The appeal follows Combs's two denials of bail after his arrest on September 16. The lawyers for Sean Diddy Combs have filed an appeal to get him freed from custody before to his trial. According to court records that PEOPLE was able to access, the mogul's attorney, Alexander A.E. Shapiro, filed the case in the U.S. Court of Appeals for the Second Circuit on Tuesday, October 8.
The rapper "was not released pending trial, even though he offered to comply with restrictive conditions that would have prevented any conceivable risk of flight or danger," according to the complaint. Shapiro claims in the lawsuit that the court "violated its obligations under the Bail Reform Act" and "rejected a plainly sufficient bail package" for Combs. Mr. Combs is thought to be blameless. He knew he was going to be charged, so he came to New York to turn himself in," the document said. "He made a remarkable show of his will to confront and fight the allegations, not run away. He offered a bail package that would categorically prevent him from endangering anybody or getting in touch with any witnesses. Liberty "is the norm, and detention prior to trial or without trial is the carefully limited exception," according to the Bail Reform Act.
