Let’s talk about inheritance and transfer of title.
You inherited a piece of land. You are wondering how you can transfer the title under your name. What documents do you need and how do you proceed with it?
In this video, Your_Lawyer discusses the two (2) documents in the settlement of an estate of a deceased person:
1. Affidavit of Self Adjudication. When you are the sole heir and the decedent left no debt, you may adjudicate the entire inheritance unto your self through this affidavit.
2. Deed of Extrajudicial Settlement of Estate. When there are two (2) or more heirs and the decedent left no debt, the heirs may execute this document to divide and distribute among themselves the inheritance.
Under the Rules of Court, these documents may be executed only when the decedent left no debt and no will. This means that if there is an unpaid indebtedness, you cannot simply divide among yourselves the inheritance since the creditors are entitled to collect from the estate. The creditor’s claims must be satisfied first before the net estate can be distributed among the rightful heirs.
It is required that the Affidavit of Self Adjudication or the Deed of Extrajudicial Settlement of Estate must be published in a local newspaper once a week for three consecutive weeks.
Also, when the decedent left a will, you cannot simply disregard or set it aside. The will must be probated and when it is allowed by the Court, the distribution of the net estate must be based on the instructions of the decedent as laid down in the will, with due regard to the legitimes of the compulsory heirs.
Note that under the TRAIN Law (RA 10963), you have up to one (1) year from the death of the decedent within which to file the tax return and to pay the estate tax, failing which, you may be meted with penalty, interests and surcharges. The estate tax is now at 6% of the net estate.
If the decedent died on or before December 31, 2017, you should take advantage of the Estate Tax Amnesty under RA 11213 (Estate Amnesty Act) under which you are required only to pay the estate tax at 6% of the net estate value without penalty, interests and surcharges. This tax amnesty is extended until June 14, 2023.
Once the taxes are paid, the BIR will issue the electronic Certificate Authorizing Registration (eCAR).
You also need to pay the Transfer Tax with the Local Treasurer’s Office so that you will be issued the Tax Clearance.
You submit the eCAR and the Tax Clearance to the Register of Deeds, along with the Owner’s Duplicate Copy of the Title, Certificate of Publication and the Approved Subdivision Plan, if available. If there is an approved subdivision plan, the Register of Deeds will issue individual titles to the heirs. Otherwise, only one title will be issued bearing the names of all the heirs and their respective shares.
Once the title is issued, you need also to have the Tax Declaration transferred in the name of the heir/s.
