Hearing directly from a FAA representative is very informative. Instead of hearing someones interpretation of the rules or their feelings of what the FAA is doing, hearing it directly takes the quessing out. It allows the FAA to get out accurate information to the people. It's a win for the FAA and for the ones the rules will apply to. Great job with this one.

It's definitely great to see... I still have mixed feelings about the rules and rules to come. Now. if I'm sitting on the front porch I'm not supposed to fly the field in my back yard but with remote ID I could fly around the block. The problem with that is if I go to a Park everyone will know who I am and where I'm at.

Everything is changing and all we can do is make our voice heard about loosing our freedom and the right to fly anywhere from a safe height over a few people in passing is OK and use a strobe lights to fly at night and just use common sense and do the best you can to comply with the regulations and have your number from the FAA on the drone I ordered a sticker with my number and phone number on it for around 10 bucks

@@AlienDrones Hi Keith, I have a question. How does the FAA view theatrical performances with drones? The ones where they fly at night and create 3D art. The way I read the law the pilot must operate only one drone at a time. How is it that they can have hundreds of drones in the air driven by computer and only one pilot? It defeats the whole purpose of optical line of sight because you cannot be looking at 100 different drones simultaneously.

I would like to see more discussions like this. It's very helpful. :) Also, aimed at the FAA, I would like there to be some consideration in regards to the accessibility of using drones for personal purposes, in a not-for-profit situation. I see no reason that a person should technically need a Part 107 remote pilot certificate if they decided to, for instance, take a photo using their DJI Mini of their yard to help determine where to plant a tree, garden, etc.; However, right now, it kind of feels like that is the case, given the rules as written right now.

Funny thing is I was using my mini to inspect my own roof which is much safer than me climbing on the roof. The rules seem to say I need a 107 part B which makes no sense. If I see missing shingles or flashing I would then climb onto the roof to inspect and repair as needed. The drone is much safer way for just a simple inspection.

When I saw that the video was 40 minutes I just knew I wasn't going to watch the entire video in one sitting. It was so interesting that I ended up watching the entire video from beginning to end. @@oemglobal3535 Of course, nothing personal, after all we don't know each other and it's just a discussion over point of view, always a fleeting proposition at best. From what I've seen of hang gliding (Torrey Pines) and ultralights I'm not concerned about them at all like I would be about drones flying BVLOS. Ultra lights are few and far between in the urban and suburban environment while drones flying BVLOS have the potential to be far more present in these areas and the injuries that could occur would be to non participating bystanders rather than pilots and passengers (pilot/passenger deaths and injuries dominate rather than bystander deaths and injuries). My point in my earlier comment was that it appears that the overall long range theme of the FAA program regarding drones is to develop a regulatory basis that will allow safe BVLOS while maintaining a backward compatibility with "recreational" use using an appropriate "common sense" level of "self certified" pilot responsibility that one should always expect to see in any case. As far as your Gotcha moment, I see it more as a caveat moment to remain alert to. Exception 44809 is certainly a work in progress to be hammered out in more detail and hopefully not by the courts alone and as the last resort. It is strange that ultralights are as lightly regulated as you point out. I'm curious to know how that came about.

@@ChrisTietjen_00 yeah, manned aircraft certainly do have a built-in deterrent to reckless operation, and as I indicated elsewhere, ultralights are rarer than drones. So your points are well taken here. At the same time, while this rep's presentation comes off as effective UAV-friendly PR, I'm cynical and skeptical of the stated rationale for some of the rule-making, particularly remote ID requirements (as I also stated elsewhere).

The Mini-2 with Prop Guards does NOT qualify as Category 1 because the Prop-Guard puts the weight of the drone "and anything attached" over the limit of 0.55 Lbs. If you manage to acquire a Japanese battery, (Good Luck!), which is lighter than the US model, the drone including guard stays under 0.55 Lbs., thereby qualifying as a Cat-1.

It's rediculous. There are more drone rules and restrictions than that for a glider, parasailing, micro lights. They are getting tougher to drive you away and protect thr skies for automated drones that amazon, etc are working on. The stupid this is all those drones will still put peoles safety at risk. Amazon and courier companies trying auto delivery drones want you gone, but the danger for public will be more dangerous than the average hobbyist

BVLOS - you got your DJI guys flying a couple miles out in busy places - and you got guys like me FPVing around trees and outbuildings - never more than a couple hundred meters out, on our own properties out in the sticks - nobody around. But the FAA puts it all together, into one stupid bundle of criminalized RC activity.

