YES I do not understand why the judge went ahead. How can the victim be there responsible for "prosecuting the case" and trying to give the judge the information he needed. The judge was in the wrong here - exceptionally. Why did he not delay this. Punishing the victim for being angry that this POS was going to get no punishment when she is going through horrible consequences of his crime. The defendant had a polite lawyer the judge likes and the victim had NOBODY. So she swore, big deal. I have seen Middleton put up with far worse attitudes and SHE is not on trial.

In some sick way, I almost wish it were that motivated. The Prosecutor's office seemingly did nothing. There wasn't any clear sign of a thorough investigation into what happened. When Judge Middleton says, on the record in open court, that he has literally no access to any of the reports or findings from any prosecutorial body or its representatives, that's trouble.

Let me throw an alternate theory with just as much evidence. Given he was only charged with leaving the scene, plus her shitty behaviour and attitude, maybe the prosecution was sick of telling her he wasn't the only person to blame, and the charges did fit the circumstance.

But, you know -- I wasn't there. They both have local counsel for separate actions. I think it goes far beyond beyond the usual pro se mud-slinging. I don't know what, but I wish them the best in resolving... whatever it is. Those are all fair points.

@@Lindon_Martingale In the previous hearing, there was a strong implication that she was trying to blame an unrelated health issue on the accident (I think it was like a broken back or something). The defendant readily admitted he hit her and fled, but maintained she ran out in front of his car intentionally and that he didn't think he hit her hard enough to cause the injuries she was claiming. So, the whole fact pattern was pretty fishy. And now you add in her histrionics and her refusal to listen to reason and I can see why there'd be some doubt to the legitimacy of her claims.

Exactly.. but he was right about nothing being enough for her. She was out for blood basically. And yes, it’s understandable. But having that much animosity and bitterness built up inside her does nothing to help her cause. Even though Judge Middleton explained this to her, she still wasn’t listening to him. And she was most definitely inappropriate and disrespectful to the court. That’s not the place to pop off and keep doing it. I know Judge really did not want to put her in contempt. That was the last thing he wanted to do. It’s obvious. But he’s just not going to let people continue to run over him or disrespect his court. It’s a shame all around honestly. She really needs some healing and peace. I know how hard that can be considering the circumstances and the amount of pain she experiences daily. But even still, you can find peace and healing through pain and hardships. If anything, that’s the best time to really find that path because it helps you through to the other side. I feel sorry for her in a way. But she also needs to learn some respect.

Ohhhh okay. I understand that point. I honestly don’t blame her for being upset. If I were in her shoes, I think I would feel the same way she did. And then the guy laughs at the end. He may have gotten off without much punishment from the court, but karma will get him. (Mike, we have a no fault law for auto accident related injuries as well. A whopping $10K).

I'm a victim of a drunk driver at age 30 , I'm now 62. I was left for dead too. It's been a very chronic pain filled life. I understand her anger.... when your entire life is now turned to sh!t & everyday you Are in pain its hard. She'll become less angry overtime I hope. She needs to just go scream at the top of her lungs out in the universe. Just try & get rid of it because if you don't it will eat you alive! And watch LTWM with all the great other people that do. ✌️💙

Agreed, I feel so bad for her (and both of you). But it is an easier weight to bear if you ever feel that righteous outrage from someone who can do something fights for you; this woman got nothing but a remorseless defendant and an absent DA. Although her behaviour wasn't ideal, I get her anger, she was the one who didn't have a choice in the incident. I hope Debbie will fight for victims, as she always has, so that they know they are valued and cared about.

This woman just got screwed over again. She has had no justice at all. This is not the first time we have seen Middleton go really easy on drivers with no license or drunk. He should’ve gotten the maximum jail time. And why on earth would he allow him to have work release and do weekends? Middleton is losing it. He is angry at a woman who is very much justified in her anger instead of at the perpetrator, who basically has destroyed her life. This is a terrible outcome.

