I believe you are referring to the fifth ammendment, not the fourth. More specifically this line from the fifth "nor shall private property be taken for public use, without just compensation.". Which just about every state Supreme Court has ruled does not apply.

This happened to an innocent homeowner in Montgomery, Alabama also. The SWAT folks were certain that a fugitive was in the attic because they saw a hot spot on their thermal scopes. After tearing out the whole ceiling and insulation, they found the water heater hiding in the attic. Your house could be next!

QI literally just means you can't personally attack an officer for doing their job to the letter... this way they don't stop to debate whether protecting/saving you is worth it.

Her daughter offered to give cops the remote for the garage door opener so they could open the door. They refused and blew it off the tracks with explosives that still didn't open it. That alone proves they used her house to play with their toys. They should be liable for the repairs, not us.

Each state has a supreme court for state law (some may have another name but that's the role they fill) and then there is the federal supreme court (SCOTUS). It's quicker to use SCOTUS than say its full name and it ensures there is no confusion between it and say the supreme court of Rhode Island.

That would be a good start, but the judiciary is the bigger and more immediate issue. Lifetime appointed, bought and paid for hacks HAVE to be removed from the bench, but that is a very slow and involved process. It really isn’t even possible because of how divided we currently are.

One of the places where something similar happened they argued that the city shouldn't have to pay because pursuing the criminal was for the common good. But that makes no sense to me, that's forcing an individual to pay for the benefit of everyone. Having the city pay spreads the burden out over the group of people it's supposed to benefit.

Let's go down this thought process. If a person is going to be held liable for doing the job their employer AND a court tells them to do they should be legally held to pay for any "damage" done? So who would take that job? And if you did take the job, wouldn't you second guess every single order that was given to you, thus delaying any action? This CLEARLY should fall under the Takings clause of the Constitution, no matter how it was done. No punitive damages, only to repair whatever damage was done by Government actions.

I’ve worked in insurance for 18 years, and haven’t been in property for a while but can’t think of why the insurance wouldn’t cover this 🤔…it doesn’t cover illegal acts but that committed by the insured not a third party.

@@originalDVJ Sure, but here in Australia we don't search the way your cops do. It may take 5 mins longer, but we thoroughly & but carefully search. If we have to damage walls or access other sealed spaces, if we have to access it by force we pay for it so we go in with a minimum of unnecessary damage. That said I'd the person who's house is searched is proven to illegally have whatever was searched for, THAT damage isn't covered by the PD's insurance. Unfortunately it's often not covered by the offenders insurance, so if the house is rented the Landlord unfortunately winds up getting screwed.

DoD didn't consult with me before supplying military equipment & military training to police officers... did they check with you first? Get a notice in the mail? No I didn't think so.