It feels like the FAA has used BVLOS as the carrot for trying to induce acceptance for RemoteID. The reality is the BVLOS will require MUCH MUCH MUCH more than just RemoteID for a UAV to qualify for BVLOS. So I consider some of the past FAA communications to have been a bit sloppy at best if not disingenuous in directly linking RemoteId to BVLOS in an effort to "sell" RemoteId to the non-commercial UAV participants (i.e., RemoteID = BVLOS). Kudos to this FAA rep for at least acknowledging that RemoteID is simply a small building block towards a UTM system (which I believe is likely many years off) which ultimately will create framework for BVLOS for certain classes of drones (e.g., likely only commercial drones not consumer drones because of the fees and additional equipment required). This is why I have a problem with the FAA using BVLOS as the carrot for acceptance of RemoteID...As consumers we will pay the RemoteID "tax" and the Commercial UAVs will reap the benefits. Also I find some of the the Privacy implications of the current RemoteID standard to be totally unacceptable (e.g., broadcasting the exact location of the pilot AND making that information available to JohnQ public via a simple app on a smart phone).

Ask that fine gentleman why the FAA made it illegal to fly FPV without a spotter - when its more dangerous to fly drones (not planes) LOS than it is to fly em FPV - because - flying LOS you will lose orientation and have to guess which way it will go. With FPV - no guessing - you always know.

This point seems to be lost on the FAA. I don't fly FPV - not my thing - but clearly FPV pilots typically fly with far more real-time positional awareness and much greater precision than I do with my "flying camera." But even beyond that, I am far more confident with the info from my drone telemetry than what my eyes give me by observing a dot in the sky at god-knows-what distance. That's why much of this discussion led by the FAA seems contrived.

First, thanks for all you do and the effort you put into helping educate recreational drone pilots like myself. While watching your video, I'm looking at my DJI Mavic Air 2 sitting on my desk next to me, which I haven't flown in months because I am so fearful that I am going to violate some rule, regulation or law. Sure, I've registered the drone and I've really tried keeping up with all the changes the FAA has promulgated for hobbyists, but I'm at the point where I'm just not willing to put in the time and effort it takes to learn and keep up with the ever-changing never-ending rules, regulations and laws that are coming down from the FAA. It's just too overwhelming for the average Joe hobbyist, like myself, to comprehend. The positives just don't outweigh the negatives. Fortunately, I have other interests and hobbies that don't require near the time and effort it requires to fly my drone for fun, which is why I bought it in the first place, to have fun! As far as I'm concerned, recreational drone flying is dead. Anyone want to buy a slightly used DJI Mavic Air 2? 😳

This ran me away from the hobby a couple of years ago the new rules and then the fear of more rules that makes it to where I could only fly in my backyard about 15 ft off the ground so I quit. I came back and I bought a DJI mini just to have something to fly and I don't worry about it much or the rules. I know what they are and I fly in such remote places so far away from people or airports or anything that I just really don't think about it. it is daunting though but to put it in perspective there are thousands upon thousands of rules to driving a car that you don't think about all the time but we don't get rid of our cars. Just use your common sense, remember drones can fail like anything else and make sure that if that happens it is not over anything that may damage a person or someone else's property and you should be fine. Also, do not invade their privacy. Those are the static rules I follow all the time.

I know this feeling very well. It's even worse for FPV, which is "basically illegal" unless you set up some fairly exotic monitor based ground station and have the reflexes and chameleon eyes necessary to watch both a 7" tablet screen and a fast moving 3" sub-250g "toothpick" nano quad at the same time, or have a friend willing to put up with watching your terrible flying skills for a half hour or so as your "visual observer".

For Manned Aircraft they made sense. They have fucked up repeativly the drones and had the courst tell them such more than onces including the current suit over Remote ID. NO that are not good for drones NOT AT All. Only thing they are woried about is Comerical and HUGE operations not hobbiest and small people.

loved FAA interview. I haven't as yet heard an explanation as to why FAA cares if you make money from drone pictures/videos. And yes I am very new to drone flying, I have viewed many videos explaining a lot of the rules of the FAA and part 107. Reading part 107 was directed at all the legal definitions that were overwhelming. Hope you do more FAA interviews that helped reduce a lot of my concerns. Thanks a lot.

Where do the brushless tiny whoops fall in respect to the regulations? Are they included in the Category one drones? for example NBD V1 Brushless tiny whoops?

If the NBD V1 weighs 250g or less and has prop guards that protect from lacerating human skin in the event of a collision then the drone is Category One. Under Part 107 a Category One drone can be flown over people except not in sustained flight (ie. hovering) over open air assemblies. Flying under 44809 (Recreational Exception to Part 107) one needs to follow the guidelines of a aeromodeling club and the eight rules set out in 44809. From the FAA: "Note: We have not yet begun officially recognizing CBOs. Recreational flyers are directed to follow the safety guidelines of existing aeromodeling organizations or use the FAA provided safety guidelines per Advisory Circular 91-57B."

