What I am amazed is how they get police to act so quickly. I’ve heard so many stories of other car rental places, or private citizens who loan their car out and not have it returned. Being told by police “good luck not our problem it’s a civil matter go to court there isn’t much we can do for you”

@Jacob Take this with a grain of salt, because I am neither a lawyer, nor even well versed in American law as a layman, but from the perspective of the average Hertz employee, there was nothing wrong to the police report. They didn't lie, they just saw that their system didn't show any rental for that car from that person. That said, this is the point where higher ups and managers should be held personally accountable - they are getting paid the big bucks to take responsibility, yet when shit like this happens, everybody just goes "Oh, it's a software error. Nothing anyone could have done..." And that's simply disingenuous, because there is stuff that can be done to make sure your basic company software works. And these managers failed to implement measures to catch this sort of shit, so they should be held accountable for the actions of the company they were managing (or apparently not managing).

I did autoglass for 35yrs from Pennsylvania to Florida / Chicago to Texas. I managed stores, opened new markets and was always selling. Three times I was forced by the companies to do Hertz glass work. All three times I was accused of creating damage to their vehicles and not making known to them. All three times I had video evidence of no damage prior to beginning the work by recording with the damaged glass still in the car. All three times they sued. All three times we insisted on discovery and depositions. All three times they dropped out.

Rental companies always buy the cheapest cars they can get their hands on, sometimes from the factory, and they try to get them on expedited basis, so the paint chips off, interiors are worse because they don't apply any protective coating, and their mechanics have a minimal amount of time to check over hundreds of cars constantly going in and out of the lot. Never let a rental company try to pin any of that nonsense on you.

The boy that cried wolf doesn't apply in police text books. Even for swatting, where police killed innocent people under false pretense from fake phone calls. Even in the present they come in force at locations that are known to be youtube streamers. So, ok, first time you go and search the place and find out is a streamer, literally during their live scene. But there should not ever be a second time or hell a third time where you go to the same bloody address and demand to see inside because some caller. That is clearly a fake call and police should 1. stop going there and 2 find those callers and send those to jail for +10 years and pay up all the costs for dispatching emergency crews.

It’s about cash flow and illicit profits. Sounds like employees are incentivized in ways that enable the C-suite to write off certain fake “losses” to reduce taxes, etc. Similar thing by gyms/fitness centers around forgeries, etc.

@@ED-es2qv I work at hertz. I can tell you they are very strict on things like this. We usually don't charge customers for minor damage or smoking in vehicles, or trashing vehicles because they don't want the bad PR "plus managers don't want to deal with angry customers and calls from corporate. The issue with people being arrested while in a legit rental is because hertz runs a bare bones crew. So the csr's renting cars are always slammed with customers. So they forgot or improperly close contracts causing them to not get assigned or multiple contacts stay open for the same vehicle. Hertz needs go out of business, they are a horrible company to work for.

Here’s a policy for ya Hertz: if any employee calls the cops on someone without first checking if they have a rental agreement, they will be fired immediately. If any manager has an employee do this and doesn’t fire them immediately, the manager will be fired immediately and then the employee will too.

It's happened too many times for this to be the fault of individual employees and not either company policy or a systemic company failure. Hertz settled 36 lawsuits this year alone, there are almost 50 in the class action, and many more suing independently, attorney general investigations have happened in multiple states, and this has been going on since at least the early 2000's.

The customer would extend the rental but the person wouldn’t put it in the computer correctly or at all. 🤦🏽♀️ luckily one person had a text between them and and the employee about extending the rental. Imagine if u did it over the phone like most of us do.

This happens all the time. So why is it now somehow criminal when its a company? You didn't break in and steal their car. It's a contract dispute.

@@ralphmtsu In some states if fines aren't paid the plates can't be renewed, so that could hurt hertz. The problem is that the ticket would go on an individual's driving record so ignoring it is still bad. Instead the best move is to go to court with a copy of the rental agreement and make an affirmative defense asserting that while it did happen you aren't the responsible party. Some states don't allow an affirmative defense for such so if that's rejected you sue hertz for the money you had to pay in small claims court then add on a lump of money for the distress of dealing with their legal problems. They'd eventually have to pay.

In most places, a complainant can't drop felony charges. That's up to the government. Once somebody is charged with a felony, the party that reported the crime doesn't get to decide to file or to drop charges.

I mean it's not like people don't those things break just by looking at them. Only thing that I've seen with the worse build quality is Teslas. Every three years in Germany your car has to be re-inspect and 10% of 3-year-old teslas fail to do to things like missing bolts from the factory on suspension parts.

