Crystal, here in Denmark we banned the favoured vape juice, now the kids buy underground vape juice through snapchat. You cant stop it this way, start punishing those who sell to minors harshly instead and give them help to get off of it

The idea that an illegal/underground market will exist, is a horrible argument against prevention methods. It's illegal to get drunk/high & drive a car. But sadly, people still do it. It's illegal for minors/kids to drink alcohol. But people still do it. It's illegal for kids to buy handguns & ARs in certain places. But people still do it. Should we erase all of these laws just because people will find a way to break the law? No. Laws like this are the best way to limit potential public harm. Infinite lives are saved even if it's impossible to completely ban the behavior.

@@CassieAngelica Sure, but that could be the fact in most social issues. Second hand smoking for sure damage others. Drugs in its very nature will hurt way more than the ones using it. Suicide help probably is the most social liberal issue ever since it is ones own decision and you can go through a process to get that help instead of doing a reckless suicide yourself. We are of course not talking about impulse decision that is many suicides and this people would nevery go through that process. But euthanasia for sure would emotional hurt your relatives for example and not in a small manner. Homosexuality though is one of the issues when it is not complicated at all with really no backside having an accepting society. But many social issues will have a darker side when people get hurt way over the one using whatever it is.

I got oral cancer from smoking 10 years ago. After many failed quit attempts, I tried vaping. The tobacco flavors never did it for me. Once I got my tastebuds back, I wanted something different and fruity flavors are what finally got me to quit. Vaping is harm reduction and there has been many studies and polls showing adult vapers prefer flavors.

I’m kinda with Kyle in this one. Everyone I knew in high school who vaped/smoked would’ve preferred good flavors, but really wanted nicotine. The argument they never would’ve tried it if there weren’t flavors doesn’t really convince me when my parents/grandparents generation all smoked non-flavored cigarettes

no one is stopping you from eating anything. if you are fat your bmi will be reported to insurance companies, if you smoke your insurance companies should know. no one is stopping you from these behaviors (smoking or overeating) but you will pay your fair share. smokers and fat people are making other people pay for their choices that make medical care more expensive. no one is stopping you from these bad behaviors.

People always do at the start until 10 years down the line when they realise it was a good idea. In the uk we banned smoking in pubs. Everyone went mad then everyone decided they like not having their eyes burn on a night out and not breathing in 2nd hand smoke was actually quite nice. Most people just don't like being told to quit a bad habit that's the truth.

The problem is it’s not the government who is doing this. This is not a handful of politicians in the state capitol building, this was a huge margin of ordinary people exercising their democratic rights. 63% of voters decided they don’t want this product in their state & that’s that. Californian here. I couldn't BELIEVE this passed. I had thought there was no way. I still can't get it through my head. The other argument against this is that they will find a way around the law anyway. They always do. Prohibition doesn't work. We know this already. Also, anecdotally, the flavored vapes allowed me and several others I know quit smoking actual cigarettes. You can argue that thats not much better and overall I would kind of agree, but there is no doubt to me that my health has improved immensely. I went from smoking nearly a pack a day to just a few puffs an hour off the vape, and you can not honestly saw that's not a huge improvement.

@@garfieldGG -- Nope. Gambling wasn't banned in California, it actually was not legal here to begin with, except in tribal casinos. There were ballot measures in this latest election where Native tribes tried to legalize sports betting specifically, and those measures didn't pass. Not sure why, but I guess the majority of voters didn't care to add more types of gambling to the already legal gambling that happens in the tribal casinos. I dunno.

I wholeheartedly agree with Kyle on this one. I smoke menthol cigarettes (6-8 a day, which I thoroughly enjoy and use an excuse for a meditative break) and have for many years with no adverse effects that I'm aware of and my 33-year-old son enjoys his caramel apple, french apple pie, or whatever other flavors he chooses for his vape instead of seeking more nefarious and dangerous pass times and one of the reasons we moved from California to Arizona is because we're sick of the nanny/police state. How many prohibitions is it going to take before people realize that it is just yet another attempt at control through fear and it will not work, ever!

