I'm so happy rn and thanks to Cyber Credible it was difficult filling out my car title I just got a Mercedes for the dealership and they left me to fill everything without experience...

When you say in the presence of a notary, does it have to be a notary in the state of Ohio? I’m trying to sell a car that is titled in the state of Ohio in the state of Colorado. It seems like no one can give me a clear answer on this?

I would encourage everyone to contact their bank notary and let them tell you what needs to be done. Mine is willing to do the sellers portion without the buyers information but highly encouraged me to keep that title locked up until money is exchanged. My bank notary is only concerned with my signature.

An Ohio notary is only responsible for the signers (seller) signature, NOT the buyers printed name. An Ohio notary has nothing to do with the back of the title as it is a contract/buyers order. An Ohio notary is NOT a licensed attorney. An Ohio notary has no responsibility to the printed buyers name at all and it does not need to be filled out while notarizing the sellers signature. Don't believe what you hear, read the LAW. An Ohio notary is independent of the clerk of court and the court itself and receives their power from the Governor.

I would recommend that you read the back of the new Ohio title. It clearly states that everything on the top half of the page must be filled out in the presence of the notary. Feel free to check with any of your local Ohio title offices to verify. Both title offices and major banks will refuse to notarize a title unless the buyer's name is present.

@@josiah_at_fueled_by_diesel Not true, I have been an Ohio Notary for 20 years. I also dabble in cars. I have yet to have a notary at a bank near me worry about the top have being filled out and I bought and sold a lot of cars over the years. Also I follow the ORC or Ohio law, just because the form say so does not mean the law agrees with it. I'm only responsible for the sellers signature, NOTHING ELSE. The Ohio BMV cannot force a notary to practice law by filling out the form or "demanding" that it is filled out as we are not lawyers.. It is up to the seller to make sure. An Ohio notary is only a witness for the State that the person is who they are and that they signed the signature. Our power comes directly from the Ohio Governor and we are independent of the courts.

My renewal is due this year though (I think you actually have to renew online now instead of at the county courthouse) and I will clarify the notary's responsibility with them. I represent a dealership and deal with the Ohio BMW daily and they are non-negotiable regarding the entire top half of the title being filled out in the presence of a notary. I appreciate your feedback as well.

@@josiah_at_fueled_by_diesel How can you renew online when they have to re-swear you in? Curious about that? I will have to ask when I go down there. I originally became a notary to notarize title for my dealership years ago. Did you know that notaries have the powers of arrest? In certain situations Notaries can write their own arrest warrants.

Dude when it cones to previous owners and owners wtf are you talking about?? I get you making an educational video but the way you just (car salesman’d) through the most important part of the title is confusing af.. I’m an Indiana resident and I’m buying a Harley tomorrow from a guy in Ohio. But the way you just ZIPPED through the most important part ie. the owners section has me confused af.. in Indiana we don’t need a notarized title so I’m new to this.. next time actually explain what you’re sayin in NON USED CAR SALESMEN LANGUAGE!! How old are you? Seriously grow up. You should have gone through courses if you’re notarizing and if not get off your high horses and just go to the dang bank to have them tell you how it’s done 😂