Iam 67 & back in 2018, I wanted to rent a car from a rental car company Royal Rent A Car based in Sacramento CA & it was my first time renting a car & I was 62 at that time!! They told me to go to Avis & like "WTH", I was shocked & insulted & boy I let them know about it, but it was like "water on a duck's back" to them!! They were sooo "non-chelant" & "we don't care" & "value you as a customer".

I rented a car from AVIS during my last visit to Washington state. Five weeks after I returned the vehicle Sedgwick sent me a claims letter stating I owed over $23,000 because the vehicle was stolen while in my possession. I talked to a rep on the phone and said it wasn't stolen and I can send them the receipt I was given after I dropped off the vehicle at SEATAC which shows the mileage, date of return etc... He said they had that already. I asked how was it stolen from me when we all had a receipt that was only issued after I dropped it off. Rep said he'd ask his superior. Couple of weeks later they sent me a letter saying the case has been "closed".

Last year I went back home to Chicago to visit family & I usually Enterprise is my first option then Budget. However rentals were so crazy high last year I went through Hotwire & the rental was from Hertz. I hadn't heard of any of the issues they've been having but I have to say it was the strangest car rental experience I've ever had. When I went to pick up the car and showed someone the rental agreement they just told me to pick a car and when I went to leave there wasn't anyone to make sure I was in the right car for what I rented. Then when I returned the car there wasn't anyone to actually turn it in to and when I finally found some one they said to park it & leave the keys. If I didn't have a flight to catch I would've just waited for someone. I did however make sure to take pictures of the car, where I left the keys, the license plate, the vin & exactly where it was parked just in case. After hearing all of these horror stories I feel like I was lucky & will never choose Hertz.

It's a fact that extreme stress can cause spontaneous abortion (miscarriage) in pregnant women. This poor lady. I have no doubt that this has cast a dark shadow over the rest of her life, and really fkd her head up. I think a large rich law firm should sue the living crap out of Hertz and everyone involved in the "chain" of criminal law enforcement that act as their attack dogs.

She is suing for that. Although there could be a question of Hertz's liability for it. Since that was a subsequent arrest. Although it wouldn't have happened if they had never filed the false police report, and it wouldn't have happened, if they had withdrawn the false charges.

I had a rental this summer. I checked and double checked the plate and vin while mentioning I've seen these videos. I went around it recording condition, plates and vin. I made damn sure I documented everything and that the employee knew what I was doing.

I used to `be an Area Field Manager for U-Haul, and later a District Manager for JarTran Truck and Trailer rentals. There were times when I called the police to help me retrieve stolen equipment. The police always said it was a civil matter and there was nothing they could do.

@@Maximara That depends on what he meant by “stolen”. Did they call the cops because someone was a few hours or a day late returning a rental or was it trucks kept for weeks or months past the rental date and the person completely ghosted? The former is absolutely a civil matter.

That’s because it’s not stolen if you allow someone to have something for a specific timeframe, and they just fail to return it within that time period. The word for that is called “conversion” and it’s a lot harder to prove, even though it’s a civil matter with a lower burden of proof.

I'm pretty sure it is the fault of the police when they keep arresting her for the same thing - though maybe the subsequent arrests were for failing to appear. Either way, sue the cops / justice system too - it's all taxpayer money that pays out those lawsuits, and taxpayers have lots of cash. Might as well collect if you can.

I’ve never rented from Hertz, but I have needed to extend a rental agreement beyond the original terms. Contacted Enterprise and told them what was going on (family member passed away). They were extremely polite and respectful and extended the rental with no issues, so I’m not sure how even this would be a problem as long as you’re communicating.

Sometimes they communicate with you, but don't communicate with other employees or the police. The company can go "oh, you're right, that's not stolen" but fail to call the police to get their stolen vehicle report rescinded. Or even if they do have the local police remove the listing, the local police could fail to get it removed from a state or nationwide system and then police in a different town arrest someone for it.

There needs to be some kind of dark comedy satire, maybe a Saturday Night Live skit or South Park episode where a car rental place is doing an add on television and they are bragging about how rarely they by mistake have people who rent their cars arrested for theft. The guy advertising their fictional car rental agency might say something like "We have had less than half as many unlawful arrests than Hertz and unlike Hertz we make an effort to compensate our wrongful arrest victims".

@@Omniseed Nah. If cops get a report of stolen from the vehicle owner, then the car is stolen. There isn't really any way to "prove" the car was stolen, so they have to taken them at their word. The City, maybe for failure to notify of the court dates, but again bench warrant issued, the cops were just doing their job.

The thought of of the rental agreement kept coming up in other comments and there was mention of other cases where people *did* produce the rental agreement and *still* got arrested.

That's my guess. Most rental companies are self-insured, but I'm sure there's a financial accounting benefit on their balance sheet that they can take advantage of the moment they report the car as stolen. The only thing a company likes more than making money is shuffling paper around to make it look like they're making money.

