You know the worst thing about looking for a new job as a result of being bullied at your current one? It's the fact that your potential next employer will ask you why you're leaving job and will speak to your employer as well which means that if they're bullies as well they're likely to turn you down while giving you a shit excuse and you'll be trapped in unemployment. It's a shit chain you can only get out of by starting your own business

This is becoming more and more common with no fair solutions. 9 times out of ten the management would take the side of the bullies. This is why I believe the job market is no longer sustainable. But in the end, the bullies will be the downfall of the corporation with incompetence and bad service after they drive out the good workers.

And I am of course having to go find another job, even though now I apparently have problems. Now given, I was abused and bullied for years. Not just mild bullying. But, it's hard. I have been bullied since October. I went to my HR who said I was just being paranoid. I took this to heart. The bullying carried on and got worse over time. To the point in a meeting in HR office (about something else). When one of the bullies rip into me about my work. The HR manage just sat and watched, then piping in how she could find me more things to do. Then when I had to collect a key from HR manager, a few days later. She was totally sarcastic to me. That was the final straw. I found a new job, they asked for reference from the so called company before I had handed in my notice. The next day my job was up, being advertised for replacing me. Even though I had not handed notice because not had job offer. I have only 3 weeks left there but lots of staff are just blanking me. Complained to the union who were afraid of the company and they suggested I take it to an outside agency (unnamed). The worst thing is that the bully isn't even our company's employee but boss's other company employee. She shares a office with me and my colleague. I don't know for what reason but my colleague joined her. Today they basically accused of stealing, saying I can't be alone in the office cause I might steal, so one of them always have to be there with me to watch me. I've never stolen a thing. They also keep destroying my work tools and papers. And of course insulting me is a daily routine. I'm thinking about quitting because I have no other choice. I haven't reported it yet cause I know it's useless. The management doesn't care.

I was supported in filing an investigation and it took 6 months. Eventual outcome was that it was not a case where disciplinary action could be done but it did stop the behavior. I still work with that bully and if another incident flares up, i wont hesitate to raise the alarm again. My boss did compliment me for bravery in formally complianing. My message is this.....please say something and report. Think about all the other people affected. Because its usually not just one person targeted. We have to stop this bottoms up, as a collective.

My client is on minimum wage and works in a school kitchen for 35 hours/week, employed by a contract company. She and 5 colleagues were called to a meeting where one staff member was publicly dismissed on grounds of redundancy and the rest were all asked to sign a contract for 25 hours there and then. Due to the intimidation and bullying atmosphere of that scenario they all signed , then realised they cannot live on that income. Any suggestions to add to what I have sent in response please? see below: -- These are bullying tactics (no other word for it) of your employer. It is a recognised but unprofessional method to pick on one person in public in order to scare the rest into submission. As an adviser, I can be almost 100% sure that the person picked on had less than 2 years service with the employer, because anyone who is dismissed needs 2 years service in order to make a complaint of unfair dismissal. Which brings me on to this: - for your group of 6 please list (with their initials if they are not also our direct clients): each person's start date of employment. It will be on the front of their contracts if you were all issued with one. - The next piece of advice is very important to distinguish between those who have and those who have not had 2 years, and I suggest you each make your own minds up. Any action carries something of a risk to the employment, and employers often take the calculated gamble that some people may resign (they might want that) or claim unfair dismissal. - By cutting your hours and getting your agreed signatures it does on the face of it make it very difficult to claim that you are not being treated in accordance with your contract, because you signed. However the forced signatures with the threat of redundancy if you didn't, put it in a different light. - As I understand the meeting where you were bullied was in the half term, it might be seen that you waited too long to make a fuss. If there is a serious problem which goes to the heart of the contract there should be an immediate response. I note that you have been in correspondence with HR. The dates of that correspondence will probably show that you did not wait long. The other aspect is of course the impact on your earnings. > Do you get paid monthly or at other intervals (weekly/fortnightly/4-weekly etc?). - From what date did the new hours take effect? Can you send me: > a copy of the agreement you signed and your original contract? Are the contracts for the others all the same? > a copy of the correspondence (probably emails) with HR? > What date was the meeting where you signed the change? - I can draft something which you and your colleagues can sign and send to HR if you are all in agreement. Please ensure that all of them know the risk to being dismissed especially for those with no ability to make an unfair dismissal claim (less than 2 years service). It is called an official grievance, and you should look at your contract and/or company handbook or similar if you have one, and read what it says about who to put a grievance to. If in doubt, send it to HR to the person you have been dealing with. - It will say something like On receipt of a grievance the company is supposed to arrange a formal grievance meeting (see the process in your contract or handbook). You can also check the ACAS guidance to grievance procedures: www.acas.org.uk/grievance-procedure-step-by-step After a grievance meeting the company is supposed to then give its decision on your grievance. They can either accept it, propose a compromise or reject it. If you do not get out of it what you asked, you will at that stage each have to consider the options: putting up with the situation; looking for other work; or resigning in response and if possible claiming 'Constructive' unfair dismissal. I would have to give further advice at that stage for you to know what the implications and potential benefits and problems of that action might be. DANGER: As above, there is a risk of being dismissed. Or they might pick on one/some of you to dismiss for reasons whatever they can find which they will of course say is not linked to this, even for those with long service. ADVANTAGE: Sticking together of course has the benefit that you are a group affected by the same issue. Are there any other employees not part of your group of 6? best wishes Gillian Employment Caseworker

I was told by a solicitor that there is no such thing as bullying and any claim has to be related to a protected characteristic. Was this incorrect? Can you bring a constructive dismissal claim for bullying not related to a protected characteristic?
@DanielBarnettLaw
3 жыл бұрын
Yes, you can bring a constructive dismissal claim for bullying which is not related to a protected characteristic, if the bullying is serious enough to breach the implied term of trust and confidence and if you've got at least two years' employment behind you.