I'm fully with Kyle on this. I've no idea how Krystal can even make the "they'll market it to kids" argument seriously. What kid is actually going to think a tobacco flavored version would ever taste better than a candy/shake/cake of the same flavor? If someone really likes a certain flavor there are dozens of better ways to get that flavor that will always outrank tobacco. It really screams of Krystal trying to force an excuse against it because it's such a poorly thought out, reactionary view. If you've got a problem with marketing to kids (something they'll always attempt to do), then you'd focus on the marketing itself, not something as basic and universally desired as the product having flavors.

She didn't say they would market it to kids. She said they already did. And I don't think most people would disagree with that. The way vapes are marketed is 100% targeted at kids and teenagers. They realized that teenagers weren't picking up smoking at the same rate as previous generations and their previous generation of smokers were dying (many of them because of the smoking). These products were designed to attract kids to smoking.

Here are a few quotes from one article about 1 company. "Congressional investigators found Juul Labs “deployed a sophisticated program” paying schools as much as $10,000 each to let company representatives deliver its message directly to children. In at least one presentation, without teachers or parents present, a company representative showed kids how to use a Juul e-cigarette. Other evidence showed that Juul Labs also targeted preteen kids through summer camps and out-of-school programs." "Juul purchased banner ads on child-oriented websites for Nickelodeon and Cartoon Network among other websites designed for child audiences, according to a 2020 Juul lawsuit filed by the Massachusetts attorney general." But no, generally not in school bathrooms because it's harder to conceal. I am from California and this is exactly how me and my friends argued when it was up to voting for this proposition. I was against the ban and my biggest arguement is that banning the flavors is not "keeping children safe." I have a teen sister and she tells me that the kids who are still vaping are just mixing the unflavored liquid with random shit to give it the flavor. I don't want kids to vape period, but this alternative is significantly worse

That's a bad argument to make. Just because something can be done doesn't mean that it will be done with the same frequency. As coal ovens were phased out the people who had been using them to commit self-murder didn't all switch to a new method, some portion of them had to work harder to go through with it and chose not to. Likewise, in this case it will be less convenient to figure out how to mix the liquid to taste better so you can expect that fewer kids will be doing it. The whole bit about either legalizing the flavors or kids are going to be huffing random stuff that they put in there for flavor is questionable at best.

Especially if you can still get flavors in other states, that opens up a black market which quite possibly causes more problems than the prohibition prevented.

"Smoking doesn't hurt anyone" - as someone who was raised by a smoker and now suffers life long lung problems, it is categorically untrue that smoking doesn't hurt anyone. Second hand smoke is still a huge cause of cancer and other lung problems for a lot of people.. and as long as there are cigarettes, it will continue to be so.

As a Californian, who doesn't smoke , I can't stand for this type of prohibition. It passed with 60% of the vote, but the ballot initiative was framed in a way that made the yes vote appear as the obvious choice to the layman. This isn't freedom. Totally agree with Kyle .

As an Aussie who's spent some time in California, I'm really surprised California would do this because they are so pro-pot. Of all the Americans I met Californians are the most laid back and if "Its not harming me or my family then leave people alone." I wouldn't call Californians libertarian but I would call them free choice advocates. That's because I see libertarians as the right wingers who want the liberty to strip others of their liberty like the current SCOTUS. Californians always seemed to me to be more nuanced when it came to this sort of thing. So what's changing?

Back when I needed a green dealer, he also sold nicotine vapes and cartridges. Didn't get it when I first saw it on his Snapchat, but then I thought of how one of my friends that used to smoke was underage when he did. Kids probably aren't using fake IDs en-mass to buy flavored juice or some crap, like where this law would "mean something." They're buying it from the same people that sell them underground weed and other drugs, and those are the carts that were hurting people a couple years back in the news, not regulated ones. Like Kyle said, enforce pre-existing laws (and improve parenting). This isn't gonna fix much, and will probably lead to kids getting even worse juice than they already get.

I'm pretty sure at least 70% of the world's population can't find Twinkies close to where they live but they seem to do fine without it because ther are many alternatives... Yup, I just checked it out on ZeeMaps and it appears you can only find Twinkies in the US, UK and Germany. So more than 90% of the world population can't get this exquisite delicacy in shops.

Not a smoker and never have been. I do see it as a public health issue so I could see making cigarettes harder to get like in grocery stores. If you want to smoke though, you should be able to go to a specialty store. Cigarettes don’t disappear because they are illegal.