I do not understand why the FFA has such a ruling as to not allow flying over people without their permission when the Law alls allows filming of anyone in Public (There is no implication of privacy when in public) so what is what here?

The FAA uses the term laceration. Abrasions, a milder form of injury compared to lacerations, involve the scraping away of a layer of the skin, usually caused by friction with a rough surface. Lacerations (wounds) are more severe, and deeper tears of the skin. I don't believe my DJI Mavic Mini's thin prop blades would cause lacerations, perhaps just an abrasion. Plus, prop guards increase weight and the odds of it coming down prematurely.

Larger drones and people that use carbon fiber props on smaller drones can cause full-on lacerations. The FAA is an illogical blanket agency so they treat regulations like using a hammer instead of a flyswatter to get flies - and when you’re a hammer, everything looks like a nail.

a mavic mini at 249g fitted with propguards will not fall into cat 1 as it will be over .25kg see this is why we need a direct question and answer panel with the FAA. 99% of what this guy said doesnt even apply to how i fly so its basically useless as it is for some other people.

Play with it low, and slowly. Learn step by step. Watch a lot of informational videos. If you're unsure about something, look it up. Don't be discouraged to begin one of the most fulfilling hobbies technology has granted us. As Kevin said, they are here to integrate it safely. Not take it away.

How about: "Hey FAA - get the F out of our hair and quit bothering us." Those of us that choose to register our UASs are, by definition, 'rule followers.' A distinctly different group of people that would be likely to fly a UAS irresponsibly in the first place. What makes the FAA think that instituting more rules will make UAS use safer? The people that are going to be unsafe are going to be unsafe anyway - and will likely not register so that there is a record of them. How many 'drone' related deaths have there been in all of history? Oh yeah... thats right, about a billion less than manned aircraft related deaths. This whole thing reminds me of the movie "Minority Report" where the 'authorities' intervene before a crime has taken place. This whole FAA B.S. is like gun control laws. Only the 'law abiding' will follow the rules and they are not the ones causing the problems. The only purpose of this is to satisfy a tyrannical need for increasing control, for the sake of control. 'Safety' has nothing to do with any of this - it's an invented and marketed 'threat' to sway opinion so we willingly hand over liberty.

I would agree but I would also be willing to bet some commercial outfits are supporting some group to pay politicians to push the FAA into regulation so they can do what they want with their commercial delivery drones or working drones.

I’m currently in college to become an airline/commercial pilot. This type of conversation is exactly the kind of detailed content that we need for recreational and part 107 operations. Thank you for making this content and thank you FAA for attempting to be more transparent. My interactions with the FAA and FSDO’s have been fantastic so far. I really hope that trend continues!

I always say a good measure of where to fly your drone is if you were in the drone or a person standing under that drone & your life depended on what you did with the controls of said vehicle. because you will pay the price for your actions 😌👍🏻✨ fly safe

The problem with the FAA is that they are concerned about a drone hitting someone on the head, yet, they have no problem allowing commercial aircraft manufacturers to conduct self-inspections of their products which then crash and kill hundreds of people. What difference does it make if I have a part 107 certificate or not? If my drone causes injury or damage, I am civilly responsible. This is just another money making opportunity for the government. There are a lot more commercial, government, and private aircraft flying over our heads all day and night than drones, but those pilots don't require special permission to fly over our heads and ground traffic. Since drones have become popular, the FAA has done nothing but come up with more rules to restrict our businesses and our hobby. It amazes me that they want drones to be safer to fly, but the bigger flying objects have been getting away with murder for decades. The FAA is just another corrupt agency looking for new ways to push their thumbs down on those of us just trying to make a living and have some fun at the same time.

Now we need "Shielded Operations" to get addressed (and approved) for letting us fly low altitude in areas where surrounding buildings, hills or other objects are higher than what we intend to fly. I'm thinking mostly of FPV operations, or doing low level video / photo flights in scenic areas...

For VLOS they actually clarified it a bit with some recent documents, but it has not relaxed. I did a video on the documentation where this is discussed: kzitem.info/news/bejne/y3t3qqSgm6Z9jaA . If you are part 107 you can get a waiver but it is still very difficult, but not impossible. For recreational flights there isn't any way possible to fly BVLOS...

I just added part 107 remote pilot to my pilot license. It's interesting how the Regs evolved. REMOTE ID will be mandatory by end of 2022 or you need to operate in designated area (FRIA).

At 249 grams the Mavic Mini requires no license. When you add (non-lacerating) prop guards, you are over weight. Do you have to register that contraption?

I have not made it through all of the comments so I apologize if this is repetitious. I am reading the Fed Reg V86#10. If I understand it properly, a Class 1 craft can transit over a full football stadium without remote ID. The assumptions are 1. the transit is 'brief', 2. the transit is incidental, 3. the transit is not related to the event, 4. all rotating parts are guarded. This doesn't sound right. Am I missing something? One additional comment: the rule is mute about transiting over traffic.