It's all about the non sense he stated. As a former police officer, I would never arrest someone with the proper paper work for a car rental if the car was reported stolen way before, recovered and gave back to the legetimate owner without removing it from the data base. Also, I would had no problem at all declare a car stolen from the word of one party, as a matter of fact, I did it many many times.

Someone else mentioned they might be getting insurance on the "stolen" vehicles. Considering they've just pulled out of bankruptcy, I wouldn't be surprised if some of that was going on.

I rented a car from Hertz in the Netherlands and the rear tires where vibrating so bad the car could not be driven at highway speeds. Hertz called out AAA in the evening who came and checked the car and verified tires where bad. Next morning Hertz called and asked me to drive 50 miles away to a tire shop and wait for new tires to be fitted... I politely declined and eventually some poor employee had to bring a new car to my hotel on his way home from work.

Steve, the problem with proving the original reservation with Hertz is that the records of the reservation are held by Hertz - and they might just alter those records, given their behavior as reported in so many incidents. Hopefully the woman has some records of her own, such as an online reservation with an acknowledgement by email form Hertz?

About 10 years ago, I worked for a different rental car company as a college job. We would regularly get angry customers from Hertz who would rent from us after they either left them stranded, or otherwise inconvenienced them. Funny enough, we once had a car that was months overdue for being returned by the renter, I did a couple of "investigative drive by's" and if the car was there, they would call them again and tell them they would be coming to get it and that they would still need to pay the overdue balance (This was usually only done on cars that were 1+ month overdue for returning) . If they couldn't get the car, then they would call them several times over several days to tell them that they would be calling the police and reporting the car as stolen if they didn't hear back from them.

Another company to me is Royal rental Car out of Sacramento CA. They refused to let me rent a a car back in 2018 & it was my first time renting a car at 62 years of age & they were so non-chelant about it!! I tried to get a hold of corporate headquarters & they had no customer service or other phone numbers, no email address or mailing address on their web-site!! I WAS SOOO SHOCKED!!

Back in 2018, I tried to rent a car, a Chevy Spark for 2 days & from Royal Rental Car out of Sacramento CA. When I went to them, they refused to serve me & told me to go to Avis & this was my first time I tried to rent a car & I was 62 years of age then!! I was quite angry & "rubbed it in their faces" how insulted I was & I tried to call headquarters & I could not get through to complain to them!! That was a further insult & a slap in my face!!

That's so brazen on Hertz's part to try and muddy the waters by bringing up the idea that some of the claims were baseless. And the doubling down...why not drop the charges? I mean, are their records so poorly kept that they can't confirm that she legitimately rented the vehicle? (and was a platinum member?) Many years ago, I was on an afternoon plane flying out of Miami. We were a little late leaving, and the last guy to make it on had been running to make the flight, and he was not a young man. He was visibly glad to be leaving the area, and was perspiring profusely. I asked him what had happened and he told me this. When he drove in to the Hertz place near the airport (I believe that's correct, but it was 30 years ago) to turn his rental car, and he was surprised to hearbsirens and see the police arriving right behind him - then he looked up and bodies were everywhere. A gunman had apparently just come in and shot all of the employees (and others) dead, then left. My seat mate's problem was that there was no one there to turn the car into and because he was one of the first witnesses on the scene, he had to give the police a statement, causing him to miss his scheduled flight. The airline was notified and held our flight for a few minutes to help him get home. Whether it was a disgruntled customer, or an armed robber, I never found out, but my seat mate was very happy to have missed the shoot-out and to have proof he had turned his car in.

I find it amazing that the fact someone from the rental agency checks your ID against the reservation before either handing you the keys or letting you out of the lot of the keys were already in it proof that Hertz is knowingly and willingly filing false reports.

At Hertz if you're a Gold Member (at some airports) you don't go to the counter, you walk out to where the cars are, you pick your car from the area that corresponds to your reservation and then you drive it to the exit to the garage and they match the vehicle you took to your reservation. The keys are in the vehicles.

Years ago, Hertz was my go to for car rental. Today, I will walk before I rent from them again. I'm not sure ANYTHING they do could ever win back my business.

I am right there with you. I never rented from anyone else - helped that if you were a Ford shareholder, you got a small discount. I won't go near them now. I was using Avis, but they just charged me $350 to clean the interior of their car which I left practically spotless to begin with.

At what point does the local police department become culpable for these arrests, especially given that Hertz's CEO has publicly admitted they have had many people falsely arrested??

On the topic of "culpable" whenever you have police arrest someone there is a chance of a cop with a slippery trigger finger KILLING the person, they have GUNS DRAWN. Sooner or later someone (likely a young black man) will get KILLED because of Hertz.
