I was receiving SSI until November 2003. The only reason it was stopped was because my father retired and I was transferred to disabled adult child which of course is much better than SSI and I'm glad I'm receiving it. However, when I reapplied for Medicaid every year, I don't understand why it shows I'm on Qualified Individual program. Was I supposed to be on QMB? Please answer so I can get this straightened out. I never hear of QMB until now. My father passed away three years ago so I'm entitled to 75 percent of his retirement.

Your income may be too high because you receive dad's disability benefit as a disabled adult child. QMB looks at all sources of income, including social security / disability income.

@elderneedslaw I used to draw ssi. My dad didn't become disabled, he retired at age 62. Am I pickle eligible for QMB?

@@dmana3172 I'm not certain what "pickle" eligible means. QMB just looks at your income and assts (from all sources) and if you are under their threshold, you qualify. If not, then additional planning is needed.

My son is a disabled adult child on SSDI and medicare. He was given QMB when his SSDI was approved. He must reapply yearly. He lives at home, pays his own bills and is not claimed as a dependent. The my Florida site asks for the income of everyone in the home. Can my son be his own household without claiming parents assets? I don't want to charge him rent as it's taxable income to me. I would rather he put his extra money in his ABLE account. I can't find these answers anywhere. Thank you.

Your income/assets (even if living in same house) does not impact your adult son's eligibility for SSDI or QMB benefits. Using an ABLE account is an excellent idea for excess resources (up to the yearly cap).

So you're saying that that the higher SSDI benefit of a DAC whose SSI and medicaid was stopped after qualifying for SSDI (as a DAC) and medicare is still counted despite the wording of 42 USC section 1383c)? Well that explains why I can't get QMB or a D-SNP Part C advantage plan.

In Florida, you can still qualify for QMB, despite income being above threshold, by utilizing a Pooled Special Needs Trust.

My sibling has no applicable assets and is over the income limit by $23 dollars. What can they do to appeal the denial?

Hi there - if your sibling is interested in QMB Medicaid in Florida, and has too much income, a pooled trust needs to be opened (and the extra $23 transferred to the trust every month). Once the trust is created and properly funded, you would need to reapply. Feel free to call our office to schedule a consultation to discuss how pooled special needs trusts work and how to get one set up!