Problem is that the breathalyzer was given 3 hours afterwards - you can’t prove he was drunk at the time of the incident. The real issue is that her former employer decided to fire her and haven’t fired him. With him potentially drinking on the job, driving without a license, and being involved in this situation.

That was disrespectful to the victim. His comments about how at least he didn't leave her alone in an isolated area or that the defendant couldn't know the nature of her injuries shows a bias toward the defendant. He could have given him a slightly longer sentence. Let's face it he charged her with contempt because she called him out on a bs sentence. So he punished her for it.

How could this even proceed without the prosecutor there? She had no one to represent her and fight for her cause. I think that's reprehensible. As well Middleton's sentence was an absolute farce. The prosecutor dropped the ball all the way through by not investigating/charging properly and then not showing up for sentencing. This poor woman got f**ked over by Michigan court system. I understand she can't swear at the court, but she was left to fight on her own behalf AGAIN due to the prosecutor NOT showing up. Michigan Court should be ashamed over this one. It shouldn't even have proceeded after the prosecutor was a no show.

This wasn’t being tried, it’s sentencing. Yes, the prosecutor should have been there, but she’s not prosecuting the case, she’s arguing for sentence and isn’t qualified to do so. Middleton is one of the best judges on the bench. If the prosecutor was needed he would have delayed this but dragging out a misdemeanor becomes a burden on the system. I understand why she’s mad but this is by no means a miscarriage of justice.

@@Mewse1203 I didn’t mean the entire proceeding, I meant the prosecutor not being present was not a miscarriage. However, I’m certain this woman was present through the criminal process, and I’m certain she has her own attorney since there was a civil case. She had ample opportunity to review what the prosecutor was doing. Addressing all of this at the sentencing is not where the problem lies and Mike is correct, the judge did everything he could with the charges presented to him so no, Middleton was not the problem here. The problem lies solely with the prosecution and this woman’s inability to manage her emotions.

@@HellenaHanbasquetI would love to see how well you handle your emotions when someone runs you over and blames you for it, and then you sit through a sentencing where the judge makes excuses for the perpetrator (who again shows no remorse), and then gives him a super light sentence because he “doesn’t want him to lose HIS job.” The victim then justifiably says it’s bullshit and she is taken to jail in front of the man who just got a super lenient sentence. It’s such a slap in the f’king face. The whole thing. I’d like to see you do a better job in the face of such injustice. Justice was NOT done here. The villain won.

He said that to explain why he cannot go with the „intent-to kill“ guidelines, comparing her case with the case of somebody left in a ditch to die. Context matters! At the same time, his tone was off, and he could have taken a moment longer to explain the comparison.

I don’t care for the way the Judge handled the victim. I know this is a plea deal, but there wasn’t any justice in this case. Judge Middleton is a very lenient judge. I don’t agree with a lot of his rulings. He was harder on the victim than on most of the defendants. I enjoy his stories, but not in the middle of a sentence or trial. Especially when someone has been hurt severely.

Ms. Davis did well as an Assistant DA when Mr. Marvin was radio silent for weeks (sometimes months) at a time. The voters made it known that she has the support of the people. Popular support opens the "purse" of the budget. After all, career politicians win or lose on press. Debbie Davis is a blue chip investment for prosecutorial reform. Her model could spread to other counties, even other states. Maybe Fulton County and the City of St. Louis take some lessons. It could happen.

@ConMetalFan judges have to also follow sentencing guidelines. The fact that the only thing on his criminal record was to DWI's from the late 90's is what made this a probation only case. Pretty sure even if this was charged appropriately it probably still would have been a probation only case only with more significant consequences if he violates.

