene, because the adults have clearly left the room, both in the ANC led government, and in business.

In the definitions section of the EE act the term black people is defined as a generic term "black people" which refers to Africans,Coloureds and Indians, that being said if you're are an LLB graduate and looking for articles you would have seen that many of these ads especially in PTA the main requirement is Afrikaans FAL(no acception) and most black people don't have Afrikaans especially as FAL but this is not an anomaly because it's being done across a lot of professional fields so this argument about being "qualified" is nonsense and so it seems that people want to appear color blind when it suits them The EEA said nothing about hiring a non qualified person because everyone knows that there is a lot of qualified people of all races in South Africa who went to the same schools and universities as their white counterparts but a lot of them get no jobs after their studies while seemingly others get jobs with ease If we did not have some sort of an equity plan white people would only hire whites and we all know that and you wouldn't be able to do anything because it would be legal. The EEA seeks to diversify the workplace and it does not say you shouldn't hire whites it is merely pushing for diversity, Anyone who is concerned by this should just read the EEA. I may be wrong so if you're critical please do it with respect

All those entities are failing because of the ANC's management of SOEs not the general population because as far as i'm concerned i have nothing to do with SOEs nor did i contribute to their collapse. However let me re-emphasize because you seem to be confusing black people at large with incompetence and corruption, there are thousands of qualified black people(Africans, Coloureds and Indians) who are as qualified and as competent as anyone else but they're not getting hired because they don't have Afrikaans FAL and other indirectly racist standards, for that matter there are a lot of white owned entities involved in the collapse of SOEs and so that is not a matter of employment equity it's more corruption and incompetence in government which has nothing to do with the greater population. Remember how many white owned companies were involved in that free state dairy scandal. So i respectfully ask you to conscientize your perspective and do not think that the ANC represents all of us and people are not monoliths

You are so right Riaan. Why is this is? Because of the social engineering of the past, the gutter education, the previous regime choked any potential to progress to achieve and balance and have the same level of skills. Dit is die probleem. So we have inherited this denial to compete with the rest. Kyk waar sit ons nou, diep inne kak. So yes, you right sir. You whites got the training on a platter. We coloureds worked the system with parents who demanded that we got intense education while in the home so that we could circumvent that gutter education. The result, a skilled and sophisticated culture. On par with whites. Since 1994 coloureds oxygen was still cut off. And still we got intense education. Companies abroad scrambling for our services. What you say surely has merit in that the imbalance Is there. But you can't remove It with imbalance on the opposite side. What has to be done Is to create equality of opportunity, investing in high quality free education for the next generations. There Is also the fact that throwing out competent people for less competent ones that have the "correct" skin color to match your quota Is totally idiotic and It will happen of this law Is implemented. It will only decrease jobs and stability and lead you right back into Apartheid...
