I was married for more than 10 years. As a full-time mother, I had no SS benefits. After inquiring at the Social Security Office in my area, I was advised if I could wait to take my ex-spousal SS benefits until the age of 70 years, I would be entitled to more funds. I later found out that this was not true. When claiming ex-spousal benefits the amount will be the same if you take Social Security benefits at 62 or at 70 years. With this wrong information, a person could lose a substantial amount of money if the person chose to wait until 70 thinking the benefit would be more, only to discover that they missed 8 years of benefits that cannot be retrieved. Always double check your information.

Married 14 years. divorced 20 years, our 26 y.o. daughter with Down Syndrome lives full-time with me (He has not bothered to keep in contact with either of our children for 20 years). I heard that my daughter and or I can receive additional SS from his SS account. I just turned 62, I have never remarried.

If the higher earner is six years younger than the ex spouse kin, the lower earner, who is older, take half of the Social Security of the younger spouse. If they have not reached a particular Social Security age qualifying for instance if they are still under 62. Do you have to wait for them to reach each qualifying age for you to take half of the amount of that qualifying age? Thank you.

My ex remarried 4 months before he passed away . We were married over 10 years before we divorced. I get his SS . The lady at the SS office told me that his wife of 4 months gets nothing . 😮 She said they had to be married at least 9 months in order for her to get a check . I felt bad for her , as we were friends and she really needed that check. 😢 They also said that if she had been eligible for a check , her and I would get the same amount .

If my ex got remarried in her late 30’s then was married for over 10 years to a deadbeat who didn’t work while living on my kids child support and settlement, can she still be getting half my ss benefits if she divorced the deadbeat before 60 even though they’re still living together and only divorced to collect ss from both their ex’s?

So there isn't any clause if you were not exactly 10 years. I have a friend that was married for 9 years and almost 11 months. They did not have any children. She's now 60 years old and disabled. She's not able to draw his SS?

I understand that there is pending legislation that will remove the spousal benefit in an effort to shore up the pending short fall of SSA if passed. Are you aware of this? and is it necessary to claim the benefit prior to any legislation that eliminates the spousal benefit? Thank you

I was married for 11years.Is a divorce decree of spousal support that is currently coming out of my paycheck, does that still come out of my Social Security check? I turn 62 tomorrow and am considering retiring early and working part time, but I can't do it if my spousal support is still valid. She has been drawing SSA since age 63, she is currently 72. Her benefit is way less than mine. If I draw ss benefits, and she claims my benefit, I'm wondering if that will satisfy the divorce decree of spousal support, or does SSA nullify the spousal support order?