I'm sorry, normally I like this judge, but he should be ashamed of his actions in this ruling. The guy who ruined her life with his criminal activity, gets 10, easy days. Days he's even allowed to do work release on? That's garbage. Then, the poor lady has to act as the prosecutor and try to argue her own case, in a serious injury case, where the prosecution should have been the one to do it. Then, when the judge hands down the cotton candy punishment she gets reasonably mad, doesn't have the representation she should have had, and fires back, she gets a day in jail. Meanwhile the guy that commits a felony, but is charged as a misdemeanor, as the judge pointed out, gets 10 days? So nearly killing her, running from the scene, causing her to lose her job, keeping his, and giving some BS sob story about how it's affecting him, gets 10 days, served when he wants, hell, even do work release if you'd like. That was a serious miscarriage of justice, and maybe judge Middleton needs to retire, since his judgment is clearly compromised. He should have had the decency to have let her keep going after he just basically let the guy that nearly killed her go with barely more than a warning. I don't want you to lose your job, you don't need to pay a fine, here's 10 days to serve, if you feel like it, you can do weekends, or work release, whatever works best for you... Yeah, that's garbage, then, goes heavy handed on the lady he just shit on. Normally, I'd be all for this judge, but man, that was a dirty thing to do, and he should consider hanging it up. This is just shameful.

What most people are not hearing is that they didn’t find the driver until hours later and they can’t prove that there was alcohol in his system when the accident occurred. There was a case in NYC when a subway train conductor crashed into another train. Instead of staying at the scene the conductor was found in a bar drinking. Most likely they were both drinking, it can’t be proved.

@@Mewse1203 I agree that he should have been charged at the higher level, I think even Middleton would have agreed, I think when there is a guilty plea you can’t just throw out the lesser charge and add to a higher level. Middleton had to acknowledge that the guy had no record for 30 years.

Doesn't matter if he was drinking or not. He didn't have a valid license and he hit a whole person and left her to potentially die. I'd argue it's worse if he was clear headed and chose to do that.

The lady doesn't understand what "on purpose" means. The intentional drinking doesn't mean intentional hitting. Also, unfortunately if nobody was there for a long time, he can claim that he drank after the accident 🤷♂️ and judges have to rule based on provable facts, not gut feelings, albeit strong

Middleton looks pissed over her lawyer filing the emergency stay. I don't blame him. It is absolutely ridiculous the way people are so disrespectful in court and to law enforcement. I don't understand this victim mentality that has taken over. And people in society absolutely do try to use their victimness as a weapon just like he said and it is a big part of what is destroying our society.

You are spot on!! It seems like there are way too many people who were never taught that there are consequences to every action you make. Good or bad. The choice is yours. Too many people have been coddled and catered to. And wayyy too many “aged children” running around terrorizing society with their demands and feelings. It’s shameful what society has become. Having said that, it makes me even more grateful for the time period I grew up in and all of the hard lessons I had to learn from. When you finally realize you’re not special, the world doesn’t owe you, everyone’s life is hard, youre responsible for yourself and your actions/decisions, and you’re only a “victim” if you choose not to be one..instead of being a “survivor” and using your struggles as strengths… that’s what being a responsible adult is all about. I feel bad she’s went through all of what she’s been through. But that doesn’t give her the right to be disrespectful to the court. Period.

Eh, it seems to me like that should be the standard before incarcerating someone on direct contempt, if there aren't exigent circumstances. Kick her out of the courtroom, and let another judge who wasn't there and wouldn't have any appearance of partiality hear the contempt allegation in another hearing. In this case she's clearly contemptuous, but then you have cases like the YSL trial where it took another judge hearing it to say "Actually, the judge was being inappropriate, contempt is purged and the judge is removed from the case." It would be a problem if the lawyer in that case had actually served jail time on the contempt before that ruling happened.

She should have been more respectful that is true, but Judge Middleton was out of line in his behavior toward her. He was condescending and disrespectful in his comments. His comments probably escalated her behavior because it was clear he was on the defendants side.

I suspect that this woman has been a problem employee for some time. She was likely cleared by her doctor and therefore was obligated to return to work. The fact that the union is not backing her position, says a lot.

