On August 28, 2016, Tallahassee, Florida, 55 year old FedEx worker Steve Lincoln shot and killed his 33 year old roommate, single-mom Vicki Hoffman, with Vicki's son in their apartment. He then fled to Michigan, where he was later apprehended. He was indicted for the First Degree Murder of Vicki, but then raised self-defense / stand-your-ground immunity. The case went up on appeal due to a ruling about the admissibility of his testimony during the stand-your-ground appeal. Judge Stephen Everett had decided that his testimony at that hearing should not be used against him at trial because the prior judge who presided over that hearing imposed a burden of proof on Defendant, rather than the State. The First District Court of Appeal reversed, and the case went to trial. Senior Judge Gary presided, because Judge Everett was supposed to be busy with the Donna Adelson trial.