There may be a misunderstanding there in the original conversation with the lawyer. There IS no law against bullying per se. Remedy is achieved through equality legislation for discriminatory bullying or health and safety legislation. Constructive dismissal is often overlooked because of the risks involved. As Daniel said in the video, if you lose, you've just walked out of a job. However, if the situation is intolerable, it may be the only solution.

Hi everyone, I have a question and just want your opinion from if possible Daniel and anyone else feel free to comment. I feel that this statement is discriminatory, “If you aren’t happy or don’t like this place, stop doing your current job (I am a supervisor), if you want leave” - from my manager. Now this is where I struggle to understand because I am disabled which they know I declared it, I have Asperger’s and other mental health issues. Now I understand to a point, if I come across rude or negative because that is how I am sometimes without knowing, I don’t pay attention to social cues as good, don’t understand when I annoy people etc. But essentially what they are saying, if you are struggling with your disability which I have good days and bad as we all do, rather than going how can we support you, they did ask if there is anything wrong which I didn’t comment because they are several things which are poorly managed, and I would of put it across in a inappropriate way the way I was feeling. But I feel that is discriminatory, just want Daniel’s opinion and anyones really. I am apart of a trade union.

I have issues seeing things for what they are... once I realize who the bullies are its hard for me to just ignore... that being said its managers, board members, coworkers and its very sad. because it puts you in a place that will garuntee retaliation from the bullies. when you stick up for whats right you either come out on top or they gang on you. so what do you do? I am dealing with an insane amount of stress. I don't like bullies and I don't like "letting" it slide. if I wanted I could probably get the place in alot of legal trouble.. but then you got a whole new series of stress which I've experienced because I. ever hesitate sticking up for what's right. I know its not my job but as a man I can't just be ok with certain things..

Just thought I'd point out that the two-year qualifying period is only applicable to a constructive unfair dismissal claim. A constructive dismissal wrongful dismissal claim may be brought for notice rights. Although touched upon, it is often tha case that employees allege bullying because they either cannot or are reluctant to obey reasonable and lawful orders. Often, such allegations are used as a vehicle for attacking a colleague or manager who is holding the employee to proper account.

I got a solution learn martial arts like Jujitsu, kick boxing and a gun license just in case things get real serious ,Then when the bully antagonize or starts talking down on you and disrespecting you( stand your ground) if it get physical then use you self defense skills show him/her who is boss, if that person do not stop , and it get way more serious then you have a weapon to protect yourself and family.

Grow up! This is a serious subject not something out of the movies. Threatening people or violence towards individuals can carry up to three years in a UK prison, carring a Fire Arm in the UK without a licence can carry a life sentence in prison.

bit misleading he starts of with the equality act saying that harassment is illegal...that is only if its a protective characteristic which means it does not apply to most people...ITs politically correct protection basically...so if it racism, sexism, religion, sexuality etc....which will only be 1 percent of workplace bullying...very diasspointed that he made out its for everyone and its not...there are virtually no laws to protect from bullying and harassment Yes there are some but most people lose..The legal profession are never practical of give good solid info...WHY they make lots of money from doing the opposite so they get the work.

Sandra I am praying 🙏🏾 for you, the environment that you are in is highly toxic & is very unhealthy. If what they are saying & doing is creating thoughts of you hurting yourself, it’s time to get HELP! You need to take action immediately & talk to someone that is unbiased about your status & that can direct you to the proper resources for work related bullying. Please hang in there & get the help that you both need & deserve. If the quickest resolve to preserve the quality of your life is just quitting then leave. There will be other doors that open just like that one did. You are valuable & know one has the right to bully you. Please seek help bc it doesn’t get better with those type of individuals. 🙏🏾

I'm from Canada. What is your advice? Same here being bullied, mobbed, gaslighting, harassed at the hospital for over 12 years. I've happened to be the top worker for 38 years and have never been suspended. These bullies are jealous and miserable people. Union, manager, HR and the police are all totally useless. Bullies are lazy bums and stupid managers are scared of the bullies. They say about me I'm crazy, I drink, I'm a stalker all bs defamation of character. The biggest mistake since they removed disciplinary measures. They should arrest the bullies and fire the manager. Action speaks louder than nasty words. It destroyed my reputation. I will never quit to make these lazy bums ever win. If I decide to transfer to another hospital and may start mobbing me once again, I don't know all the new managers etc. like in every department like now. So best to not change hospitals. I will never let bullies try to control me from quitting. Never let these low life lazy bums win ever win.w

Hi Daniel, have you heard the term I will golliwog up with blank later. I received an email with this communication in it , which I find very desressfull . A second email was received 2 minutes later with no apologie in relation to the first email. Now I truly believe this was not a typo error. I have made my reservations known to my employer, what action are they likely to take? The email came from a work colleague.