You don't know why the union isn't backing her up. Don't make assumptions about unions. Some are really good and will even fight for a bad employee. I have seen a union fight for an employee that was violating policies and committing fraud and was terminated for it. But the union dragged out the fight for a year.

My comment on this and I certainly wish there would have been a prosecutor in the room. At first the defendant is stating I'm sorry for what happened I didn't mean for what happened I'm sorry for what happened to you. But then when she's speaking he goes back to what I assumed was his defense initially which was she ran into my car and and she really wasn't that hurt and it was more her fault than mine. It certainly cannot be both. Either he remains defiant that it wasn't his fault, or he's remorseful because it was his fault. Show to pretend to be remorseful so that the sentence will be lower is completely ruined and completely diluted by the fact that he's sitting in the courtroom continuing to deny that he's responsible for any part of what happened

It was absolutely shameful that Judge Middleton gave this hat of a rear end a slap on the wrist after he essentially thumbed his nose at this woman after he gave her life long, debilitating injuries. Any respect I ever had for him from watching his proceedings is 100% gone. I don’t care that she had outbursts. People that haven’t had debilitating back injuries don’t know the 24/7 suffering that one goes through. And to have a prosecutor utter FAIL to charge this man properly, and be so cowardly to not show up to support this woman is pathetic on a level that I’ve rarely seen. Had she been advocated for in any way whatsoever, she likely wouldn’t have had any reason to speak out the way she did. This was a failure of our judicial system on every level… and Judge Middleton was the coward who couldn’t make it right.

I’ve been the victim of an absolutely horrible injury accident that required the jaws of life and left me permanently disabled. The lawsuit resulted in a settlement that didn’t even cover my medical and vehicle. I lost my nursing career as the breadwinner in our family. I have absolute empathy for her. But you just can’t act like that. She needs therapy. She’s either a professional victim or hasn’t dealt with her trauma. I suspect she’s a professional victim based off of her demeanor and presentation. I had to start over from scratch, my degrees were worthless. I uprooted my entire life and turned it upside down myself because I wasn’t going to sit and cry in my cheerios. I’m actually more successful today than I was when I was working as a nurse. I won’t thank the ahole who hit me, but the accident was certainly a catalyst.

@@GoodnightJLH it’s more likely she would be able to get therapy. Mental health care is one thing that is within better reach to low/no income people than higher income brackets with the exception of massive inner city communities (LA, NYC etc) which is not the case here.

Absolutely not Judge Middleton’s fault but it’s crazy to me that you can hit a pedestrian and flee the scene without facing felony charges and significant jail time. Honest mistake or not, just leaving someone you’ve severely injured with your car is despicable.

Her Attorney needs to be sanctioned for not showing up to court. Not fair to their client! Should not have been charged as a misdemeanor, to me it should be a felony. The Prosecutor did that lady wrong, not following through or being in court. Mr. Smith is a jerk😡. His stupid evil comments are wrong. If she ran into the car, she would not have sustained such awful injuries. The fact he left the scene, to me, shows his guilt. If she ran into his car he would have stayed to report it. She is beyond wicked and pray Karma catches up to him. Do not blame Kim for being angry. She should not have been so confrontational either though. Kim should have learned to shut up.

I would probably not be calm either, but I understand why Middleton held her in contempt. If he is not consistent with his use of holding people in contempt, he opens himself and the court up to serious down the road. Saying that doesn't change the fact that she has every right to be in an absolute rage over how her life was torn apart by someone who was doing something they shouldn't be doing in the first place.

I used to work for commercial insurance companies that included writing commercial auto insurance in Michigan, and they do indeed have some strange laws, including a complex "no-fault" structure. This imo is a prime example of how ppl confuse justice with vindication. This lady wanted to feel vindicated, she's convinced herself that she was intentionally wronged- when the reality is, she was the victim of an unfortunate accident. The court is not here to vindicate you- the judge handled this correctly imo.