Don't know what more common-sense thing you could do besides banning any kind of marketing. Which is already implemented in the states as far as i know. There's a weeed shop on every corner in my town but they can't have overly extravagant store signs, windows must be tinted, etc. You're not gonna stop newly fledged adults from trying it but I've seen with my own eyes how walking into a smoke shop and running into your boomer neighbors picking up an eigth for their hip pain really takes the "cool and forbidden" factor out of blazing right out of it, which is itself along with peer pressure the reason so many teens start smoking (cue the "It's not addictive" crowd rolling in 🙄)

I started smoking in junior high school and it was unflavored Marlboro's because that is what my friends smoked. NO NUMBER OF VOTERS HAVE THE RIGHT TO CONTROL ANOTHER PERSON'S PERSONAL INDULGENCES!!!! PERIOD! I would vote to stop putting these types of laws up for a vote in the first place!!

The only reason I ever needed vaping gear was because I got addicted to cigarettes. The only reason I ever needed kratom was because I got addicted to pharmaceuticals that were overprescribed and diverted finding their way to me. I’m open to all these conversations but I’m definitely more partial to solving the up-river problems that are leading to consequences downstream like the ones I mentioned. Healthcare, education, jobs, inequality; these things often lead to people using addictive substances and if they do then the resources should be available to help them and those things are currently out of reach for millions of people.

I am a Californian and I voted against this. Something Cristal doesn't understand is there is an industry if anit-smoking advertising. This is funded by a nicotine tax. The product these companies provide is akin to "refer madness" but towards tobacco. While tobacco companies are extremely limited in how they can advertise. There was plenty of money and propaganda on both sides of this debate. I am not a minor nor a smoker. This law does not affect me. But it is wrong for the government to tell me, an adult. What I can and cannot put in my body.

I use vape products in CA. I live in a city where the flavored ones are already banned. I still get them. The shops just sell them out of the back. On it's face I think it's ridiculous the government says I can have my nicotine but just can't enjoy it as much. I'd be cool with the ban if and only if they banned all other flavored vices. I don't drink but if I have to suffer so do you guys. No more flavored white claws or vodka. Don't come at me just cause you have a vice you like better.

@@nearthefarworld vape products contain 3 ingredients generally. The nicotine, the polypropylene glycol (generally regarded as non toxic), and the flavoring. Exhaled vapors contain about 6.23 µg/m3 of nicotine as nearly all is absorbed in the lungs. Which is basically nothing and contains none of the other toxins from cigarettes. Also this problem is completely eliminated by just not vaping near people. Second hand vape exposure is a piss poor reason to ban it.

Its the catch 22 they already punishing smokers. Cant put the price up anymore. They make more on the tax than anyone involved from field to ashtray. New smokers wont be able be punished so they just banned. Also I paid enough tax my lifetime of smoking build a small school. Obviously it was the right thing to do. Would just spent the money on food get fat or bigger car guzzles gas or drugs and booze, which would had more social harm. Smoking had made my life great. Soon as people stop smoking they become arrogant jerks and never hangout with their friends.

Nah its just positive state intervention, same reason loads of things are not publicly available. Even if you are a freedom absolutist eventually you will be against the personal sale of certain items, so its just a matter of where the line is drawn. I'm happy to draw that line past cigarettes especially considering their impact on OTHER PEOPLES health due to second-hand smoke.

I feel like I've seen a lot of kids who vape but just use menthol and don't even like the fruity and overtly sweet flavors. I believe the desire for fruity flavors among adults and teens is virtually the same.

I’m 100% with Kyle here. If high school and middle school students are getting their hands on vapes then we need to look into who’s selling to them and crack down on it (I don’t think they’re getting them directly, they’re having others buy for them), but this Helen Lovejoy “think of the children!” moral panic overreaction is just idiotic. Minors also find ways to get alcohol but we don’t dare have initiatives to outlaw booze.

Smoke whatever you want as long as you aren't forcing others to breath it in so fine with no smoking in businesses etc. Drink as much as you like just don't go operating motor vehicles firearms or anything else you could harm others with until you sober up. And believe abortion should be a safe lefal option up until the point in the pregnancy that the child could be viable outside of the mother's body.

I lived in NZ and its nice that smoking is banned almost everywhere. it does have effects outside the smoker, so regulation is warranted. plus, wherever healthcare is socialised, banning smoking makes sense.

