A freight broker license, also known as a Freight Broker Authority, is needed to legally operate as a freight broker in the United States.
To get your authority, you need to apply online at the Federal Motor Carrier Safety Administration website.
Begin the process by first obtaining a Personal Identification Number (li-public.fmcs...) from the FMCSA website.
Once you have your PIN number, you’re ready to submit an online OP-1 application for your MC Authority. If you want multiple licenses, for example to be a broker and a carrier, then you’ll have to file separate applications.
If you are a carrier, and you work in interstate commerce, you will also need to apply for a USDOT number. The USDOT Number serves as a unique identifier when collecting and monitoring a company's safety records.
If you want to also operate as a freight forwarder or a carrier, you will need to get liability insurance, and submit proof to the FMCSA. Liability insurance is not required if you only operate as a freight broker.
For each state in which your brokerage will be operating, you must also obtain a processing agent (www.fmcsa.dot..... The role of the processing agent is to address all legal documents if a claim is filed against your brokerage in that state.
Once you’ve obtained the necessary processing agents, you need to submit a BOC-3 form to both the FMCSA, and each state in which you’ll be operating.
You then need to obtain a $75,000 freight broker bond (bit.ly/3w9Ch7o), also known as BMC-84. The cost of your bond can range between $750 and $9,000 per year depending on your credit score, years in business, and other financial factors. The bond guarantees, to both shippers and motor carriers, that you will follow the rules of the FMCSA, and carry out your responsibilities as a freight broker.
The final step in the legal process is to obtain your Unified Carrier Registration which can be done at the UCR website (www.ucr.gov/). The UCR system registers and collects fees from the operators of vehicles engaged in interstate travel.