I was a paramedic from 1983-1989 - I left my license run out - but in 1986 I was hit by a drunk driver. The ambulance I was driving at the time was totaled and the car she was driving was also totaled so she wasn't able to leave the scene. Her can was one that belonged to a friend of hers and the owner had liability only on it and she didn't have a license herself due to multiple DUIs before this. I was nearly killed in the accident. I had hit my head on the windshield and in the process I sliced my eye on the little tab that turned on (and off) the spotlight and I hit the back of my head on the M size oxygen tank that was located behind the driver's seat when I was thrown back into the seat once the squad came to a halt. She also pushed the ambulance and her friend's car into the welcome to the city sign and destroyed it and the plot of land all around it. She did sprain her wrist but that was the only injury she received. To this day I have seizures and debilitating migraines as a result of the head injury. I also lost a great deal of vision in my left (injured) eye. The girl that hit me contacted her father, who was a fairly wealthy man in town, and he convinced her to not take an alcohol test so she didn't and afterwards when her dad got to the hospital to much time had passed to get an accurate breath test. Because she wasn't charged with DUI, she only received property damage and driving without a license and even tho that was a multiple offense, her dad basically bought the city off so she got away with everything. Her dad bought the EMS I worked for a new ambulance and paid back a big chunk of money to BWC but she essentially got off scot free. I can understand this girl's feelings in all this and not sure I could say she was wrong in any of this, other than cussing at Judge Middleton. One big thing that bothered me and I'm sure it bothered her too was he was given 10 days jail but he was allowed to choose when he wanted to complete those 10 days and she had to go do her 24 hours right then and there.

This case has been turned into an absolute sham, granted the defendant isn't helping himself by shooting off his mouth in front of the judge, all that did was to prove there's no remorse towards the victim and its sad that as the law states at this time can be only a misdemeanor, yes he took off, yes he didn't have a license then or ever for that matter. Society lately has become very cold when it comes to issues like this and chances are its not going to get better anytime soon, and why is her lawyer sitting in the back of the court? What does that say about him? Real support for your client there.

At first I felt sorry for her, but by the end I wanted her to be in for 24 hours for her immaturity. I personally hate DUI drivers, but that wasn’t this case. This is a problem because it’s entirely the fault of the prosecutor for being lazy and not doing their job. I’m surprised that he got any jail time at all. The defendant is a POS, but the victim has zero self control and actually comes off as pathetic and vindictive.

I am a wheelchair user who went into hospital able to walk and came out a wheelchair user. Initially I was so depressed I couldn't pursue a case (and uk so these things are less often pursued) by the time I got my life together too much time had passed. I really like LTWMs final words. We can decide not to be a victim, I have an amazing life by deciding not to be a victim. I love my life. sure i'd prefer being able to walk but I am not a victim.

This case should have been continued until the prosecution could attend. As “unjust” as the sentence was, the victim screwed herself out of a lot of compassion due to her disrespect of the court. You can’t sit there & say, “This is bullshit” while the judge imposes sentence.

At 42 (I'm now 75) I was paralyzed by a hit & run driver. 3 yrs ago, a 55 yr old relative was paralyzed during a church-sponsored post-hurricane community rebuilding project. This lady is walking unaided on two legs. None of us lost everything, tho it feels that way for a long time as we struggle to somehow rebalance our lives. The point I want to make is that this lady has poisoned her very soul all this time. I do feel for her but it's important she understand that the bitterness with which she's cloaked herself will destroy her and her children. We all have to find or create little miracles to help our healing. Of course her injuries are fairly recent but the state of her mind is her responsibility. It would be awesome for her children to observe and learn about handling a crisis. I wish the best for her and hope that her emotions and body begin to heal now.

This is a tough one. Where is the line between justice and retribution? There is a reason victims don't pass sentence but their voice does need to be heard. The prosecutor not showing up is very concerning.