But i think as a society if we see certain products are harmful to individuals(even adults) then I think the society has the right to implement strategies to reduce the use of it. Ofcourse it has to be a multi pronged approach Like in the example of food & soda. Making burger & soda more expensive, limiting the maximum size of a soda bottle/cup you can get. At the same time making healthier food & drinks cheap ( by reducing taxes on them etc). Also trying to find ways to introduce to the public other healthy tasty options ( probably incentivizing all fast food/ restaurants to have those options on the menu). I am from India, there lots of very tasty Indian vegetable dishes. Ofcourse I love going to many fast food restaurants too (Panda express is my guilty pleasure LOL). But I think having those other TASTY healthy options really helps me stay off fastfood & soda most of the time. Maybe I havent tried many restaurants here in the US but I feel every restaurant I go to its the same exact thing...some type of burger fries etc.

Californian here. I am 100% with Kyle on this one. It should not be the government's responsibility to tell grown adults what they can or cannot do _for their own safety._ That goes for _all_ drugs, as well as other things like seatbelt laws. I have a principled stance that if the government is trying to protect you from YOURSELF, it has overstepped its authority. I reject this nanny state garbage, and voted against the ban.

I agree with Kyle. As a California native, I was LIVID when this stupid measure passed. The argument that it is because the tobacco product is flavored that it appeals to kids is incredibly shaky. We don’t apply the same argument to flavored alcohol and underage drinking continues to be a problem throughout the state. I understand that from a legal perspective, it is what it is and the voters have spoken. But for me, it just serves as another highlight to why I’m becoming more and more fed up with the California voter base that is so easily influenced by arguments that appeal to emotion by injecting kids into the conversation. Like Kyle said, if you truly cared about kids, you’d make it harder for kids to buy these products, not adults.

As a Californian, I have to mention that the phrasing on the ballot was so misleading that everyone I know thought they were voting AGAINST the ban. I don't think such a majority of Californians would naturally be in favor of banning that type of freedom for adults. We should honestly hold a new vote.

This is the first I've heard Kyle argue the drug issue (or the personal product issue) as a rights issue. I've always been coming from that position. If you can't easily make it yourself, - and there is a demand to be served in the adult market - then the freedom should not be denied by any public consensus. It's a private issue - best kept among the private interested parties. Are the flavored tobacco products also banned from online sales to age verified adults within the state of California - and shipping to the state?

The will of the people is irrelevant when backing the will of the people involves violating someone else's rights. If the will of the people states that we should illegally invade other countries, that doesn't mean it's a good thing. If the will of the people decides that we should bring back slavery or ban interracial marriage, that doesn't mean the people have a right to make that decision. A good rule of thumb for me for ballot initiatives is the language. If the language revolves around introducing and easing access and rights without stepping on the rights of others, I see it as legitimate while anything that restricts the behavior of consenting adults is illegitimate

I absolutely hate the smell of flavored e cigarettes. It makes me wanna barf. But obviously I’m not for banning them

I’m with Dicky McGeezacks on this one. You can’t out right ban it. but make it super difficult for kids to get it.

They should ban cigarettes because they are objectively garbage for you, and they cause a lot of litter. If you’re going to have tobacco products it should be straight pipe tobacco or cigars, and they should be regulated to have good standards for the product.

I've never smoked a single puff of a cigarette, but kindly, please fuck off, you don't get to tell people what is "objectively garbage" for them. Some people have decided that it makes their lives more happy to smoke cigarettes than to not smoke them and live 5 years longer, if to someone the experience of smoking cigarettes is more worth it than the extra time alive they'd have, who are you to tell them they'd be better off not smoking? Also lots of products cause litter, that's why the government pays for people to clean that stuff up. People in Amsterdam smoke quite a lot too, yet their streets are completely clean. If your city's streets are unclean, that's a government issue.

Not sure if this was considered but flavored e-cigs/vape products help people quit. Especially when used in conjunction with chantix. The chantix makes tobacco products taste bad. Then you start vaping non tobacco or menthol flavors so that you remove the actual burning and instead vape. Then over time you reduce the strength of the nicotine. It took me around a year to quit but I managed it and I’ve been clean off tobacco since 2013. Just saying and hope they think before they legislate.

I used chantix before and it worked great for me (because I never remember my dreams).. sucks they took it off the market but if it was making people hurt themselves I 100% get it

If you follow the logic of banning flavored cigarettes, then you should be in favor of banning weed edibles.
