@@billkennedy9759 Yes definitely. But you still have to be careful though. For example, if a brand sponsors your video, it doesn't matter if there's a copyright claim on it. But if it gets blocked though the brand will probably ask for their money back.

Thanks for the info as it's still confusing because of the gray area involved but I did just recently get a couple of copyright strikes from FloSports due to track & field footage that I used in my video although it fell under fair use with just a little bit of the video shown while I did commentary over it. It's very confusing at times on what's acceptable.

Same here. Based on my understanding of how the process is truly working (and anyone who reads this can correct me) is that the YT algorithm doesn't detect fair use, it detects CID (content ID) and then it's up to you and the content's owner to dispute it. So, your video that is "fair use" will get claimed and then you have to dispute it as fair use and then the owner will take a look at it and say "yes or no" and if they say yes, your claim is removed. If they say no, you have to settle it in court and the courts are "holistic" meaning there is no clear cut yes or no, it may depend entirely on the judge (and of course your video). The bigger sports companies (NBA, UFC, NFL) have ample money to go to court, we little people do not, and are often scared off from disputing. At this moment, I am only a month into my channel and it's not worth disputing anything until I actually am part of the YT Partnership and monetized. Then, if I feel my videos are fair use, I will dispute every claim because fair use is OUR LEGAL RIGHT to use their content. It may not be fair, but it is what it is and I am not going to be shaken down. Cheers! BTW, I checked out your channel. Nice stuff man! Subbed, too

The girl is actually a KZitem employee and that video was from KZitem’s own creator channel. But more to the point, it is labeled CC (Creative Commons license) which grants anyone else permission to use the content.

When a video gets a copyright claim it stills remains on KZitem for you to watch. It just doesn't make any money through the KZitem partner program, Which is probably why the run promotions at the start to try and make money that way. As far as videos getting blocked, there's no way to know if a video will get blocked before it happens. Sometimes it never does, sometimes it happens 3 years down the line. But remember that all you see on KZitem are the videos that didn't get blocked. You don't see the millions that did.

So often times because I usually shoot games by myself I often times negate getting good establishing shots and considering shot variety during the game. Yes and no. You’ll need to transform the content a bit more than just adding commentary to qualify as fair use. But even then, you’ll get a copyright claim each time and will have to dispute it. Sometimes you might win and sometimes not.

Legally I think you should be fine but it’s just my opinion. And either way, keep in mind that if the copyrights owner decides to formally complain to KZitem, KZitem would takedown your videos and basically tell you to take the copyrights owner to court if you disagree.

No because, like it says in the video, it’s a court matter. So if you have a fair use disagreement with someone it’s ultimately up to a judge to decide who’s right. All I’m doing is helping you getting in a position where you would most likely win your argument in court but it doesn’t prevent all of this stuff from happening.

I got a copyright infringement claim against me for uploading a video of myself watching the last 2 minutes of a football match on TV. It's a video of me watching a match on TV. It's not the footage, it's the room where the TV was, the background, the edges of the television, the screen, and me talking over the top. How on earth have I infringed anyone's copyright with that? If I video something live, and what I capture on my screen is something happening in the world, does the person who was doing that thing have the right to claim my video as their property? It's in the privacy of my own home. Can I demand the rights to any image taken of ME in the same way??

@@danfm200 unfortunately yes. People even used to go a movie, film the entire thing on a small camcorder and sell a bootleg dvd of the film. There are many ways people can film a screen to steal other people’s content.

@@Abdur_Rehman10. Why do you say that they are not the owner? UEFA content that you take from another channel is still UEFA's intellectual property and it's up to them to decide who gets to use it. Where you got the footage from doesn't matter one bit. The only thing that matters is what's in the footage.

Good and informative video. Just for my own understanding, I want to ask about my exact situation. I'm just starting my own channel, focused on backcountry camping, fishing/hunting content, with the goal of becoming monetized. However, I am a huge Cubs fan. And the thought came to mind about taking a weeks worth of games, and creating a short highlight reel of the top plays and adding music in the background. (Ive got an account with EpidemicSound and I know I'm ok as far as that goes) And the other day I made a 4 minute video from the previous 5 games with music. Right after i uploaded it, it had already said "copyright" Not copyright claim or copyright strike...just copyright. I immediately deleted it as I don't want to risk getting my channel in trouble. If I were to start making those videos...do you think I'd be "playing with fire" and risking the future of my channel...or do you think I'd ultimately be ok. Would love any help or suggestions of what i could or should not do.

It was definitely a copyright claim. A claim doesn't affect your channel at all. It only prevents you from making money with that specific video. A strike affects your entire channel and does not disappear just because you delete the video that created it. So, as far as copyrights are concerned, you can upload MLB content and you'll just keep getting copyright claims. But personally, I wouldn't mix two different topics on the same channel. You'll just confuse your audience and the algorithm, and that will kill the reach and engagement of your channel as a whole.

No it will not. You get demonitized because KZitem recognizes that this footage belongs to someone else. You can add all the audio you want but it's not going to change that fact unfortunately.

@@Gucur KZitem doesn't demonitize channels. That's not a thing. They just demonitize individual videos. So if you upload a video with your own content, that video will be monetized if you are part of the partner program. otherwise, I do sell digital packs like LUTs, SFX and VFX but I don't sell courses yet.

Thanks for the video! A quick question, what is your guess of small portion of original video? For example I have 15 minutes of interview, but I would like to use 4 parts by 15 seconds from an in-game action from another video (which is for example 1 hour). I am using the video and on the background the voice of the interview. Do you think it's ok? Second case, I am using once again cover-up video, 5-6 parts by 20 seconds, a total of 2 minutes from 10 minutes highlights video to have a video background on 15 minutes interview. Does that qualify as a small portion? I am not using the commentary of the original video, only the picture.

It’s hard to say. There’s no official number. But is the interview yours or from someone else? Because if that’s not even yours, I doubt that your examples would be considered fair use.

Demonetizing on fair use of sports footage is ridiculous. The great plays are made by teams and players in an atmosphere created by fans and history. The people who have rights to film and distribute the footage shouldn’t own those moments. Just my two cents.

As someone who would greatly benefit from copyright free sports footage, I kind of disagree. Put yourself in their shoes. If you were investing 100’s of millions of dollars to acquire de broadcast rights of a sports league and everyone else was using your content for free and making money from it as well, you would probably try to stop it too.

problem with your video is its based on American law.. I live and work in Australia.. I shoot sports footage as a subcontractor, As such the organisation that has employed me is given permission by me to use footage as they wish. To me that does not entitle 3rd parties to use same footage for a news broadcast or sports report.

Hey there I actually moved to Canada a few months ago after living in Australia for the past 12 years shooting and editing sports videos as a subcontractor. If an organisation hires you to film something for them, technically they own the rights to the footage, not you. When I shot content for the A-League, the AFL or the NRL, the footage was never mine. It was always theirs. From then on, it’s up to them to decide how they choose to handle third parties.
