I think is a universal constant... these types HATE to be ignored. Drives them absolutely CRAZY... and then they do something foolish. I'd go back there and continue fishing... because we all know he's gonna come back out. Just silently fish... with a camera recording everything. Best case scenario is he accepts that you have a right to be on the water... and stops harassing you. The worst case scenario is he doesn't... and you have a case to charge him with assault. And then sue him in civil court (AKA a big settlement... lots of $$$).

I'm sure he's aware of the law and that he's breaking the law. He was badgering me for a bit prior to me turning on the camera. I was ignoring him for some time without saying a word. He's got enough money that he can buy his way into and out of problems. Problems like him harassing fishermen, laying down logs around his property in the lake with huge chains which is likely a violation of ecology statutes and it is questionable if his deck is up to code as well.

It def looks like the property lines run into the riparian way and in reference to the last comment left your property line can extend into the waterway. The thing to look for is the actual apn map as you searched. The zoning type maps may not show all property lines. Funny side note: There are parcels for sale, underwater, at the edge of the San Francisco bay. Subdivided land.

@@johnz5055 in general I only visit that spot in spring. Typically because the bass are that shallow until later in the year when submerged vegetation grows in. Then it's very difficult to fish because of dropping lake level and fish under the mats. I don't typically punch or flip from my kayak. It's easier to go elsewhere and try something different

I have worked (hard) all my life and I (will) protect the miniscule possessions I have worked so hard for for regardless who gets offended. I had one the other day. I was wading in a public park. Dude said I'm not allowed to be there, said he would call authorities. I told him it's a crime to harass legal anglers (it is in my province) and to hurry up and call the authorities. Told him to call the FBI (we dont have FBI in Canada, I watch too many movies). He asked how I got where I was. I said I flew. Authorities came 30 minutes later. Told me to enjoy my fishing, have good day, and stay safe. I fished the spot for another 2 hours. I always bark back against these idiots. I call their bluff every single time, and every single time I have been in the right. I am not always right, but when it comes to fishing I do my homework first.

Call the FBI :-) yeah I think this guy just built his shiny new dock and doesn't want anyone near it. I found the state constitution article 17 defines that the state owns navigable waters (which is where I was) and he doesn't own that spot. Additionally, we do have a law against harassment of fishermen and I told him I was aware of the law on that issue. He's trying to bluff me into going away.

Chain some logs, grow some moss & plants on top of them. Slowly over 5 -10 years add some rocks, dirt, more logs - meanwhile chase everyone away so they don't see up close what he doing & presto! Ah, but what you say can't be true -- if you find a way to look at the satellite map a little closer, there's no possible way he could see the fisherman from his house (at least 100 yards away, and blocked by trees). Not only that, but the '40th Street boat ramp' and a marina are directly behind the fisherman, with probably 100 boats there. Only a moron would buy waterfront property, when he hates fishermen. That's some kind of mental sickness... like buying a house near an airport when you hate the sound of planes. If he wanted solitude, he would have moved AWAY from the fisherman.

The law is clear in Washington wherever theres a public boat launch or public access to any body of water, said body of water does not belong to any one person! It belongs to the public! Even if private structure, patios, pillars, homes or boats , floats affixed in or near the publics water all remains fishable ! You might not figure out the exact locations but it’s good enough, and you can show a person or cop what you looked at, and that you made an effort. There’s no way you’re getting arrested for trespassing when making those kind of efforts

This old fart has spent his life trying to get everything how he wants it and if something throws that off, he can't handle it. He's a fool. If he were wise, he'd just let the gentleman fish in peace and he would be on his way shortly. But he created the Streisand Effect here basically by harassing this angler. Yep, this is Lake Washington, so the appropriate law is RCW 77.15.210 -- Obstructing the taking of fish, shellfish, or wildlife (1) A person is guilty of obstructing the taking of fish[, shellfish,] or wildlife if the person: (b) _Harasses, intimidates, or interferes with an individual engaged in the lawful taking of fish,_ shellfish, or wildlife or lawful predator control with the intent of disrupting lawful pursuit or taking thereof.

Don’t know what state this is, but in Texas, the State of Texas owns all the public waters, salt and fresh. And the fish and wildlife are owned by the state. So if you’re wading or in a boat on public water, it’s not trespassing.

Yes, I have found that these types of people scheme to capture a chunk of public waterways, for their own personal use. They'll do whatever they can get away with. This crazy old man is actually violating RCW 77.15.210, for harassing a fisherman. He'll keep doing it, until he faces consequences. Which is why you should call the game warden, and get it on the official record.

Willamette River by us has what is called Green Way which is the 30 year high water mark. This area is public. Many land owners try to claim they own everything right into the water. A friend and I were in a canoe fishing bass in a arm of the Willamette River which is also under water during high water. Guy came out harassing us. We told him we are legally fishing the area because it is in the Green Way. He kept threatening to call police. We told him good we aren't going anywhere. Then tells us he owns the land below and the air above. My friend told him you must be God. He went and got an old Brownie camera that likely did nothing. We posed with our fishing gear still in the Canoe out in the water. When I got home I called the Oregon State Police. Officer told me they have been out there repeatedly telling the guy he can not threaten people to leave. I told him one of these days he is going to mess with the wrong people. Another friend did Duck Hunting in a slough of the Willamette River. Someone put in a Duck Club and claimed ownership of part of the slough. My friend was being harassed and brought a State Police officer with him hunting and they were getting shots over their heads. The officer got out on the duck club property and told the morons one more shot comes over us and I will be making arrests of everyone in here. The Duck Club claimed they did a land swap with the State of Oregon. That is illegal because no one owns the Green Way it is public access. He was going to court to fight it and died of Lung Cancer but friends said they will continue. Not sure what ever happened.

Sorry about losing your friend to cancer. He sounded like he was on the right side of life. It is unfortunate that humans are often so intolerant of others and the laws regarding access to public land and waterways. I figure those Duck Club guys would tolerate people fishing but too damn greedy to claim ownership of everything. Maybe they would be better off with PETA protestors or someone more like them 🙃

If you can get to a waterway via a public way, or the water itself, you can be there and a private citizen can't stop you, even if the water is cutting through or adjacent to their land. That's how I've always understood it.

Yep, in general the high water mark is what matters... you can fish, all the way up to that mark. This can vary by state, though.

Ran into a lot of these people on Lake Washington shoreline. Especially on Mercer Island. The best was the security from BIll Gates new mansion. They said we had to stay 500 feet away from his shoreline.

I live on a lake and no one gets mad when fishermen get close to their docks. Most come out and talk to you. If the homeowners are using the dock I don’t go near it,”sunbathing, swimming, fishing”. But everyone waves and appreciates it when you have respect. No homeowner/landowner should act like that.

Its pretty common around there. When Bill Gates was building his compound on the lake and we would go fishing by the dock, in a boat, his security guards would tell us we cant fish there and its private property. We would laugh and tell them to call the cops then and keep fishing. Ironically the cops never showed up, not once…

No cop this day either. I waited for some time for the police. The police had just passed me moments prior to this incident. So they were on the water already and could have made a stop