I think the remaining difficulties will be flight over open air assemblies of people. In addition, usually with stadiums of people result in a TFR which would restrict the flight altogether. If anything were to happen there's no way a flight over any portion of a stadium full of people wont be considered risky, and if it's gray and there's a problem the PIC will lose for sure.

at the 12:10-ish mark where he talks about sustained flight over people like a highway...he says you can transit from one side to the other but not hover. Totally understand that part. I have my part 107 and have taken my recurrent Knowledge test. I still can't do this yet, correct? I need to have remote ID first, and props fulling enclosed, which does not exist for my drone specs currently. So flying over people or moving cars is not allowed yet? Flying at night with the anti-collision lights is currently legal now with my above cert, Correct? And I keep hearing about a list of what catergoies a drone flys under ie category 1, 2, 3 or 4 but have not seen a list anywhere...what category is the mavic 2 pro under? Where would one find a list, or is that even relevant yet?

Indeed, it is relevant today, as the rule is in effect. In the video there are links below the description to an assortment of documents that could be helpful. Recreational flying? WHAT. A. JOKE. You practically need a law degree to work out if you comply to a particular requirement to fly under a set of rules, thenb you need memberships and registrations of yourself and the drone to fly what people have been flying for the most part safely for decades. And you have to take tests and fill out forms. Lots of forms. What is recreational about filling out forms and declarations and doing exams? Literally taking the fun out of r/c and drones, and expecting people to thank them for it. And they know full well that 250g makes it very hard, let alone with prop guards and remote Id taking part of that weight. Integrating my left food. Embrace. Extend. Extinguish.

Please ask about the need for a spotter on 250g drones doing fpv. They have better visibility than manned aircraft and have low risk of serious damage.

Greetings! So i fly a SG906- above 250 gr plane "recreational" with FAA register stamped, todays date is Sept 30 2021, If i understand Mr. Kevin correctly the recreational under (44809) cant fly at night unless your flying in accordance to a CBO organization that doesnt exist? "And" we would need to bw compliant with safety part 107, "And", a pilot license or rwgistration ", And, And, And, And.

There are no known prop guards for the mini 2 or mini that will keep the weight under 250 grams. I would like the FAA to give a waiver to weight requirements for prop guards saying like if you are using prop guards for safety reasons and the weight is under 50 grams, the weight will not count against your 250 gram limit. Because I can’t think of any drone a part 107 pilot would use for commercial business that would meet category 1 limits with the way it is now

Indeed, but _prop guards_ aren't specifically required. _Protection from rotating parts lacerating the skin_ is the requirement, so the solution is up to us! If it can be done with helium balloons then it will pass the rrequirement...

A small UA system may be eligible for one or more categories of operation over people as long as a Remote Pilot in Command cannot inadvertently switch between modes or configuration. What does that mean?

A drone can be qualified for multiple classes, but the class being specified and flown can't be changed during that flight. There are very few drones that are classified right now so I haven't seen this used in practice though...

That is correct, no CBO rules. Even if you "fly recreationally" you are doing it under part 107, *NOT* 44809. No TRUST test, no CBOs, no BS... 🤙

A question about flying over people or vehicles. There is a tree line 50 yards from the edge of the highway. Could I hover a drone along the tree line and watch the traffic on the freeway. Same question over people, if the drone is 20 feet away, can it hover and watch people?

So, am I hearing this correctly. If you don’t have a remote pilot license, you can’t fly recreationally because the FAA doesn’t recognize any safety organization required under the carve out? Or is this just dated information.

Information is still current, yet, and you certainly fly recreationally. Until the formal recognition, you're supposed to use existing aero modeling organization guidelines as mentioned here in this vid: kzitem.info/news/bejne/mWionaN_sneXhn4 The Proxy 1 CBO Listed in the description will work: www.modelaircraft.org/sites/default/files/documents/100.pdf. If you're wondering about flights over people purely recreationally, the short answer is this is not allowed without a 107.

I had already found the TRUST test, but didn’t know about following an organization safety guidelines. I swear, some of this is more confusing than airplane flight rules.

Thank you. Interesting and informative although frustrating at times. Why is the FFA and Congress for that matter asking me to fly according to rules that not yet exist?(as a non part 107 flyer). Also it seems to me that the FFA is getting closer to the rules that the EU has already agreed to and implementing as we speak. The unfortunate part is that there seem be be significant enough different where it may be needed to have a drone to fly here and one for Europe.

There isn't an off the shelf, main stream GPS drone readily available in the US that I'm aware of, but some of the smaller FPV whoop drones can support prop guards and still stay below 250g.
